W ednesday, November 13, 2013 A special meeting of the Everett City Council was called to order at 3:00 p.m., November 13, 2013 in the City Council Chambers of the Everett City Hall, Council President Moore presiding. Upon roll call it was found that Council Members Moore, Roberts, Murphy, Gipson, Bader and Stonecipher were present. Mayor Stephanson was excused. INTERVIEWS – INTERIM POSITION NO. 7 Council President Moore stated that this was a special meeting for the purpose of interviewing the seven candidates nominated for Interim City Council Position No. 7. He noted that June Robinson declined the interview and is seeking another ambition, and that Art Thomson would be unable to attend due to a previous engagement. Mr. Thomson submitted a written statement in lieu of being interviewed. President Moore reviewed the process by which a candidate will be chosen. The council members interviewed Kim Nielsen, Elly Smith, Rich Anderson, Judy Tuohy and Megan Dunn. Each candidate introduced themselves, responded to questions from the council members and gave a brief closing. Council President Moore read the statement submitted by Art Thomson into the record. The city council meeting recessed and reconvened at 6:30 p.m. Council Member Gipson led the Pledge of Allegiance. The minutes of the November 6, 2013 City Council meeting were approved as printed. Council Member Stonecipher abstained from the vote. COUNCIL Council Member Roberts stated that he worked with Pat McClain this past week at the special legislative session related to The Boeing Company’s 777X. Council Member Bader reported on his attendance at the Puget Sound Regional Council Growth Management Committee meeting. CITY ATTORNEY The City Attorney had no comments. CITIZEN COMMENTS Kinuko Noborikawa, Everett, Chair of Communities of Color Coalition, spoke regarding an exhibit at the Pacific Science Center, “RACE: Are We So Different,” and workshops provided by the Race and Social Justice Initiative. Jay Himmelman, Everett, spoke regarding environmental impact forms filled out by the city of Everett in 2004 related to the Valley View Neighborhood. Gail Chism, Everett, expressed concern regarding the removal of a tree by the PUD of Snohomish County without notifying the neighbors. Jackie Minchew, Everett; Gail Chism, Everett; and Andrea Tucker, Everett; spoke in support of Megan Dunn for Interim Position No. 7. Cheryl VanWinkle, Everett; Crystal Donner, Lake Stevens; and Tom Gaffney, Everett; endorsed Rich Anderson for Interim Position No. 7. Josh Wixson, Everett, spoke in favor of Judy Tuohy for the interim position. Gigi Burke, Lake Stevens; Charlene Rawson, Everett; and Marilyn Boyd, Everett; expressed their opinions regarding the qualifications needed to fill Council Position No. 7. The council members offered comments about the process and the candidates being considered for the appointment. Council President Moore asked for nominations from each council member, opened the nominations, and reported that Council Members Murphy, Bader and Moore nominated Rich Anderson, Council Members Roberts and Stonecipher nominated Judy Tuohy, and Council Member Gipson nominated Elly Smith. As a majority vote was not reached, a second vote was cast excluding Elly Smith from the process. President Moore again asked for nominations from each council member, opened the nominations, and reported that Council Members Murphy, Bader, Moore and Gipson nominated Rich Anderson. Council Members Roberts and Stonecipher nominated Judy Tuohy. Moved by Council Member Murphy, seconded by Council Member Gipson to nominate Rich Anderson to Interim Position No. 7. Roll was called with all council members voting yes. Motion carried. COUNCIL BRIEFING AGENDA COUNCIL BILL NO. 1310-43 FIRST READING: AN ORDINANCE creating a special improvement project entitled “Hannabrook Park Playground Improvements,” Fund 354, Program 044, to accumulate all costs for the improvement project Presented by Paul Kaftanski, Parks CONSENT ITEM: Moved by Council Member Murphy, seconded by Council Member Roberts, to approve the following consent item:  RESOLUTION – CLAIMS To adopt Resolution No. 6674 acknowledging the payment of audited and approved claims against the city of Everett in the amount of $889,796.84 for the period of October 26, 2013 through November 1, 2013. ACTION ITEMS: COUNCIL BILL NO. 1310-41 THIRD AND FINAL READING: AN ORDINANCE closing a special improvement project entitled, “2011 Landscape Repair – Lowell Larimer Road,” Fund 303, Program 094, as established by Ordinance No. 3294-12 Moved by Council Member Bader, seconded by Council Member Stonecipher, that this is declared to be the third and final reading of Council Bill No. 1310-41 and the City Clerk is directed to call the roll for the final disposition of the ordinance. COUNCIL BILL NO. 1310-42 THIRD AND FINAL READING: AN ORDINANCE relating to Stalking and Stalking No-Contact Orders, adding new sections to the Everett Criminal Code (Ordinance No. 1145-85) and amending Ordinance Nos. 1974-93, 1234-86 and 1521-88 as provided in Section 12 herein Moved by Council Member Roberts, seconded by Council Member Murphy, that this is declared to be the third and final reading of Council Bill No. 1310-42 and the City Clerk is directed to call the roll for the final disposition of the ordinance. AYES: Roberts, Moore, Murphy, Gipson, Bader, Stonecipher NAYS: None Ordinance No. 3354-13 adopted. GRANT – SENATOR HENRY M. JACKSON PARK PHASE ONE MASTER PLAN IMPROVEMENTS Moved by Council Member Bader, seconded by Council Member Stonecipher, to authorize the Mayor to sign the grant agreement with the Washington State Department of Commerce for Senator Henry M. Jackson Park Phase One Master Plan Improvements in an amount up to $970,000.00. Roll was called with all council members voting yes. Motion carried. GRANT – EMERGENCY MANAGEMENT OPERATIONS Moved by Council Member Murphy, seconded by Council Member Bader, to authorize the Mayor to sign Contract E14-135 with the Washington State Military Department to receive funding for the Emergency Management Operations in the amount of $57,338.00. Roll was called with all council members voting yes. Motion carried. PUBLIC HEARING – 2014 BUDGET Council President Moore reconvened the public hearing on the 2014 Budget. The council members questioned various budget items and changes and received responses from staff. Council President Moore invited public comment. Cletus Skrabak, Everett, spoke regarding the plight of median families in the city of Everett and suggested that in the 2014 budget city employees pay a minimum of 25% of their health premiums. Gail Chism, Everett, questioned whether the Parks Department could tap into the conservation future monies and expressed concern regarding the condition of the Lowell Larimer Road. Victor Harris, Everett, spoke regarding quality of life in Everett and the expanded duties of the Code Enforcement Department. Moved by Council Member Roberts, seconded by Council Member Gipson to close the public hearing. Roll was called with all council members voting yes. Motion carried. Moved by Council Member Roberts, seconded by Council Member Bader to direct staff to prepare a budget ordinance based on the discussion and comments that have been made and the materials provided.
