Chairperson Thompson called the meeting to order at 6:00 p.m.
Chairperson Thompson asked for a motion to approve the agenda for the October 7,
2019. A motion was made by Commissioner Day, seconded by Commissioner Begalla.
The motion carried unanimously.
Chairperson Thompson asked for a motion to approve the minutes from the September
9, 2019 meeting of the Planning Commission/Board of Adjustment. A motion was made
by Commissioner Beaudry, seconded by Commissioner Day. The motion carried
unanimously.
Old Business:
With none heard, Chairperson Thompson moved on to new business.
New Business:
Attorney Boal began the public hearings by explaining the legalities of the hearing, and
how it would be conducted. Applicants would be heard from first, followed by those in
favor of the proposal and finally hearing from those who are opposed to the proposal.
He asked each person speaking to clearly state their name and home address for the
record prior to being sworn in to testify. Mr. Boal additionally explained that public
hearings are contested case hearings and that anyone who wishes to contest the
Commission’s decision must make it known to him at the closing of the hearing.
Attorney Boal opened the hearing with CP 33, A request by Dennis and Stacey Wallace
for a Conditional Use Permit to allow an accessory building to exceed 60 percent of the
footprint area of the principal building and to allow the total of all accessory buildings to
exceed 75 percent of the footprint area of the principal building for property located at
151 Washakie Drive, Evanston, Wyoming, which is zoned Low Density Residential-
Established .5 (LR-E.5). The applicant is proposing to construct a detached garage
measuring 36 feet by 62 feet (2,232 square feet). (Section 24-26 C.)
Dennis Wallace, 151 Washakie Drive, Evanston, WY, was sworn in and testified on
behalf of the application.
Mr. Wallace explained the reason for the request was to erect a garage 36’x62’, larger
than the allowed.
Mr. Wallace advised the garage would be placed on the rear of the property and would
be accessed from Aspen Grove Drive. The structure would be under the 25’ height
restriction.
Mr. Wallace stated the garage would be used to house personal items to include an RV
and additional vehicles as well as a single piece of construction equipment when not in
use, currently sitting on the property without protection.
Mr. Wallace stated the garage would be constructed with materials that would match the
current structures on the property and would include 2 large entrance doors as well as
windows and a smaller standard sized access door.
Attorney Boal asked Mr. Wallace if he had received and reviewed the letter provided by
the Perry’s.
Mr. Wallace stated he had received and reviewed the letter and his wanted to reassure
the neighbors that he is not operating a commercial business out of his home as all
work is completed off site. He added that the garage would allow him to put the single
piece of equipment as well as other personal items inside and out of view.
Chairperson Thompson how the garage would be accessed.
Mr. Wallace advised access would be off Aspen Grove Drive. The required curb cut
would be applied for and paid for. Mr. Wallace stated if approved, the new garage
would also allow him the option of removing some of the older sheds/structures on the
property.
Attorney Boal asked if anyone else would like to address the Commission.
Rick Clover, 204 Hayden Avenue, Evanston, WY, was sworn in. Mr. Clover advised he
lives in the neighborhood and wanted to ask if the additional equipment and trailers
currently be stored on the property would be housed in the new garage.
Mr. Wallace stated that was correct.
Stacey Wallace, 151 Washakie Drive, Evanston, WY, was sworn in and offered
additional information regarding the concerns of Mr. Clover. She advised that much of
the equipment currently stored on the lot next to their home, belongs to the contractor
constructing the home next to them. They are allowing theses items to be stored on
their property along with items being used by the contractor completing the sidewalk
project.
Jill Clover, 204 Hayden Avenue, Evanston, WY, was sworn in and clarified that
construction equipment currently on the Wallace’s lot would be stored in the garage.
Mr. Wallace reiterated that yes, the single piece of construction equipment as well as
person items would be stored in the new garage.
Attorney Boal asked if anyone else wanted to speak either for or against the application,
hearing none, the hearing was closed.
Chairperson Thompson asked for a motion to approve CP 33, Commissioner Day
moved to approve CP 33, with staff recommendations. Seconded by Commissioner
Beaudry.
Chairperson Thompson expressed concerns regarding the size of the building.
Commissioner Beaudry stated that the initial perception that a commercial business was
being run out of the home seem to have been addressed and the property is large
enough in size to accommodate a structure of the proposed size. The structure will
match the existing home and other structure and clean up the property.
Commissioner Day stated the structure will be a distance off Aspen Grove Drive and
behind an existing fence.
Mr. Wallace stated the garage would be located behind the fence and 150 feet from
Aspen Grove Drive.
Chairperson Thompson called for a vote. The motion passed unanimously.
Attorney Boal continued the hearing with HE 34, A request by Sean Williams and Crysta
Herman for a Height Exception to allow a fence to exceed the maximum height
limitation of four feet within the front yard setback area for property located at 1113
Sage Street, Evanston, Wyoming which is zoned Low Density Residential-Established
(LR-E). The applicant is proposing to construct a five-foot tall fence within the 20-foot
front yard setback area located along Sage Street. (Sections 24-22 and 33)
Sean Williams, 1113 Sage Street, Evanston, WY, was sworn in and spoke on behalf of
the application.
Mr. Williams explained they were requesting to increase the height of the front yard
fence to 5’, with the goal of keeping their dogs in and other animals out. He stated that
currently the renter next door has a friendly dog, but that individual will not always be
there.
Chairperson Thompson asked how the fence would match with the neighboring fence
structures.
Mr. Williams stated the greatest difference would be with the neighbor who has a 4’
fence.
Attorney Boal asked if anyone else wanted to speak either for or against the application,
hearing none, the hearing was closed.
Chairperson Thompson asked for a motion to approve HE 34. Commission Beaudry
moved to approve HE 34, seconded by Commission Begalla.
Chairperson Thompson explained to the Commission the location of the home and
garage leave the home owners with only a front yard for their use. The garage sits
along the alley and the home is just in front of the garage, leaving no back yard for use.
Chairperson Thompson called for a vote. The motion passed with 3 Commissioners
voting for approval, 1 (Commissioner Begallal) dissenting.
Attorney Boal proceeded with ZC 36, A request by the City of Evanston for a Zone
Change from Low Density Residential-Established and Public to Medium Density
Residential-Developing for property located north of Saddle Ridge Road between
Ortega Court and South Ridge Road, Evanston, Wyoming. This property includes Lot
202 of the 2nd Amended Southridge Park Subdivision and an abutting triangular shaped
un-platted parcel of land to the east. Subject property totals 4.688 acres in size.

Senior Planner DuWayne Jacobsen presented the request, detailing the staff report.
Commissioner Day asked if the recommendation was for the 3 lots of the subdivision.
Senior Planner Jacobsen advised it was.
Chairperson Thompson asked for a motion to recommended ZC 36 to City Council.
Commissioner Day moved to recommended ZC 36 to City Council, seconded by
Commissioner Beaudry.
Chairperson Thompson called for a vote. The motion passed unanimously.
Other Business:
Hearing no other business, Chairperson Thompson announced future meeting dates of
November 4, December 2 and January 6, 2020.
The meeting adjourned at 6:45 PM.
