Second Regular Meeting
April 21, 2020
The official record of proceedings of the second regular meeting of the Evanston City Council for the month
of April was held in the Council Chambers of City Hall on the above date. These proceedings were video
recorded.
Council member Lynch led those in attendance in the Pledge of Allegiance to the Flag.
The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30
p.m. and welcomed everyone present.
Those present from the governing body at the start of the meeting were: Mayor Williams; Councilmembers
Tim Lynch, Tib Ottley, Evan Perkes, David Welling, Mike Sellers, and Mikal Welling.
Staff members present at the start of the meeting were: City Attorney, Dennis Boal; City Clerk, Nancy
Stevenson; Director of Engineering & Planning, Dean Barker; Police Chief, Jon Kirby; and Payroll/HR
Specialist, Diane Harris. Community Development Director, Rocco O’Neill; City Treasurer, Trudy Lym; Public
Works Director, Gordon Robinson; Director of Parks and Recreation, Scott Ehlers were excused. A group
of interested citizens were also present.
Approve Agenda
Council member D. Welling moved, Council member Sellers seconded, to approve the agenda. The
motion passed unanimously with 7 yes votes: Williams, Lynch, Ottley, Perkes, D. Welling, Sellers, M. Welling.

Council Comments
Council member Lynch reminded everyone to be safe and continue social distancing.
Council member Perkes agreed to continue to social distance.
Council member Sellers recognized the passing of Mike Erickson, a prominent business person in the City
and a veteran. Appreciation to BPI for their generous donation of hand sanitizer to the community.
Grateful for the warmer weather as people suffering with depression can get outside.
Ordinance 20-09
Council member D. Welling moved, Council member Ottley seconded, to pass Ordinance 20-09 on
second reading.
ORDINANCE 20-09: AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING, VACATING THE TWIN
RIDGE SUBDIVISION NO. 4 –PHASE 4 TO THE CITY OF EVANSTON, AS MORE PARTICULARLY
DESCRIBED HEREIN.
The motion to pass Ordinance 20-09 on second reading passed unanimously with 7 yes votes: Williams,
Lynch, Ottley, Perkes, D. Welling, Sellers, M. Welling.
Ordinance 20-10
Council member D. Welling moved, Council member Ottley seconded, to pass Ordinance 20-10 on
second reading.
ORDINANCE 20-10: AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING, VACATING THE TWIN
RIDGE SUBDIVISION NO. 4 –PHASE 5 TO THE CITY OF EVANSTON, AS MORE PARTICULARLY
DESCRIBED HEREIN.
The motion to pass Ordinance 20-10 on second reading passed unanimously with 7 yes votes: Williams,
Lynch, Ottley, Perkes, D. Welling, Sellers, M. Welling.
Ordinance 20-11
Council member Perkes moved, Council member Lynch seconded, to table Ordinance 20-11 to the
second meeting in August (August 18th).
ORDINANCE 20-11: AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING, VACATING A PORTION
OF THE RANCH AT EVANSTON PHASE NO. 1 SUBDIVISION TO THE CITY OF EVANSTON, AS MORE
PARTICULARLY DESCRIBED HEREIN.
The motion to table Ordinance 20-11 passed unanimously with 7 yes votes: Williams, Lynch, Ottley, Perkes,
D. Welling, Sellers, M. Welling.
Ordinance 20-12
Council member M. Welling moved, Council member Sellers seconded, to pass Ordinance 20-12 on
second reading.
ORDINANCE 20-12: AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING, AMENDING SECTION
23-70. B. OF THE CITY CODE BY MODIFYING THE PH PARAMETERS OF ACCEPTABLE WASTEWATER
IN SUBSECTION (3) AND REPEALING SUBSECTION (22) TO DELETE THE LIMITATION OF AMMONIA
FOR DISCHARGE INTO THE MUNICIPAL WASTEWATER SYSTEM.

