EVANSTON CITY COUNCIL First Regular Meeting January 2nd, 2024 The official record of proceedings of the first regular meeting of the Evanston City Council for the month of January was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded and streamed live. Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Williams called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Williams; Council members, Tim Lynch, Jesse Lind, Evan Perkes, Dave Welling, Mike Sellers and Jen Hegeman. Staff members present at the start of the meeting were: City Attorney/Prosecutor, Mark Harris; City Treasurer, Trudy Lym; City Clerk, Diane Harris; Director of Parks and Recreation, Kim Larson; Public Works Director, Gordon Robinson; City Engineer, Damon Newsome; Senior Planner, DuWayne Jacobsen; Information Technology Coordinator, Preston Sheets; Community Development Director, Rocco O’Neill and Police Lieutenant, Rhett Groll. Police Chief, Mike Vranish was excused. A group of interested citizens was also present. Approve Agenda Council member Sellers moved, Council member Welling seconded to approve the agenda with the following addition: Motion to accept bid under New Business. Revenue & Expenditure Report Council member Lynch moved, Council member Sellers seconded, to approve the Revenue and Expenditure Report for September and October 2023. The motion passed unanimously with 7 yes votes: Williams, Lynch, Lind, Perkes, Welling, Sellers, Hegeman. Council Comments The Mayor and Council members expressed condolences to Chief Michael Vranish and family for the loss of Mike’s father, Clarence Vranish. Clarence had served on the City Council, Uinta County House District 49 in the Wyoming House of Representatives and was an involved and upstanding citizen of Evanston for many years. The Mayor and Council also expressed sympathy for the families of the children tragically killed in a fire. Council member Sellers reminded everyone it is flu season and to remember to wash your hands. Council members Lind, Hegeman and Mayor Williams all addressed articles in the media pertaining to semi-truck parking areas and their positions regarding the issue. Appointment of Department Heads/Attorneys/Municipal Judges Council member Lynch moved, Council member Welling seconded, to confirm the Mayor’s appointments of the following Department Heads, Attorneys and Municipal Judges: Chief of Police - Mike Vranish Director of Engineering and Planning – Damon Newsome Director of Public Works – Gordon Robinson Community Development Director – Rocco O’Neill City Treasurer - Trudy Lym City Clerk/HR/Executive Asst. – Diane Harris City Attorney and City Prosecutor – Mark Harris Municipal Court Judge – Dean Stout  Alternate Municipal Court Judge - Clayton Thomas The motion passed unanimously with 7 yes votes: Williams, Lynch, Lind, Perkes, Welling, Sellers, Hegeman. Oath of Office City Clerk, Diane Harris conducted an Oath of Office for Damon Newsome to fill the position of City Engineer for the City of Evanston. Election of Council President Mayor Williams called for nominations for the election of Council President. Council member Sellers moved, Council member Lynch seconded, to nominate Evan Perkes as the City Council President for 2024. The motion passed unanimously with 7 yes votes: Williams, Lynch, Lind, Perkes, Welling, Sellers, Hegeman. Ordinance 23-06 Council member Lynch moved, Council member Welling seconded, to pass Ordinance 23-06 on second reading. AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING AMENDING SECTION 12-1., DEFINITIONS, OF THE CITY CODE TO MIRROR THE LANGUAGE OF THE STATE STATUTES FOR THE DEFINITION OF A STREET OR HIGHWAY. WHEREAS, there is a need to amend Section 12-1 of the City Code to mirror the language of the state statutes regarding the definition of a street or highway for purposes of enforcement of certain motor vehicle traffic laws; NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: Section 12-1 of the Evanston City Code is amended and re-enacted to provide as follows: ' 12-1. Definitions. A. For the purposes of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section: STREET OR HIGHWAY The entire width between the boundary lines of every way publicly maintained or if not publicly maintained, dedicated to public use when any part is open to the use of the public for purposes of vehicular travel "Street" and "highway" shall be construed to be synonymous in constructing this chapter. Section 2: This ordinance shall be effective on passage on third and final reading. PASSED and APPROVED on Second Reading this 2nd day of January 2024. Bid Award Council member Lind moved, Council member Lynch seconded, to accept the base bid for the apparent low bid for Shades Brewing Company Greyshell-Roundhouse Project to Tanner Construction, LLC as recommended by Community Development Director, Rocco O’Neill. The motion passed unanimously with 7 yes votes: Williams, Lynch, Lind, Perkes, Welling, Sellers, Hegeman. Resolution 24-01 Council member Sellers introduced Resolution 24-01. Council member Sellers moved, Council member Hegeman seconded, to adopt Resolution 24-01. A RESOLUTION OF THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING APPROVING CHANGE ORDER NO. 6 FOR THE 18TH, 19TH & WEST SUMMIT WATER REPLACEMENT PROJECT IN THE CITY OF EVANSTON. WHEREAS, the City of Evanston has previously authorized the 18th, 19th and West Summit Water Replacement Project, which is being constructed by Kilgore Companies, LLC dba Lewis & Lewis, and WHEREAS, the governing body has determined that it is in the public=s interest to approve Change Order No. 6 for the reasons set forth therein;  NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING, AS FOLLOWS: Section 1. Change Order No. 6 for the 18th, 19th and West Summit Water Replacement Project, a copy of which is attached hereto as Appendix “1”, is approved. Section 2. Resolution 24-02 Council member Welling introduced Resolution 24-02. Council member Welling moved, Council member Perkes seconded, to adopt Resolution 24-02. A RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE SUBMISSION OF AN APPLICATION TO THE STATE FORESTER FOR THE CITY OF EVANSTON TO BE OFFICIALLY RECERTIFIED AS A “TREE CITY USA” FOR YEAR 2023. WHEREAS, City of Evanston has been previously certified as a Tree City USA by the State Forester; and WHEREAS, the governing body has determined that it is in the public’s interest to apply for recertification for 2023; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING, AS FOLLOWS: Section 1. The City of Evanston hereby authorizes the submission of an application to the State Forester for the City of Evanston to be recertified as a “Tree City USA” for the year 2023. Section 2. The Mayor and City Clerk are authorized to sign and attest all documents which are necessary to apply for the recertification. Department Comments Evanston Parks & Rec Director explained how the Community Tree Program works. Department Heads all thanked the Mayor and Council for their reappointments.
