Planning & Zoning Commission Board of Adjustment Evanston, Wyoming www.evanstonwy.org Board of Adjustment/Planning Commission Meeting Minutes October 1, 2018 6:00 PM at City Hall Board Members Present: Maryl Thompson – Chairperson Kimberly Begalla Rowdy Dean Dave Huggins Robert Smith Staff Present: Dennis Boal, Evanston City Attorney DuWayne Jacobson, Associate Planner Dean Barker, Evanston City Engineer Dawn Worley, Administrative Assistant III Chairperson Thompson called the meeting to order at 6:00 p.m. Chairperson Thompson asked for a motion to approve the agenda for the October 1, 2018 meeting. A motion was made by Commissioner Dean, seconded by Commissioner Huggins. The motion carried unanimously. Chairperson Thompson asked for a motion to approve the minutes from the September 17, 2018 meeting of the Planning Commission/Board of Adjustment and the minutes. A motion was made by Commissioner Begalla, seconded by Commissioner Dean. The motion carried unanimously. Old Business: With no old business, Chairperson moved on to new business. New Business: Attorney Boal began the public hearings by explaining the legalities of the hearing, and how it would be conducted. Applicants would be heard from first, followed by those in favor of the proposal and finally hearing from those who are opposed to the proposal. He asked each person speaking to clearly state their name and home address for the record prior to being sworn in to testify. Attorney Boal additionally explained that public hearings are contested case hearings and that anyone who wishes to contest the Commission’s decision must make it known to him at the closing of the hearing. Attorney Boal opened the hearing with CP 18-10 A request by Tabatha Ruiz for a Conditional Use Permit to allow a day care as the principal use of the property located at 508 Center Street, Evanston, WY 82930, which is zoned Low Density Residential- Established (LR-E). (Section 24-15 A. (13)) Tabatha Ruiz, whose mailing address is 212 Hayden Avenue, Evanston, WY, was sworn in and spoke on behalf of the application. Mrs. Ruiz explained that she is purchasing the property located at 508 Center Street to move her daycare from its current location on County Road to the location on Center Street. She advised the Commission that she additionally owns the building next door at 500 Center Street which is her preschool. Mrs. Ruiz added that having both the preschool and daycare next door to each other will be an added convenience for herself, staff and parents. Attorney Boal asked Mrs. Ruiz what her hours of operation are and how many children she is currently licensed to serve. Mrs. Ruiz advised her current hours of operation are Monday-Friday from 7:30 AM-5:30 PM. She stated she is licensed for up to fifteen children. Attorney Boal asked the audience and the Commission for questions or statements either for or against the application. Chairperson Thompson asked Mrs. Ruiz to explain the difference between a preschool and a daycare. Mrs. Ruiz explained that a preschool is a focused learning environment and a daycare is designed to provide supervision. Attorney Boal asked the Commission and audience for questions or statements either for or against the application. With none heard, the hearing was closed. Commissioner Begalled asked if the Commissioners had reviewed the staff recommendations including the one-year probationary period. Chairperson Thompson stated that is consistent with the previous application. Chairperson Thompson asked for a motion to approve CP 18-10 with staff recommondations. Commissioner Day so moved, seconded by Commissioner Smith. The motion passed unanimously. Chairperson Thompson announced future Planning Commission and Board of Adjustment meeting dates of November 5, December 3 and January 7. The meeting adjourned at 6:10 PM.
