W ednesday, September 05, 2012 The regular meeting of the Ev erett City Council was called to order at 6:30 p.m., September 5, 2012 in the City Council Chambers of the Ev erett City Hall, President Gipson presiding. Upon roll call it was f ound that May or Stephanson and Council Members Roberts, Moore, Hatloe, Gipson, Burke, Stonecipher, and Af f holter were present. Council Member Moore led the Pledge of Allegiance. The minutes of the August 29, 2012 City Council meeting were approv ed as printed. Council Members Hatloe and Gipson abstained f rom the v ote. MAY OR May or Stephanson had no comments. COUNCIL The council members had no comments. CITY ATTORNEY City Attorney Iles had no comments. CITIZEN COMMENTS No citizens wished to speak. COUNCIL BRIEFING AGENDA COUNCIL BILL NO. 1208-44 FIRST READING: AN ORDINANCE regarding insurance plans f or appointiv e of f icers, classif ied non-represented employ ees, and elected of f icials, amending Ordinance No. 1594-89, as amended (Chapter 2.74 EMC) Presented by Sharon DeHaan, Human Resources Council President Gipson requested a copy of EMC 2.74.010 through 2.74.050. Sharon DeHaan agreed to prov ide a copy to each of the council members. CONSENT ITEMS: Mov ed by Council Member Hatloe, seconded by Council Member Moore, to approv e the f ollowing consent items: RESOLUTION - CLAIMS To adopt Resolution No. 6535 acknowledging the pay ment of audited and approv ed claims against the city of Ev erett in the amount of $1,565,995.29 f or the period of August 18, 2012 through August 24, 2012. RESOLUTION – ELECTRONIC TRANSFER To adopt Resolution No. 6536 acknowledging the pay ment of audited and approv ed electronic transf er claims against the city of Ev erett in the amount of $7,698,778.54 f or the period of July 1, 2012 through July 31, 2012. BID CALL To authorize Bid Call 2012-060 f or Annual Supply of Traf f ic Sign Blanks and Sign Faces f or the Engineering Sign Shop. BID CALL To authorize Bid Call 2012-066 f or Annual Supply of Water Treatment Chemicals at the Water Filtration Plant and Water Pollution Control Facility. ACTION ITEMS: PURCHASE – RAPISCAN METOR 6M WALK THRU METAL DETECTOR Mov ed by Council Member Moore, seconded by Council Member Hatloe, to authorize the purchase of a Rapiscan Metor 6M Walk Thru Metal Detector f rom GSA Contract #GS-07F-9429G in the amount of $5,117.60 including sales tax. Council Member Stonecipher inquired as to why this item is being paid f or out of Fund 156, Criminal Justice, instead of the Municipal Court construction f und. Debra Bry ant, CAA/CFO, stated that she would look into it. Mov ed by Council Member Stonecipher, seconded by Council Member Roberts to table this item until f urther inf ormation can be prov ided. AGREEMENT – COOPERATIVE PURCHASING Mov ed by Council Member Roberts, seconded by Council Member Af f holter, to authorize the May or to sign the Electronic Master Interlocal Cooperativ e Purchasing Agreement with the National Intergov ernmental Purchasing Alliance. COUNCIL BILL NO. 1208-41 THIRD AND FINAL READING: AN ORDINANCE prov iding f or the issuance and sale of limited tax general obligation ref unding bonds of the city in the principal amount of not to exceed $15,000,000 to prov ide f unds to ref und certain outstanding general obligation bonds of the city Mov ed by Council Member Hatloe, seconded by Council Member Burke, that this is declared to be the third and f inal reading of Council Bill No. 1208-41 and the City Clerk is directed to call the roll f or the f inal disposition of the ordinance. COUNCIL BILL NO. 1208-42 THIRD AND FINAL READING: AN ORDINANCE approv ing the appropriations of the 2012 rev ised city of Ev erett budget and amending Ordinance No. 3273-12 Mov ed by Council Member Burke, seconded by Council Member Roberts, that this is declared to be the third and f inal reading of Council Bill No. 1208-42 and the City Clerk is directed to call the roll f or the f inal disposition of the ordinance. RESOLUTION – POLICY /PUBLIC NAMES AND NAME CHANGES Mov ed by Council Member Roberts, seconded by Council Member Af f holter, to adopt Resolution No. 6537 establishing a policy on Public Names and Name Changes and repealing Resolution No. 5865 and CB 763-76. AGREEMENT – JAIL SERVICES Mov ed by Council Member Roberts, seconded by Council Member Moore, to authorize the May or to execute the Interlocal Agreement with Snohomish County f or jail serv ices. COUNCIL BILL NO. 1208-40 THIRD AND FINAL READING: AN ORDINANCE prov iding f or the v acation of all of that portion of Chestnut Street ly ing between Block 396 and Block 397, and all of that portion of 17th Street ly ing between the east right of way line of Chestnut Street and the east right of way line of the alley in Block 325, Plat of Riv erdale Addition to Ev erett, according to the plat thereof , recorded in Volume 10 of Plats, Page 45, records of Snohomish County Mov ed by Council Member Af f holter, seconded by Council Member Moore, that this is declared to be the third and f inal reading of Council Bill No. 1208-40 and the City Clerk is directed to call the roll f or the f inal disposition of the ordinance. AGREEMENT AMENDED – SEWER LIFT STATION NO. 24 REPLACEMENT Mov ed by Council Member Roberts, seconded by Council Member Moore, to authorize the May or to sign Amendment No. 5 to the prof essional serv ices agreement with Murray, Smith & Associates, Inc. f or Sewer Lif t Station No. 24 Replacement project f or a total amount of $378,441.00. AGREEMENT – PURCHASE/TWO ACRES OF MITIGATION Mov ed by Council Member Roberts, seconded by Council Member Af f holter, to authorize the May or to sign the Interlocal Agreement with Diking District No. 5 f or the purchase of up to two acres of mitigation. AGREEMENT – TASK FORCE FUNDING Mov ed by Council Member Burke, seconded by Council Member Roberts, to authorize the May or to sign the Interlocal Agreement with Snohomish County regarding Task Force f unding. AGREEMENT AMENDED – FFY 10 BUFFER ZONE PROTECTION PROGRAM Mov ed by Council Member Moore, seconded by Council Member Burke, to authorize the May or to sign the necessary documents to extend the contract with the Washington State Military Department f or the FFY 10 Buf f er Zone Protection Program award.
