EVANSTON CITY COUNCIL Second Regular Meeting December 19th, 2023 The official record of proceedings of the second regular meeting of the Evanston City Council for the month of December was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded and streamed live. Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Williams called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Williams; Council members, Tim Lynch, Jesse Lind, Evan Perkes, Dave Welling, Mike Sellers and Jen Hegeman. Staff members present at the start of the meeting were: City Attorney/Prosecutor, Mark Harris; City Treasurer, Trudy Lym; City Clerk, Diane Harris; Director of Parks and Recreation, Kim Larson; Police Chief, Mike Vranish; Public Works Director, Gordon Robinson; City Engineer, Dean Barker, Senior Planner, DuWayne Jacobsen and Information Technology Coordinator, Preston Sheets. Community Development Director, Rocco O’Neil was excused. A group of interested citizens was also present. Approve Agenda Council member Welling moved, Council member Perkes seconded to approve the agenda. The motion passed unanimously with 7 yes votes: Williams, Lynch, Lind, Perkes, Welling, Sellers, Hegeman. Approve Minutes The official record of proceedings for the City Council Meeting held December 5th, 2023 and City Council Work Session held December 12th, 2023 was approved as presented. Council Comments The Mayor and Council members expressed gratitude to the Department Heads and employees for their hard work throughout the year. They also wished everyone a Merry Christmas and Happy Holidays. Council member Sellers reminded everyone to shop local and to be aware of people that may be struggling. Council member Hegeman thanked all Service members, especially at the Holidays, as they are away from their families. Resolution 23-81 Council member Lynch introduced Resolution 23-81. Council member Lynch moved, Council member Sellers seconded, to adopt Resolution 23-81. A RESOLUTION APPROVING AND AUTHORIZING THE FINAL PLAT OF THE ARNEXUS CONDOMINIUMS 2023 ADDITION, A SUBDIVISION OF PART OF LOT 1 OF THE ARNEXUS ADDITION TO THE CITY OF EVANSTON, AS MORE PARTICULARLY DESCRIBED HEREIN. WHEREAS, George L. Arnold, P.C., George L. Arnold, individually, Fraughton Real Estate LLC and Mark E. Day and Kristeen Day (the ASubdivider@), have made application to the governing body of the City of Evanston, Wyoming for approval and authorization of the proposed subdivision entitled the "Arnexus Condominiums 2023 Addition" to the City of Evanston, Uinta County, Wyoming, a subdivision of part of Lot 1 of the Arnexus Addition to the City of Evanston, located within the City of Evanston, Wyoming; and WHEREAS, the City of Evanston finds that said subdivision is a minor subdivision and can be approved pursuant to Section 22-10 of the Evanston City Code. NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING, THAT: Section 1. The final plat of the Arnexus Condominiums 2023 Addition is hereby approved, accepted, and authorized and described in particularity as follows, to-wit: "Arnexus Condominiums 2023 Addition" to the City of Evanston, Uinta County, Wyoming, is a subdivision of part of Lot 1 of the Arnexus Addition to the City of Evanston, as said Arnexus Addition is platted and recorded in the Office of the Uinta County Clerk under Entry No. R19965, and of the Arnexus Condominiums, City of Evanston, as said Arnexus Condominiums are platted and recorded in the Office of the Uinta County Clerk under Entry No. 26139, said Arnexus Condominiums 2023 Addition being located in the SE1/4 SE1/4 of Section 20, Township 15 North, Range 120 West, 6th P.M., Uinta County, Wyoming, and being more particularly described as follows: A parcel of land BEGINNING at the Southeast corner of the Common Area of said Arnexus Condominiums and running thence S 89°46'52" W, 37.87 feet along the South boundary of said Common Area to the Southwest corner thereof; thence N 45°41'08" W, 159.24 feet along the Southwest boundary of said Common Area to the Westernmost corner thereof; thence N 42°46'52" E, 221.98 feet along the Northwesterly boundary of said Common Area and the Northwesterly boundary of said Lot 1 to the Northeast corner of said Lot 1; thence S 0°13'08" E, 274.02 feet along the East boundary of said of said Lot 1 and the East boundary of said Common Area to the POINT OF BEGINNING. Section 2. The Mayor and City Clerk are hereby authorized and directed to enforce the mandates of chapter 22 of the Code of the City Evanston with regard to the filing of the final plat with the County Clerk of Uinta County, Wyoming as by law required. Resolution 23-82 Mayor Williams recused himself from discussion and consideration of Resolution 23-82 due to his review of the Subdivision subject to the Resolution on behalf of Uinta County, Wyoming as part of his duties as County Planner. Council President Sellers then conducted the meeting for consideration of the