May 13, 2015 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., May 13, 2015 in the City Council Chambers of the William E. Moore Historic City Hall, Vice President Murphy presiding. Upon roll call it was found that Mayor Stephanson and Council Members Roberts, Murphy, Stonecipher, and Tuohy were present. Council Members Moore, Gipson, and Bader were excused Council Member Tuohy led the Pledge of Allegiance. The minutes of the May 6, 2015, City Council meeting were approved as printed. Vice PresidentMurphy announced that agenda item no. 9, a public hearing regarding the Burlington Northern Santa Fee Railway Pigeon Creek Slope Stabilization project, had been pulled from the agenda. MAYOR OATH OF OFFICE Moved by Council Member Roberts, seconded by Council Member Tuohy, to concur with the appointment of Alex Evanson and Travis Taylor as new police officers. Roll was called with all council members voting yes except Council Members Moore, Gipson, and Bader who were excused. Motion carried. The Deputy City Clerk administered their oaths of office and Mayor Stephanson presented the officers with their badges. Mayor Stephanson shared that the city of Everett has another six individuals attending the police academy. The Mayor thanked the Everett Police Department and Washington State Patrol for removing a car from his lawn on Sunday morning and arresting the driver. 137  May 13, 2015 COUNCIL Council Member Tuohy stated that Everett Police Officer Eddie Golden provided safety training to the staff of the Schack Art Center this morning. She encouraged other businesses to take advantage of this training. Council Member Stonecipher expressed safety concerns related to the closure of the Howarth Park overpass and lack of access to the beach. She suggested that signs be placed in the park to provide information regarding alternative routes. Paul Kaftansi, Parks, stated that staff signed various parts of the park today to indicate the closures, the bridge will be physically shut off tomorrow morning, and park rangers will provide emphasis patrols He stated that the city' s website will also be in the park. updated to provide information regarding alternative locations for citizens to utilize. Council Member Stonecipher stated that she received comments from citizens in north Everett regarding a letter from the city of Everett indicating the opportunity to receive reimbursement for any future flood damage has ended. She questioned the definition of " properly maintained" as it applies to backwater valves and how citizens who are maintaining their own backwater valves can prove valves are being maintained. Council Member Stonecipher also questioned whether the city would compensate an individual if their backwater valve fails, even though it was installed correctly and maintained. Dave Davis, Public Works, responded to her questions. CAA/ CFO Bryant, Administration, stated that she would schedule Grant Moen, Utilities, and Tim Benedict, Legal, to attend a future City Council meeting to answer questions. Council Member Roberts commended staff on the good work they' ve done regarding the Broadway Bridge Replacement project. Council Member Roberts spoke regarding his attendance at the Puget Sound Regional Council meetings dealing with transportation and growing He expressed his appreciation for the work done by transit communities. staff related to Sound Transit 3 alignments. 138  May 13, 2015 CITY ATTORNEY The City Attorney had no comments CITIZEN COMMENTS Jackie Minchew, Everett, spoke regarding global warming and energy uncertainty. Greg Weyer, Everett, expressed concern regarding verbiage in Ordinance No. 3400- 15 related to backflow valve and flooding claims. Michael Gerrodette, Everett, regarding homeless camps, drug spoke problems, thefts and vandalism in the Twin Creeks community. He invited the council members to tour the area. BID CALL —SHORE AVENUE STORMWATER OUTFALL IMPROVEMENTS Authorize a call for bids for the Shore Avenue Stormwater Outfall Improvement project. JOB COMPLETE —WATER MAIN " N" REPLACEMENT Accept the Water Main " N" Replacement project as complete and authorize the Mayor to sign the Certificate of Completion with CPC Materials, doing business as Smokey Point Concrete, allowing the release of the retainage bond. PUBLIC HEARING — RESOLUTION/ PIGEON CREEK SLOPE STABILIZATION This item, to adopt a proposed regarding the Burlington resolution Northern Santa Fe Railway Company Pigeon Creek Slope Stabilization project, was pulled from the agenda. 141  May 13, 2015 ACTION ITEMS: AGREEMENT —HOMELAND SECURITY GRANT PROGRAM FUNDS Moved by Council Member Tuohy, seconded by Council Member Roberts, to authorize the Mayor to sign the Snohomish County Grant Agreement to receive Federal Fiscal Year 2013 and Fiscal Year 2014 U. S. Department of Homeland Security Grant Program Funds for the purchase of specialized equipment in the amount of $155, 330. 00. COUNCIL BILL NO. 1504- 11 THIRD AND FINAL READING: AN ORDINANCE establishing an Everett Water Utility Committee and repealing Ordinance No. 1604-89 Moved by Council Member Roberts, seconded by Council Member Tuohy, that this is declared to be the third and final reading of Council Bill No. 1504- 11 and the City Clerk is directed to call the roll for the final disposition of the ordinance. Motion carried. 143  May 13, 2015 AGREEMENT AMENDED —2012 STATE STORMWATER GRANT Moved by Council Member Roberts, seconded by Council Member Stonecipher, to authorize the Mayor to sign Amendment No. 1 to the 2012 Washington State Stormwater Grant Agreement No. G1200552 with the Washington State Department of Ecology to provide a time extension to September 30, 2015.
