W ednesday, February 22, 2012 The regular meeting of the Ev erett City Council was called to order at 12:30 p.m., February 22, 2012 in the City Council Chambers of the Ev erett City Hall, President Gipson presiding. Upon roll call it was f ound that May or Stephanson and Council Members Roberts, Moore, Hatloe, Gipson, Nielsen, and Af f holter were present. Council Member Stonecipher was excused. Council Member Hatloe led the Pledge of Allegiance. The minutes of the February 15, 2012 Ev erett City Council meeting were approv ed as printed. MAY OR May or Stephanson had no comments. CITY COUNCIL Council Member Roberts and President Gipson commented that it was an honor to hav e the President of the United States v isit our community. CITY ATTORNEY Tim Benedict, City Attorney ’s Of f ice, requested an executiv e session at the close of today ’s meeting regarding a litigation matter, pursuant to RCW 42.30.110(1)(i), to last approximately ten minutes with no announcement f ollowing. CITIZEN COMMENTS Will Knedlik, Kirkland, brought f orth a complaint f or relief to determine judicially that commuter rail serv ice f rom Ev erett to Seattle v iolates state statutory authority and all monies paid to or otherwise expended on behalf of def endant BNSF and/or to or f or def endant PB, f rom any Snohomish subarea taxes, must be repaid or reimbursed to said subarea. He urged the city to join the litigation. COUNCIL BRIEFING AGENDA Adopt Resolution establishing a policy on Public Place Names and Name Changes, and repealing Resolution No. 5865 Presentation by Allan Gif f en, Planning Citizen comments by : Gail Chism and Valerie Steel, Ev erett Authorize the May or to sign a prof essional serv ices agreement with Botesch, Nash & Hall Architects, P.S. to prov ide design serv ices f or roof replacement to City f acilities in the amount of $190,248.00. Presentation by Ruben Sanchez, Facilities PROPOSED ACTION AGENDA: COUNCIL BILL NO. 1202-09 SECOND READING: AN ORDINANCE relating to Court-Monitored Def errals, adding a new Chapter to the Ev erett Criminal Code (Title 10 of the Ev erett Municipal Code) CONSENT ITEMS: Mov ed by Council Member Af f holter, seconded by Council Member Hatloe to approv e the f ollowing consent items: RESOLUTION – CLAIMS To adopt Resolution No. 6470 acknowledging the pay ment of audited and approv ed claims against the city of Ev erett in the amount of $1,401,010.77 f or the period of February 4, 2012 through February 10, 2012. BID CALL – PACIFIC AND ECLIPSE MILL ROAD IMPROVEMENTS To authorize a call f or bids f or the Pacif ic and Eclipse Mill Road Intersection Improv ements Project. Roll was called with all council members v oting y es except Council Member Stonecipher who was excused. Motion carried. ACTION ITEMS: AMENDMENT – TRANSMISSION LINE NO. 5 PILE REPLACEMENT Mov ed by Council Member Roberts, seconded by Council Member Nielsen to authorize the May or to sign Amendment No. 2 f or the “Transmission Line No. 5 Pile Replacement” Project with HDR Engineering, Inc. f or an amount of $15,361.00. Roll was called with all council members v oting y es except Council Member Stonecipher who was excused. Motion carried. GRANT AGREEMENT – SENIOR CENTER/SOFTWARE Mov ed by Council Member Hatloe, seconded by Council Member Af f holter to authorize the May or to sign an agreement with Snohomish County Human Serv ices f or a grant in the amount of $11,000 f or sof tware. Roll was called with all council members v oting y es except Council Member Stonecipher who was excused. Motion carried. MEMORANDUM OF UNDERSTANDING – SENIOR CENTER/ NUTRITION PROGRAM Mov ed by Council Member Moore, seconded by Council Member Af f holter to authorize the May or to sign the Memorandum of Understanding between the Senior Serv ices of Snohomish County and the Carl Gipson Senior Center of Ev erett. Roll was called with all council members v oting y es except Council Member Stonecipher who was excused. Motion carried.
