W ednesday, April 18, 2012 The regular meeting of the Ev erett City Council was called to order at 6:30 p.m., April 18, 2012 in the City Council Chambers of the Ev erett City Hall, Council Member Moore presiding. Upon roll call it was f ound that Council Members Roberts, Moore, Hatloe, Nielsen, Stonecipher, and Af f holter were present. May or Stephanson and Council President Gipson were excused. Council Member Af f holter led the Pledge of Allegiance. The minutes of the April 11, 2012 City Council meeting were approv ed as printed. COUNCIL The city council members had no reports. CITY ATTORNEY City Attorney Iles had no report. CITIZEN COMMENTS No citizens wished to speak regarding matters not appearing on the agenda. COUNCIL BRIEFING AGENDA COUNCIL BILL NO. 1204-22 SECOND READING: AN ORDINANCE approv ing the appropriations of the 2012 rev ised City of Ev erett budget and amending Ordinance No. 3248-11. PUBLIC HEARING COUNCIL BILL NOS. 1203-17, 1203-18, 1203-19, 1203-20 and 1203-21 Council Member Moore opened a public hearing regarding Council Bill Nos. 1203-17, 1203-18, 1203-19, 1203-20 and 1203-21, zoning ordinances relating to the Ev ergreen Way Rev italization Plan, and acknowledged, f or the record, receipt of a letter f rom Snohomish County Planning and Dev elopment Serv ices Director Clay White in support of the plan. Allan Gif f en, Planning, presented a brief ing on all f iv e ordinances. Mark Smith, Ly nnwood, representing the Housing Consortium of Ev erett and Snohomish County, submitted a letter and spoke in support of CB Nos. 1203-17 and 1203-18. He urged continuing ef f orts to encourage dev elopment of af f ordable housing. Kristin Kelly, Snohomish, representing Futurewise and Pilchuck Audubon Society, submitted materials and spoke in support of CB Nos. 1203-17 and 1203-18. She recommended additional incentiv es f or af f ordable housing dev elopment such as inclusionary zoning. Mov ed by Council Member Roberts, seconded by Council Member Af f holter to close the public hearing. COUNCIL BILL NO. 1203-17 THIRD AND FINAL READING: AN ORDINANCE adopting the Ev ergreen Way Rev italization Plan as a Subarea Plan of the Ev erett Growth Management Comprehensiv e Plan, amending Ordinance No. 2021-94, as amended. Mov ed by Council Member Roberts, seconded by Council Member Nielsen, that with the inclusion of additional representational graphics as recommended by staf f , this is declared to be the third and f inal reading of Council Bill No. 1203-17. Council Member Roberts complimented staf f on an extraordinary job, especially as to public outreach, in putting together a unique package of land use, economic dev elopment and regulatory ref orm legislation. Council Member Stonecipher echoed congratulations to staf f , and inquired whether the resulting use of tax incentiv es would be included in an annual report. Council Member Nielsen remarked that the plan is a work in progress, subject to amplif ication and adjustment, and that incentiv es to encourage af f ordable housing along this corridor are particularly appropriate. Council Member Af f holter requested that Council be apprised of the plan’s ef f ectiv eness periodically. Chief Administrativ e Of f icer Bry ant and Planning Director Gif f en assured Council that there would be annual reports and periodic adjustments. The City Clerk was directed to call the roll f or the f inal disposition of the ordinance. COUNCIL BILL NO. 1203-18 THIRD AND FINAL READING: AN ORDINANCE establishing two new Zoning Classif ications, the Ev ergreen Way Zone and the Mixed Use Ov erlay Zone, and amending the Ev erett Zoning Code, Ordinance No. 1671-89, as amended (EMC Title 19). Mov ed by Council Member Hatloe, seconded by Council Member Roberts, that this is declared to be the third and f inal reading of Council Bill No. 1203-18 and the City Clerk is directed to call the roll f or the f inal disposition of the ordinance. COUNCIL BILL NO. 1203-19 THIRD AND FINAL READING: AN ORDINANCE amending the Of f icial Zoning Map by rezoning properties in the Ev ergreen