W ednesday, December 04, 2013 The regular meeting of the Everett City Council was called to order at 6:30 p.m., December 4, 2013, in the City Council Chambers of the Everett City Hall, Council Member Roberts presiding. Upon roll call it was found that Mayor Stephanson and Council Members Roberts, Murphy, Gipson, Bader, and Stonecipher were present. Council Members Moore and Anderson were excused. Council Member Bader led the Pledge of Allegiance. The minutes of the November 27, 2013, City Council meeting were approved as printed. MAYOR Mayor Stephanson had no comments. COUNCIL Council Member Roberts announced that agenda item no. 15, a public hearing, would be moved to follow consent items. Council Member Roberts announced the Everett Animal Shelter Santa Paws event will be held on Saturday, December 7, 2013, and Saturday, December 14, 2013. He also commented that the annual Everett Transit Stuff-a-Bus campaign, sponsored by the Amalgamated Transit Union, was currently underway. Council Member Roberts also reported he met with Congressman Larsen regarding freight mobility issues. CITY ATTORNEY City Attorney Iles requested an executive session pursuant to RCW 42.31.110(1)(i), which was anticipated to last 15 minutes with no announcement to follow. CITIZEN COMMENTS Shelley Weyer, Everett, spoke on behalf of the Northwest Everett Neighborhood residents regarding tort claims related to recent storm events. COUNCIL BRIEFING AGENDA Riverfront Briefing Presented by David Koenig, Planning; Nick Abdelnour and Richard Rawlings of Polygon Homes Sewer “M” Project Briefing Presented by Dave Davis, Public Works Oliver Batson, Everett, commented on his Grand Avenue property, which is near the proposed Puget Sound Outfall #3 utility bridge. COUNCIL BILL NO. 1312-48 FIRST READING: AN ORDINANCE relating to Parks adding seven new sections to Ordinance No. 3471 (the City Park Code), amending Ordinance Nos. 3471, 889-82, 1615-89, and 2442-00 and repealing a section of the City Park Code Presented by Scott Pool, Parks Department Structural Deficit Advisory Team Briefing Presented by Paul Kaftanski, Parks Department Council Member Gipson asked what method would be used by the SDAT to respond to individuals who submit suggestions for restoring a structurally balanced budget. Mr. Kaftanski said that he would add this as an agenda item for the upcoming SDAT meeting. Council Member Stonecipher requested the SDAT provide city council members with a list of all solicited ideas submitted for consideration. Council Member Bader asked what process citizens should use for submitting suggestions. Mr. Kaftanski stated suggestions could be submitted directly to him. PROPOSED ACTION ITEMS COUNCIL BILL NO. 1311-47 SECOND READING: AN ORDINANCE establishing the basic salary schedule for employees of the City of Everett for 2014, repealing Ordinance 3308-12 CONSENT ITEMS: Moved by Council Member Gipson, seconded by Council Member Murphy, to approve the following consent items: RESOLUTION – PAYROLL To adopt Resolution No. 6679 acknowledging the payment of audited and approved payroll claims against the city of Everett in the amount of $3,370,037.87 for the period ending November 16, 2013. RESOLUTION – CLAIMS To adopt Resolution No. 6680 acknowledging the payment of audited and approved claims against the City of Everett in the amount of $807,066.46 for the period of November 16, 2013, through November 22, 2013. RESOLUTION – ELECTRONIC TRANSFERS To adopt Resolution No. 6681 acknowledging the payment of audited and approved electronic transfer claims against the city of Everett in the amount of $5,443,233.43 for the period of October 1, 2013, through October 31, 2013. Roll was called with all council members voting yes, except Council Members Moore and Anderson who were excused. Motion carried. PUBLIC HEARING – COUNCIL BILL 1311-46 Council Member Roberts opened a public hearing regarding Council Bill No. 1311-46, a proposed ordinance related to the regulations of signs. Gerry Ervine, Planning Department, provided a brief overview of the proposed ordinance. Council Member Roberts invited public comment. There were no citizens who wished to speak. Moved by Council Member Gipson, seconded by Council Member Stonecipher to close the public hearing. Roll was called with all council members voting yes, except Council Members Moore and Anderson who were excused. Motion carried. COUNCIL BILL NO. 1311-46 THIRD AND FINAL READING: AN ORDINANCE related to the regulations of signs, amending Section 4 of Ordinance No. 2076-95 (EMC 19.36.220) Moved by Council Member Stonecipher, seconded by Council Member Gipson, that this is declared to be the third and final reading of Council Bill No. 1311-46 and the City Clerk is directed to call the roll for the final disposition of the ordinance. ACTION ITEMS: AGREEMENT – INDEMNITY Moved by Council Member Murphy, seconded by Council Member Bader, to authorize the Mayor to sign the General Agreement of Indemnity with Liberty Mutual Surety. Roll was called with all council members voting yes, except Council Members Moore and Anderson who were excused. Motion carried. AGREEMENT AMENDED – FIRE ADMINISTRATION COMPLEX SEISMIC RETROFIT PROJECT Moved by Council Member Bader, seconded by Council Member Gipson, to authorize the Mayor to sign Amendment No. 3 to the Professional Services Agreement with CNJA Architects for the Fire Administration Complex – Seismic Retrofit Project in the amount of $3,085. Roll was called with all council members voting yes, except Council Members Moore and Anderson who were excused. Motion carried. AGREEMENT AMENDED – FIRE ADMINISTRATION COMPLEX SEISMIC IMPROVEMENTS PROJECT Moved by Council Member Bader, seconded by Council Member Stonecipher, to authorize the Mayor to sign the Fire Administration Complex – Seismic Improvements Project – Change Order No. 5 for additional seismic work in the amount of $60,894.27 plus Washington State Sales Tax. Roll was called with all council members voting yes, except Council Members Moore and Anderson who were excused. Motion carried. JOB COMPLETE – FIRE ADMINISTRATION COMPLEX SEISMIC IMPROVEMENT PROJECT Moved by Council Member Bader, seconded by Council Member Stonecipher, to accept Fire Administration Complex – Seismic Improvement Project as complete and authorize the Mayor to sign the Certificate of Completion with Biwell Construction, Inc. in the amount of $1,945,004.08. Roll was called with all council members voting yes, except Council Members Moore and Anderson who were excused.  Motion carried. COUNCIL BILL NO 1311-44 THIRD AND FINAL READING: AN ORDINANCE approving the appropriations of the 2013 revised City of Everett Budget and amending Ordinance No. 3339-13 Moved by Council Member Bader, seconded by Council Member Stonecipher, that this is declared to be the third and final reading of Council Bill No. 1311-44 and the City Clerk is directed to call the roll for the final disposition of the ordinance.
