First Regular Meeting
April 7, 2020
The official record of proceedings of the first regular meeting of the Evanston City Council for the month of
April was held in the Council Chambers of City Hall on the above date. These proceedings were video
recorded.
Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag.
The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30
p.m. and welcomed everyone present.
Those present from the governing body at the start of the meeting were: Mayor Williams; Councilmembers
Tim Lynch, Tib Ottley, Evan Perkes, David Welling, Mike Sellers, and Mikal Welling.
Staff members present at the start of the meeting were: City Attorney, Dennis Boal; City Clerk, Nancy
Stevenson; City Treasurer, Trudy Lym; Director of Engineering & Planning, Dean Barker; Public Works
Director, Gordon Robinson; and Payroll/HR Specialist, Diane Harris. Community Development Director,
Rocco O’Neill; Police Chief, Jon Kirby; and Director of Parks and Recreation, Scott Ehlers were excused.
A group of interested citizens were also present.
Approve Agenda
Council member M. Welling moved, Council member Sellers seconded, to approve the agenda. The
motion passed unanimously with 7 yes votes: Williams, Lynch, Ottley, Perkes, D. Welling, Sellers, M. Welling.
Approve Minutes
The official record of proceedings for the City Council Meeting held March 17, 2020 was approved as
presented.

Revenue & Expenditure Report
Council member D. Welling moved, Council member Perkes seconded, to approve the Revenue and
Expenditure Reports for January and February 2020. The motion passed unanimously with 7 yes votes:

Council Comments
Council member Lynch reminded everyone to be safe during this time.
Council member Sellers thanked the healthcare providers and first responders for their vigilance and reminded
everyone to support our small businesses.
Mayor Williams recognized everyone for social distancing. He encouraged everyone that we will weather this
storm and learn a lot from it. He reminded everyone to be safe and use common sense. He also recognized
Jeff Martin, the Manager at the Water Treatment Plant and congratulated him on his retirement after 37 years
of service.
Appointment to Boards/Commissions
Mayor Williams made an appointment to the following board. Council member Lynch moved, Council
member Ottley seconded, to confirm the following appointment:
Historic Preservation Commission
Cindy Wasson - January 2023

Public Hearing/Liquor License
City Attorney Dennis Boal conducted a public hearing to receive public comment regarding an application to
transfer the ownership of a Retail Liquor License from Evanston Golf Club Inc., dba: Evanston Golf Club, Inc.
to WYOGASTRO, LLC., dba: The Pub at Purple Sage. Mick Kindler, sole owner of WYOGASTRO, LLC.,
explained the reason for the transfer and future plans for the restaurant and bar. No one else addressed the
issue and the hearing was closed.
Transfer/Liquor License/Evanston Golf Club
Council member Ottley moved, Council member Lynch seconded, to approve the transfer of
ownership of a Retail Liquor License from Evanston Golf Club Inc., dba: Evanston Golf Club, Inc., to
WYOGASTRO, LLC., dba: The Pub at Purple Sage. The motion passed unanimously with 7 yes votes:
Williams, Lynch, Ottley, Perkes, D. Welling, Sellers, M. Welling.
Public Hearing
City Attorney, Dennis Boal conducted a public hearing to solicit public comments regarding the intent
to vacate a portion of the Twin Ridge Subdivision No. 4 - Phase 4; the Twin Ridge Subdivision No. 4 -
Phase 5 and a portion of The Ranch at Evanston Phase No. 1 Subdivision. Dean Barker explained the
reason for the vacations. No one else addressed this proposal and the hearing was closed.
Ordinance 20-09
Council member D. Welling sponsored Ordinance 20-09. Council member Lynch moved, Council

ORDINANCE 20-09: AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING, VACATING THE TWIN

Ordinance 20-12

ORDINANCE 20-12: AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING, AMENDING SECTION
23-70. B. OF THE CITY CODE BY MODIFYING THE PH PARAMETERS OF ACCEPTABLE WASTEWATER
IN SUBSECTION (3) AND REPEALING SUBSECTION (22) TO DELETE THE LIMITATION OF AMMONIA
FOR DISCHARGE INTO THE MUNICIPAL WASTEWATER SYSTEM.