Way Corridor f rom B-2 and C-1 to the Ev ergreen Way (E-1) Zone and the Mixed Use Ov erlay (MUO) Zone, amending Ordinance No. 1671-89, as amended (EMC Title 19). Mov ed by Council Member Nielsen, seconded by Council Member Roberts, that with the change to Exhibit 2, Area 4, as recommended by staf f , excluding properties on the east side of Ev ergreen Way f rom the Mixed Use Ov erlay zone, this is declared to be the third and f inal reading of Council Bill No. 1203-19 and the City Clerk is directed to call the roll f or the f inal disposition of the ordinance. STREET CLOSURE – HEALTHY KIDS DAY /HEALTH FAIR To authorize the closure of Rockef eller, Calif ornia to Ev erett Av enue, on April 28, 2012, 10:00 a.m. to 1:00 p.m., f or a Healthy Kids Day /Health Fair sponsored by the Ev erett Y MCA. BID CALL – ASPHALT PRODUCTS To authorize Bid Call No. 2012-024 f or an annual supply of asphalt products. ACTION ITEMS: AGREEMENT – FFY 10 BUFFER ZONE PROTECTION PROGRAM Mov ed by Council Member Hatloe, seconded by Council Member Nielsen, to authorize the May or to sign the necessary documents to extend the contract with the Washington State Military Department f or the FFY 10 Buf f er Zone Protection Program award. AMENDMENT – GREATER EVERETT COMMUNITY FOUNDATION Mov ed by Council Member Roberts, seconded by Council Member Nielsen, to authorize the May or to sign Amendment No. 1 to the agreement between the City of Ev erett and the Greater Ev erett Community Foundation to update reimbursement rates f or endowed and non-endowed f unds to be consistent with Greater Ev erett Community Foundation Board Policy. BID AWARD – WATER METER INSTALLATION PARTS Mov ed by Council Member Af f holter, seconded by Council Member Hatloe, to award Bid No. 2012-016 f or an annual supply of water meter installation parts to HD Fowler Co., Inc. in the amount of $399,822.17 including Washington state sales tax. RFP AWARD – VOICE MESSAGING SY STEM Mov ed by Council Member Nielsen, seconded by Council Member Roberts, to award Request f or Proposal 2011-004 f or a v oice messaging sy stem and authorize the May or to sign the contract with Continuant in the amount of $240,313.80 including Washington state sales tax. RESOLUTION – USE OF STATEWIDE ELECTRONIC DATABASES Mov ed by Council Member Stonecipher, seconded by Council Member Roberts, to adopt Resolution No. 6488 authorizing use of the state wide electronic databases maintained by the Municipal Research and Serv ices Center of Washington (MRSC) as the City ’s small public works and consulting serv ices rosters. AGREEMENT - CHIP Mov ed by Council Member Roberts, seconded by Council Member Nielsen, to authorize the May or to sign the HOME agreement by and between Snohomish County and the City of Ev erett f or the Community Housing Improv ement Program (CHIP). BID AWARD – PACIFIC AND ECLIPSE MILL ROAD INTERSECTION IMPROVEMENTS Mov ed by Council Member Hatloe, seconded by Council Member Af f holter, to award the bid f or the Pacif ic and Eclipse Mill Road Intersection Improv ements to Colacurcio Brothers, Inc., in the amount of $661,585.00. AMENDMENT – 2012 COMPREHENSIVE SEWER PLAN Mov ed by Council Member Nielsen, seconded by Council Member Af f holter, to authorize the May or to sign a supplemental agreement No. 1 to the prof essional serv ices agreement with HDR Engineering, Inc. to prov ide additional engineering serv ices f or the 2012 Comprehensiv e Sewer Plan in the amount of $43,575.00. AGREEMENT – RETROFITTING STORM WATER FACILITIES Mov ed by Council Member Nielsen, seconded by Council Member Roberts, to authorize the May or to sign the prof essional serv ices agreement with CG Engineering f or structural engineering serv ices f or retrof itting Storm Water Facilities in the amount of $99,750.00. AGREEMENT – FEMA PUBLIC ASSISTANCE GRANT Mov ed by Council Member Af f holter, seconded by Council Member Roberts, to authorize the May or or Designated Agent to sign FEMA Public Assistance Grant agreement f or the FEMA Disaster Public Assistance Program, Declaration Number 4056-DR-WA.
