W ednesday, February 15, 2012 The regular meeting of the Ev erett City Council was called to order at 6:30 p.m., February 15, 2012 in the City Council Chambers of the Ev erett City Hall, President Gipson presiding. Upon roll call it was f ound that May or Stephanson and Council Members Roberts, Moore, Hatloe, Gipson, Nielsen, Stonecipher and Af f holter were present. Council Administrativ e Coordinator Deb Williams led the Pledge of Allegiance. Ev erett Police Department’s Thin Blue Line then sang the National Anthem. The minutes of the February 8, 2012 Ev erett City Council meeting were approv ed as printed. MAY OR May or Stephanson had no report. CITY COUNCIL Council Member Roberts said he was excited to hear that the Nav y would be increasing its presence in Ev erett, and thanked Congressman Larsen f or his ef f orts in that regard. Council Member Stonecipher reported that she would be out of town next week. CITY ATTORNEY City Attorney Iles requested an executiv e session pursuant to RCW 42.30.110(1)(i) to last approximately 15 minutes with possible action f ollowing. CITIZEN COMMENTS J.T. Dray, Ev erett, expressed his objection to spending money on an ev ent to celebrate Ev erett Station’s 10-y ear anniv ersary at a time when bus serv ices are being reduced. COUNCIL BRIEFING AGENDA Crime Statistics Update Presentation by Dan Templeman, Deputy Chief of Police COUNCIL BILL NO. 1201-09 FIRST READING: AN ORDINANCE relating to Court-Monitored Def errals, adding a new chapter to the Ev erett Criminal Code (Title 10 of the Ev erett Municipal Code) Presentation by Laura Van Sly ck, Asst. City Attorney CONSENT ITEMS: Mov ed by Council Member Moore, seconded by Council Member Af f holter, to approv e the f ollowing consent items: RESOLUTION – CLAIMS To adopt Resolution No. 6468 acknowledging the pay ment of audited and approv ed claims against the city of Ev erett in the amount of $2,053,262.76 f or the period of January 28, 2012 through February 3, 2012. RESOLUTION – PAY ROLL To adopt Resolution No. 6469 acknowledging the pay ment of audited and approv ed pay roll claims against the city of Ev erett in the amount of $3,576,346.22 f or the period ending January 28, 2012. BID CALL – WATER MAIN IMPROVEMENT “K” AND SEWER MAIN IMPROVEMENTS – LOWELL AREA To authorize a call f or bids f or the construction of Water Main Improv ement “K” and Sewer Main Improv ements – Lowell Area. RFP – EVERETT TV EQUIPMENT REPLACEMENT To authorize RFP No. 2016-06 f or Ev erett TV equipment replacement. Roll was called with all council members v oting y es. Motion carried. ACTION ITEMS GRANT AGREEMENT – BUFFER ZONE PROTECTION PROGRAM Mov ed by Council Member Hatloe, seconded by Council Member Nielsen, to authorize the May or to sign the necessary documents with the Washington State Military Department to accept f unds in the amount of $119,500.00 f or the FFY 10 Buf f er Zone Protection Program. AGREEMENT – ADA AND SAFETY IMPROVEMENTS Mov ed by Council Member Nielsen, seconded by Council Member Roberts, to authorize the May or to sign a prof essional serv ices agreement with Dy keman Architects, P.S. to prov ide design serv ices f or ADA and saf ety improv ements to city f acilities in the amount of $62,150.00. COUNCIL BILL NO. 1201-07 THIRD AND FINAL READING: AN ORDINANCE relating to Banners in the Public Rights-of -Way and repealing ordinances as prov ided in Section 19 of this ordinance Mov ed by Council Member Moore, seconded by Council Member Roberts, that this is declared to be the third and f inal reading of Council Bill No. 1201-07 and the City Clerk is directed to call the roll f or the f inal disposition of the ordinance. AGREEMENT AMENDED Mov ed by Council Member Af f holter, seconded by Council Member Moore, to authorize the May or to sign the f irst amendment to the third supplemental agreement with the Public Utility District No. 1 of Snohomish County. BID AWARD – WATER TRANSMISSION LINE 5 REPLACEMENT AT THE PILCHUCK RIVER Mov ed by Council Member Hatloe, seconded by Council Member Moore, to award the contract f or the construction of Water Transmission Line 5 Replacement at the Pilchuck Riv er to Scarsella Brothers, Inc. in the amount of $2,414,286.60 including Washington State sales tax. AGREEMENT AMENDED – SMITH ISLAND/UNION SLOUGH RESTORATION SITE MONITORING SERVICES Mov ed by Council Member Roberts, seconded by Council Member Nielsen, to authorize the May or to sign Amendment No. 2 to the prof essional serv ices agreement with Jones and Stokes to extend the date f or completion f or the Smith Island/Union Slough Restoration Site Monitoring Serv ices at no additional cost. COUNCIL BILL NO. 1201-08 THIRD AND FINAL READING: AN ORDINANCE creating a special improv ement project entitled “Parks Conv ersion Planning”, Fund 354, Program 039, to accumulate all costs f or the improv ement project Mov ed by Council Member Moore, seconded by Council Member Nielsen, that this is declared to be the third and f inal reading of Council Bill No. 1201-08 and the City Clerk is directed to call the roll f or the f inal disposition of the ordinance. AGREEMENT – SOFTBALL UMPIRE SERVICES Mov ed by Council Member Stonecipher, seconded by Council Member Af f holter, to authorize the May or to sign a prof essional serv ices agreement with the Washington State Sof tball Umpires Association f or sof tball umpire serv ices in an amount not to exceed $67,000.00.