Ordinance 20-13
Council member D. Welling sponsored Ordinance 20-13. Council member M. Welling moved, Council
member Ottley seconded, to pass Ordinance 20-13 on first reading.
ORDINANCE 20-13: AN ORDINANCE APPROVING AND AUTHORIZING THE FINAL PLAT FOR THE
RIVERBIRCH ADDITION, LOCATED IN THE CITY OF EVANSTON, WYOMING, BEING MORE
PARTICULARLY DESCRIBED HEREIN.
The motion to pass Ordinance 20-13 on first reading passed unanimously with 7 yes votes: Williams, Lynch,
Ottley, Perkes, D. Welling, Sellers, M. Welling.
Resolution 20-27
Council member Lynch introduced Resolution 20-27. Council member Lynch moved, Council member
Sellers seconded, to adopt Resolution 20-27.
RESOLUTION 20-27 RESOLUTION AUTHORIZING THE CITY OF EVANSTON, WYOMING TO ENTER
INTO AN AGREEMENT AND ADDENDUM WITH UTAH YAMAS CONTROLS TO PROVIDE AN
UPGRADED ACCESS CONTROL SYSTEM FOR THE POLICE DEPARTMENT.
WHEREAS, the City has need to upgrade the access control system for the building housing the City’s
Police Department and one door in the Machine Shop; and
WHEREAS, Utah Yamas Controls has submitted the best proposal to the City to provide the
upgraded access control system for the Police Department and the one door in the Machine Shop;
NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
EVANSTON, WYOMING THAT:
Section 1: The Mayor is hereby authorized to sign, and the City Clerk is hereby authorized to attest,
on behalf of the City, the Agreement and Addendum with Utah Yamas Controls City to provide an upgraded
access control system for the Police Department and one door in the Machine Shop.

Resolution 20-28
Council member M. Welling introduced Resolution 20-28. Council member M. Welling moved, Council
member Perkes seconded, to adopt Resolution 20-28.
RESOLUTION 20-28: A RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE
EXECUTION OF A NOTICE OF GRANT AND AGREEMENT AWARD WITH THE UNITED STATES
DEPARTMENT OF AGRICULTURE, NATURAL RESOURCES CONSERVATION SERVICE, (NRCS), TO
OBTAIN FUNDS FOR PLANNING AND DESIGN OF THE BEAR RIVER AND YELLOW CREEK
WATERSHED PROJECT.
WHEREAS, there are funds available from NRCS which could be used by the City to environmentally
assess, plan and design improvements for the Bear River and Yellow Creek watershed which impact the City
of Evanston; and
WHEREAS, it is necessary for the City to enter into the attached Notice of Grant and Agreement
Award in order to receive the grant funds;
NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, Wyoming as
follows:
Section 1. The Mayor and City Clerk are authorized to sign and attest on behalf of the City the
attached Notice of Grant and Agreement Award with NRCS to obtain funds for the Bear River and Yellow
Creek Watershed Project.

Resolution 20-29
Council member Sellers introduced Resolution 20-29. Council member Sellers moved, Council
member D. Welling seconded, to adopt Resolution 20-29.
RESOLUTION 20-29: RESOLUTION OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE
EXECUTION OF A AGREEMENT WITH CONSTRUCTION MATERIAL RECYCLING INC. FOR THE
COMPLETION OF ALL WORK AS SET FORTH IN THE AGREEMENT FOR THE HARRISON STORM
DRAIN REPLACEMENT PROJECT.
WHEREAS, the City of Evanston has determined there is a need to replace a storm drain located on
Harrison Drive in Evanston, Wyoming; and
WHEREAS, Construction Material Recycling Inc. has submitted the low bid for the project; and
WHEREAS, the City of Evanston and Construction Material Recycling Inc. are prepared to enter into
an agreement whereby Construction Material Recycling Inc. will provide all materials and labor specified in
the plans and specifications and the bid documents for the Harrison Storm Drain Replacement Project;
NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
EVANSTON, WYOMING THAT:
Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City
of Evanston, the Agreement between the City of Evanston, as Owner, and Construction Material Recycling
Inc., as Contractor, for completion of all work necessary for the Harrison Storm Drain Replacement Project.

City View Water Main Phase II
Council member Ottley moved, Council member D. Welling seconded to award the bid for the City View Water
Main Phase II Project to SCI, Inc., the apparent low bidder meeting all City specifications, in the amount of
$792,708.00.
The motion passed unanimously with 7 yes votes: Williams, Lynch, Ottley, Perkes, D. Welling. Sellers, M.
Welling.
