W ednesday, February 12, 2014 The regular meeting of the Everett City Council was called to order at 6:30 p.m., February 12, 2014 in the City Council Chambers of the Everett City Hall, President Moore presiding. Upon roll call it was found that Mayor Stephanson and Council Members Roberts, Moore, Murphy, Gipson, Bader, Stonecipher, and Anderson were present. Council Member Anderson led the Pledge of Allegiance. The minutes of the February 5, 2014 City Council meeting were approved as printed. Council Members Gipson and Bader abstained from the vote. MAYOR Mayor Stephanson had no comments. COUNCIL Council Member Roberts announced that Metro will connect its rapid ride to Shoreline on Saturday which will make service complete from Seattle to Everett. Council Member Murphy reported on his attendance at the monthly Snohomish Health District board meeting. Council Member Anderson stated that he attended the Washington State Supreme Court Justice reception. He reported that the justices will be holding court sessions at the Civic Auditorium tomorrow. Council Member Stonecipher thanked the Mayor and Council President Moore for their efforts to have the Planning Commission hearings televised. CITY ATTORNEY City Attorney Iles requested an executive session following the meeting concerning a litigation matter pursuant to RCW 42.30.110(1)(i)(b). The session is anticipated to last 10 minutes with an announcement to follow. CITIZEN COMMENTS Willie Russell, Everett, spoke regarding various issues with the city of Everett’s Legal and Police Departments. PROPOSED ACTION AGENDA COUNCIL BILL NO. 1402-02 SECOND READING: AN ORDINANCE setting the meeting time schedule for City Council’s regularly scheduled meetings, repealing Ordinance No. 3170-10 COUNCIL BILL NO. 1402-03 SECOND READING: AN ORDINANCE closing a special improvement project entitled “Morrow House Tenant Improvements,” Fund 354, Program 020, as established by Ordinance No. 2676-03 COUNCIL BILL NO. 1402-04 SECOND READING: AN ORDINANCE closing a special improvement project entitled “Bayside Park Phase 2 Improvements Project,” Fund 354, Program 031, as established by Ordinance No. 3330-13 COUNCIL BILL NO. 1402-05 SECOND READING: AN ORDINANCE closing a special improvement project entitled “Garfield Park Playground,” Fund 354, Program 042, as established by Ordinance No. 3331-13 COUNCIL BILL NO. 1402-06 SECOND READING: AN ORDINANCE closing a special improvement project entitled 112 th Street Pedestrian Safety Improvements,” Fund 303, Program 084, as established by Ordinance No. 3131-09 CONSENT ITEMS: Moved by Council Member Gipson, seconded by Council Member Roberts, to approve the following consent items: RESOLUTION - CLAIMS To adopt Resolution No. 6705 acknowledging the payment of audited and approved claims against the city of Everett in the amount of $2,053,902.24 for the period of January 25, 2014 through January 31, 2014. RESOLUTION – PAYROLL To adopt Resolution No. 6706 acknowledging the payment of audited and approved payroll claims against the city of Everett in the amount of $5,123,405.03 for the period ending January 25, 2014. Roll was called with all council members voting yes. Motion carried. ACTION ITEMS: BID AWARD – RESERVOIR 6 ROOF REPLACEMENT Moved by Council Member Bader, seconded by Council Member Roberts, to award the design-build contract for construction of Reservoir 6 Roof Replacement to Shearer and Associates, Inc. in the amount of $4,569,715.00 plus Washington State sales tax. Council Member Gipson requested additional information regarding the warranty on the roof. Dave Davis, Public Works, stated that he would come back with the information. Roll was called with all council members voting yes. Motion carried. BID AWARD – PERSONNEL LIFT TRUCK Moved by Council Member Bader, seconded by Council Member Anderson, to award Bid 2013-039 for a Personnel Lift Truck to Nelson Truck Equipment Company in the amount of $137,894.88 including Washington State sales tax. Roll was called with all council members voting yes. Motion carried. AGREEMENT – TRAINING EXERCISES Moved by Council Member Roberts, seconded by Council Member Bader, to authorize the Mayor to sign the agreement with Steadfast Everett Mall, LLC granting the city of Everett Police Department use of the Everett Mall for training exercises at no cost to the city. Roll was called with all council members voting yes. Motion carried. EXECUTIVE SESSION The city council meeting recessed for an executive session and reconvened. LAWSUIT – PUBLIC RECORDS ACT Moved by Council Member Murphy, seconded by Council Member Roberts to authorize the City Attorney to file, pursuant to the Public Records Act, a prisoner injunction lawsuit against Jesse Harkcom. Roll was called with all council members voting yes. Motion carried.
