EVANSTON CITY COUNCIL Second Regular Meeting December 15th, 2020 The official record of proceedings of the second regular meeting of the Evanston City Council for the month of December was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded. Council member Sellers led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Williams; Council members Tim Lynch, Tib Ottley, Evan Perkes, and Mike Sellers. David Welling and Mikal Welling were excused. Staff members present at the start of the meeting were: City Attorney, Dennis Boal; City Treasurer, Trudy Lym; Senior Planner, DuWayne Jacobson; Public Works Director, Gordon Robinson; City Clerk, Diane Harris; Community Development Director, Rocco O’Neill and Lieutenant of Investigations, Rhett Groll. Director of Parks and Recreation, Scott Ehlers,; Police Chief, Jon Kirby and City Engineer, Dean Barker were excused. A group of interested citizens were also present. Council Comments Council member Lynch reminded everyone to stay safe. He also wished everyone a Merry Christmas. Council member Sellers commented that there are nine days until Christmas and to shop local. He also reminded everyone that there are people continuing to struggle and to reach out if you can. Appointment to Boards/Commissions Mayor Williams made appointments to the following boards. Ordinance 20-15 Council member Ottley moved, Council member Sellers seconded, to pass Ordinance 20-15 on third and final reading. AN ORDINANCE APPROVING AND AUTHORIZING A ZONE CHANGE FOR PROPERTY IN THE CITY OF EVANSTON FROM A PUBLIC ZONE TO A LIGHT INDUSTRIAL DEVELOPING ZONE, FOR A PORTION OF LOT 1, BLOCK 2 OF THE UNION CENTER 2nd ADDITION AS REQUESTED BY THE CITY OF EVANSTON. WHEREAS, the City has filed an application with the Planning and Zoning Commission of the City of Evanston, Wyoming to change the zoning of a portion of the property described below from a public zone to a light industrial developing zone; and WHEREAS, the Planning and Zoning Commission scheduled a public hearing for said application on November 2, 2020; and WHEREAS, notice of the public hearing and application was published in a newspaper of general circulation and notices of the hearing were mailed to affected landowners pursuant to City Ordinance and posted on property; and WHEREAS, a public hearing was held by the Planning and Zoning Commission of the City of Evanston on November 2, 2020, to consider said application for a zone change; and WHEREAS, after receiving testimony and evidence from the applicant, affected landowners and the public at large, the Planning and Zoning Commission voted to recommend to the governing body that it approve the zone change. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING, THAT: Section 1. The request by the City of Evanston to change the zoning of the property described below, from a public zone to a light industrial developing zone is hereby approved and authorized. Said real property being more particularly described as follows: All of Lot 1 of Block 2 of the Union Center 2nd Addition to the City of Evanston, Uinta County, Wyoming. Section 2. A RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE EXECUTION OF A REIMBURSEMENT AGREEMENT WITH THE STATE LOAN AND INVESTMENT BOARD TO OBTAIN GRANT FUNDS TO REIMBURSE THE CITY FOR THE PURCHASE AN AMBULANCE BECAUSE OF THE CORONAVIRUS PANDEMIC.  WHEREAS, the City has been awarded a Coronavirus Relief Grant to recapture funds expended during the 2020 Coronavirus pandemic to purchase an ambulance to be used by the Uinta County Fire and Ambulance District to provide essential health care services during the coronavirus pandemic; and WHEREAS, it is necessary for the City to execute the attached Reimbursement Agreement with the State Loan and Investment Board to obtain the grant funds; NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, Wyoming as follows: Section 1. The Mayor and City Clerk are hereby authorized to sign and attest the attached Reimbursement Agreement with the State Loan and Investment Board to obtain grant funds to reimburse the City for the purchase of an ambulance to be used by the Uinta County Fire and Ambulance District to provide essential health care services during the coronavirus pandemic. A RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE SUBMISSION OF AN APPLICATION TO THE STATE FORESTER FOR THE CITY OF EVANSTON TO BE OFFICIALLY RECERTIFIED AS A TREE CITY USA FOR YEAR 2021. WHEREAS, City of Evanston has been previously certified as a Tree City USA by the State Forester; and WHEREAS, the governing body has determined that it is in the public’s interest to apply for recertification; NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, Wyoming as follows: Section 1. The City of Evanston hereby authorizes the submission of an application to the State Forester for the City of Evanston to be recertified as a Tree City USA. Section 2. RESOLUTION 20-97 Council member Ottley introduced Resolution 20-97. Council member Ottley moved, Council member Sellers seconded, to adopt Resolution 20-97. RESOLUTION OF THE CITY OF EVANSTON, WYOMING TO AMEND A PORTION OF THE CITY'S MASTER PLAN TO AUTHORIZE A LIGHT INDUSTRIAL DEVELOPING ZONE, FOR A PORTION OF LOT 1, BLOCK 2 OF THE UNION CENTER 2nd ADDITION AS REQUESTED BY THE CITY OF EVANSTON. WHEREAS, a public hearing was held by the Planning and Zoning Commission of the City of Evanston on November 2, 2020, to consider amending the City's Master Plan, (the 2010 Plan), to authorize a light industrial developing zone, for a portion of Lot 1, Block 2 of the Union Center 2nd Addition as requested by the City of Evanston; and WHEREAS, Section 2-72 C. of the City Code requires that an amendment to the Master Plan be approved by two thirds of the members of the Planning and Zoning Commission; WHEREAS, after receiving testimony and evidence from the applicant, affected adjacent landowners and the public at large, the Commission members present at the hearing, unanimously voted to recommend the approval of the proposed master plan amendment; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Master Plan of the City of Evanston is hereby amended to authorize a light industrial developing zone, for a portion of Lot 1, Block 2 of the Union Center 2nd Addition as requested by the City of Evanston Section 2: The Mayor, City Clerk and City Planning Department are authorized to undertake all steps necessary to amend the Master Plan as set forth herein. PASSED, APPROVED AND ADOPTED this 15th day of December, 2020.