Resolution 20-22
Council member Lynch introduced Resolution 20-22. Council member Lynch moved, Council member
Perkes seconded, to adopt Resolution 20-22.
RESOLUTION 20-22 A RESOLUTION APPROVING AND AUTHORIZING THE FINAL PLAT FOR THE
KNEZOVICH ADDITION, A SUBDIVISION WITHIN THE CITY OF EVANSTON, WYOMING AS MORE
PARTICULARLY DESCRIBED HEREIN.
WHEREAS, on February 18, 2020, the governing body of the City of Evanston adopted Resolution
20-10 which approved the subdivision entitled the Knezovich Addition, at the request of the Subdivider, Paula
Knezovich and Ozzie Knezovich; and
WHEREAS, the Subdivider has learned that it will be difficult and onerous to obtain the required
Mortgagees consent for the subdivision; and
WHEREAS, the Subdivider has decided to revise and re-submit a new plat to the City for the
Knezovich Addition which does not include the lot that necessitated the Mortgagees consent;
WHEREAS, the City of Evanston finds that said subdivision as revised, is a minor subdivision and can
be approved pursuant to Section 22-10 of the Evanston City Code;
NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, Wyoming,
that:
Section 1. The final plat of the Knezovich Addition, as revised by the Subdivider is hereby approved,
accepted and authorized and described in particularity as follows, to-wit:
Knezovich Addition to the City of Evanston, Wyoming, located in the NE1/4 SW1/4 of Section 21,
Township 15 North, Range 120 West, 6th P.M., City of Evanston, Uinta County, Wyoming, lying entirely within
the corporate limits of the City of Evanston, and being more particularly described as follows:
Commencing at the Southernmost corner of Block 44 of the Union Pacific Railway Company's First
Addition to Evanston, Wyoming, as said Addition is platted and recorded in the Office of the Uinta County
Clerk, and running thence S 42°47'43" W, 80.00 feet along the Northwesterly boundary of Second Street to
the intersection of said Northwesterly boundary of Second Street with the Southwesterly boundary of Center
Street and the POINT OF BEGINNING;
thence continuing S 42°47'43" W, 140.00 feet along said Northwesterly boundary of Second Street
to the Southernmost corner of that parcel of land described by Quit Claim Deed in Book 1083 on Page 598
of the Uinta County Records (312 Second Street Parcel);

Said Knezovich Addition containing 0.321 acres, more or less.
Section 2. The Mayor and City Clerk are hereby authorized and directed to enforce the mandates of
chapter 22 of the Code of the City Evanston with regard to the filing of the final plat with the County Clerk of
Uinta County, Wyoming as by law required.

RESOLUTION 20-23: A RESOLUTION APPROVING AND AUTHORIZING THE FINAL PLAT FOR THE
CHAMBERLAIN ADDITION, A SUBDIVISION WITHIN THE CITY OF EVANSTON, WYOMING AS MORE
PARTICULARLY DESCRIBED HEREIN.
WHEREAS, the William Von Chamberlain and Alice Jean Chamberlain as Trustees of the William
Von Chamberlain and Alice Jean Chamberlain Living Trust and Christopher L. Dalley, Trustee of DAS
Financial, a Nevada Business Trust, (“Subdivider”), has made application to the governing body of the City
of Evanston, Wyoming for approval and authorization of the proposed subdivision entitled the Chamberlain
Addition, a subdivision located within the City of Evanston, Wyoming; and
WHEREAS, the City of Evanston finds that said subdivision is a minor subdivision and can be
approved pursuant to Section 22-10 of the Evanston City Code.
NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, Wyoming,
that:
Section 1. The final plat of the Chamberlain Addition is hereby approved, accepted and authorized
and described in particularity as follows, to-wit:
The Chamberlain Addition is a subdivision of Lot 4 of the Grass Valley Addition Amended, as shown

Council member Ottley introduced Resolution 20-24. Council member Ottley moved, Council member

RESOLUTION 20-24: RESOLUTION OF THE CITY OF EVANSTON, WYOMING TO AMEND A PORTION
OF THE CITY'S MASTER PLAN TO AUTHORIZE A LOW DENSITY RESIDENTIAL-DEVELOPING ZONE,
AS REQUESTED BY THE LANDOWNERS OF THE REAL PROPERTY MORE PARTICULARLY
DESCRIBED HEREIN.
WHEREAS, a public hearing was held by the Planning and Zoning Commission of the City of
Evanston on February 3, 2020, to consider amending the City's Master Plan, (the 2010 Plan), to authorize a
low density residential-developing Zone for the real property described below as requested by property owner,
Bart Hutchinson; and
WHEREAS, Section 2-72 C. requires that an amendment to the Master Plan be approved by two
thirds of the members of the Planning and Zoning Commission;
WHEREAS, after receiving testimony and evidence from the applicants, affected landowners and the
public at large, the Commission members present at the hearing, unanimously voted to recommend the
approval of the proposed master plan amendment;
NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
EVANSTON, WYOMING THAT:
Section 1: The Master Plan of the City of Evanston is hereby amended to authorize a low density
residential-developing zone for the real property described below:

RESOLUTION 20-25: RESOLUTION OF THE CITY OF EVANSTON, WYOMING TO AMEND A PORTION

RESOLUTION 20:26: RESOLUTION OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE
EXECUTION OF THE EMPLOYERS PLAN SELECTION AND NOTICE AND ACKNOWLEDGMENT
REQUIRED BY WYOMING EDUCATORS BENEFIT TRUST, (WEBT) TO CONTINUE THE CITY’S
MEDICAL PLAN FOR CITY EMPLOYEES.
WHEREAS, the City of Evanston desires to continue providing a medical plan for its employees by
executing the attached Employer Plan Selection and Notice and Acknowledgment with WEBT;
NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
EVANSTON, WYOMING THAT:
Section 1: The Mayor is hereby authorized to execute on behalf of the City of Evanston the attached
Employer Plan Selection and Notice and Acknowledgment with WEBT to continue providing a medical plan
for its employees.
