Board of Adjustment/Planning Commission Meeting Minutes
September 17, 2018

Chairperson Thompson called the meeting to order at 6:00 p.m.
Chairperson Thompson asked for a motion to approve the agenda for the September
17, 2018 meeting. A motion was made by Commissioner Huggins, seconded by
Commissioner Beaudry. The motion carried unanimously.
Chairperson Thompson asked for a motion to approve the minutes from the July 2,
2018 meeting of the Planning Commission/Board of Adjustment and the minutes from
the August 6, 2018 meeting of the Planning Commission/Board of Adjustment. A
motion was made by Commissioner Begalla, seconded by Commissioner Huggins. The
motion carried unanimously.
Old Business:
Chairperson Thompson opened old business by calling for a motion to approve
CP 18-08 A request by Todd Jones for a Conditional Use Permit to allow an office as
the principal use on the first-floor level of the building located at 901 Main Street,
Evanston, WY, which is zoned Regional Business-Established (RB-E). (Section 24-15
B. (2)). A motion was made by Commissioner Begalla, seconded by Commissioner
Smith. No discussion was heard. The motion carried unanimously.
Chairperson Thompson continued by calling for a motion from the Board of Adjustment
to approve BA 18-04 A request by Michael Day for a Variance to allow a detached
accessory building (carport) to encroach approximately 9 feet 2 inches into the 10-foot
minimum interior side yard setback for accessory uses on property located at 209
Toponce Drive, Evanston, WY, which is zoned Low Density Residential-Established .5
(LR-E.5). The carport measures approximately 10 feet in width by 32 feet in length and
will be located on the north side of the existing detached garage. (Section 24-16 A. (7))
and (Section 24-103). Commissioner Smith so moved, seconded by Commissioner
Begalla. Hearing no discussion, the motion carried unanimously.
New Business:
Attorney Boal began the public hearings by explaining the legalities of the
hearing, and how it would be conducted. Applicants would be heard from first, followed
by those in favor of the proposal and finally hearing from those who are opposed to the
proposal. He asked each person speaking to clearly state their name and home
address for the record prior to being sworn in to testify. Attorney Boal additionally
explained that public hearings are contested case hearings and that anyone who wishes
to contest the Commission’s decision must make it known to him at the closing of the
hearing.
Attorney Boal opened the hearing with BA 18-05 A request by Scott and Mary
Service for a Variance to allow an awning/deck cover to encroach approximately 6 feet
into the minimum 20-foot front yard setback from a street for principal and accessory
uses on property located at 21 Hidden Hollow Court, Evanston, WY, which is zoned
Medium Density Residential-Established (MR-E). (Section 24-16 A. (5)) and (Section
24-103).
Shelly Horn, whose mailing address is 33 Park Road, Evanston, WY, was sworn
in and spoke on behalf of the application. Mr. Horn explained to the Board that he is a
neighbor to Scott and Mary Service and was the previous owner of the property. He
expressed appreciation for the way Scott and Mary have cared for and improved the
property since purchasing it. Prior to the Service’s, Mr. Horn explained he had difficulty
with previous owners. Mr. Horn encouraged the Board to approve the application.
Mary Service, whose mailing address is 21 Hidden Hollow Court, Evanston, WY,
was sworn in and spoke on behalf of the application. Mrs. Service explained the
requested for the deck cover/awning is resulting from a large cottonwood tree which is
dripping sap on the deck and ruining the structure. Mrs. Service advised the property
sits at the end of a dead-end street which they maintain. The street is accessed by only
one other property owner.
Attorney Boal asked the audience and the Board for questions or statements
either for or against the application. Hearing none, the hearing was closed.
Chairperson Thompson asked for a motion to approve BA 18-05. Commissioner
Beaudry so moved, seconded by Commissioner Smith. The motion passed
unanimously.
Chairperson Thompson announced future Planning Commission and Board of
Adjustment meeting dates of October 1, November 5 and December 3.
The meeting adjourned at 6:15 p.m.