Resolution. Council member Lynch introduced Resolution 23-82. Council member Lynch moved, Council member Perkes seconded, to adopt Resolution 23-82. A RESOLUTION APPROVING AND AUTHORIZING THE FINAL PLAT OF THE WARREN HALES SUBDIVISION, A SUBDIVISION LOCATED IN THE SW1/4 NE1/4 AND THE SE1/4 NW1/4 OF SECTION 8, T15N, R120W, 6TH P.M., UINTA COUNTY, WYOMING, AS MORE PARTICULARLY DESCRIBED HEREIN. WHEREAS, Warren Hales (the ASubdivider@), has made application to the governing body of the City of Evanston, Wyoming for approval and authorization of the proposed subdivision entitled the "Warren Hales Subdivision" located in the SW1/4 NE1/4 and the SE1/4 NW1/4 of Section 8, T15N, R120W, 6th P.M., Uinta County, Wyoming; and WHEREAS, said Subdivision plat is of land located within one (1) mile of the boundaries of the City of Evanston and requires joint approval of the City of Evanston, Wyoming and Board of County Commissioners of Uinta County, Wyoming; and WHEREAS, the Subdivision does not contain and does not require the completion of any public improvements and the City of Evanston has provided comment relating to impacts of the subdivision to the City’s infrastructure or development plans and any impacts identified have been addressed by the Subdivider and the plat can be approved pursuant to Section Wyo. Stat. § 34-12-103. NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING, THAT: Section 1. The final plat of the Warren Hales Subdivision is hereby approved, accepted, and authorized and described in particularity as follows, to-wit: "Warren Hales Subdivision" located in the SW1/4 NE1/4 and the SE1/4 NW1/4 of Section 8, T15N, R120W, 6th P.M., Uinta County, Wyoming, said Subdivision being part of that tract of land described by Warranty Deed in Book 2051 on Page 949 of the Uinta County Records (Hales Tract) and being more particularly described as follows: Commencing at the East one-quarter corner of said Section 8, said corner being identical with the Southeast corner of said Hales Tract, and running thence N 89°29'27" W, 2474.58 feet along the East-West center section line and the South boundary of said Hales Tract to the Southwest corner thereof; thence N 44°15'58" W, 17.92 feet along the Westerly boundary of said Hales Tract to the POINT OF BEGINNING; thence continuing N 44°15'58" W, 382.08 feet along the Westerly boundary of said Hales Tract to the Westernmost corner thereof; thence N 69°42'00" E, 618.17 feet along the Northern Boundary of said Hales Tract; thence leaving said Northerly boundary S 20°18'00" E, 224.97 feet; thence S 69°42'00" W, 188.67 feet; thence S 45°20'38" W, 301.09 to the POINT OF BEGINNING. Said Warren Hales Subdivision containing 3.404 acres, more or less. Section 2. The Mayor and City Clerk are hereby authorized to execute the final plat and are directed to enforce the mandates of Wyo. Stat. Section 34-12-103 with regard to the filing of the final plat with the County Clerk of Uinta County, Wyoming as by law required. Ordinance 23-06 Council member Perkes sponsored Ordinance 23-06. Council member Lind moved, Council member Welling seconded, to pass Ordinance 23-06 on first reading. AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING AMENDING SECTION 12-1., DEFINITIONS, OF THE CITY CODE TO MIRROR THE LANGUAGE OF THE STATE STATUTES FOR THE DEFINITION OF A STREET OR HIGHWAY. WHEREAS, there is a need to amend Section 12-1 of the City Code to mirror the language of the state statutes regarding the definition of a street or highway for purposes of enforcement of certain motor vehicle traffic laws; NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: Section 12-1 of the Evanston City Code is amended and re-enacted to provide as follows: ' 12-1. Definitions. A. For the purposes of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section: STREET OR HIGHWAY The entire width between the boundary lines of every way publicly maintained or if not publicly maintained, dedicated to public use when any part is open to the use of the public for purposes of vehicular travel "Street" and "highway" shall be construed to be synonymous in constructing this chapter. Section 2: This ordinance shall be effective on passage on third and final reading. PASSED and APPROVED on First Reading this 19th day of January 2023. The motion passed unanimously with 7 yes votes: Williams, Lynch, Lind, Perkes, Welling, Sellers, Hegeman. Department Comments Chief Vranish reported that the “Shop with a Cop” event was a success. He mentioned they helped 61 children this year. Everyone wished Dean Barker, City Engineer well and good luck on his new venture. He thanked everyone and remarked that he has enjoyed working for the City in his hometown. The Department Heads wished the Mayor and Council Happy Holidays. Public Comment Kayne Pyatt thanked Dean Barker, City Engineer for always being so kind and helping her whenever she had questions. She remarked that he will be missed.
