May 20, 2015 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., May 20, 2015, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Bader presiding. Upon roll call it was found that Council Members Moore, Murphy, Stonecipher, Bader, Gipson, and Tuohy were present. Mayor Stephanson and Council Member Roberts were excused. Council Member Tuohy led the Pledge of Allegiance. The minutes of the May 13, 2015, City Council meeting were approved as printed. Council Members Gipson and Bader abstained from the vote. MAYOR Mayor Stephanson was excused. COUNCIL Council Member Murphy provided a liaison report on his attendance at the Fire Pension Board meeting this morning. He also announced that there are at least five budget updates scheduled for Council briefing in the next several months. The first briefing will be held on June 3, 2015. Council Member Tuohy provided a liaison report on her attendance at the Library Board meeting last night. She stated she had received comments from concerned citizens regarding the closure of the Howarth Park Overpass and lack of Bond Street accessibility to the waterfront, and asked if Jetty Island could be expanded. Debra Bryant, CAO/ CFO, stated she would contact Paul Kaftanski, Parks Director. Council Member Stonecipher commented on the sewer letter that was mailed to residents in the north end of Everett, and asked when the topic would be placed on the Council briefing agenda. Debra Bryant stated it is scheduled for June 3, 2015. 145  May 20, 2015 Council Member Moore provided liaison reports on his attendance at Tuesday's Joint Tulalip Water Board and the Public Facilities District Board meeting held this morning. Council Member Gipson asked for an update on the recent news article concerning illegal activity at Purple Haze, Everett marijuana retailer. Debra Bryant provided a short recap regarding the press release issued by the Washington State Liquor Control Board announcing results of its first compliance checks of recreational marijuana stores. Council Member Gipson also requested a briefing sometime in June to discuss the City' s obligation regarding the new Snohomish County Courthouse development project, of which the vacation requested in Action Item # 6 is a component. President Bader provided a liaison report on his attendance at the Police Pension Board held on Wednesday. He also announced that the next discussion regarding Council policy and procedures is scheduled for Wednesday, June 17, 2015. CITY ATTORNEY City Attorney Iles had no comments. CITIZEN COMMENTS Shelly Weir, Northwest Neighborhood Chair, commented on a letter sent by the City regarding future backwater valve program claims. Nikki Oku, Everett, also commented on flooding damage to her home and future backwater valve program claims. Council Member Gipson inquired about the various contractors hired to install backwater valves. Debra Bryant stated a list of contractors was provided to homeowners, and she would ask staff to be prepared to 3rd answer questions during the June briefing. 146  May 20, 2015 Council Member Stonecipher expressed concern about the concept contained in the ordinance regarding proper by the maintenance homeowner. Debra Bryant stated she would ask for an update from staff. PROPOSED ACTION AGENDA: COUNCIL BILL NO. 1505- 14 SECOND READING: AN ORDINANCE amending the Zoning Code to allow storage and maintenance facilities for public transportation agencies as a Special Property Use in the B- 2 ( Community Business) zone, amending Section 4 of Ordinance No. 1671- 89 and Section 36 of Ordinance No. 2397- 99, as amended ( EMC Title 19, Zoning) CONSENT ITEMS: Moved by Council Member Gipson, seconded by Council Member Murphy, to approve the following consent items: RESOLUTION — CLAIMS To adopt Resolution No. 6855 acknowledging the payment of audited and approved claims against the city of Everett in the amount of 6, 303, 451. 04 for the period of May 2, 2015, through May 8, 2015. STREET CLOSURE —ARTIST' S GARAGE SALE To authorize the closure of Hoyt Avenue, Pacific to Wall, from 6 p. m., June 5 through 9 a. m., June 6, 2015, and the closure of Hoyt Avenue, Wall to Hewitt, from 6 p. m., June 5 through 6 p. m., June 6, 2015, for an Artist's Garage Sale sponsored by the Schack Art Center. 147  May 20, 2015 STREET CLOSURE —BIKE TO SCHOOL DAY 13th 10th To authorize a rolling street closure from and Hoyt, to Street, to Whittier Elementary, for a Bike to School Day on May 28, 2015, 8: 00 a. m. to 8: 30 a. m., sponsored by the Whittier Elementary PTA. STREET CLOSURE —BLOCK PARTY 33rd To authorize the closure of Grand Avenue, to 34th Street, for a Block Party May 23, 2015, 5: 00 p. m. to 8: 00 p. m., on sponsored by the Purpose Church of Everett. PUBLIC HEARING — PROPOSED VACATION Council President Bader opened a public hearing regarding the vacation of a portion of the north/ south alley lying north of Wall Street between Oakes and Rockefeller Avenues and directed staff to prepare an ordinance subject to the conditions as contained in the staff report. Council President Bader invited public comment. There were no citizens who wished to speak. Moved by Council Member Moore, seconded by Council Member Tuohy, to close the public hearing. Roll was called with all council members voting yes, except Council Member Roberts who was excused. PURCHASE — BRAUN NW NORTH STAR AID CAR Moved by Council Member Stonecipher, seconded by Council Member Tuohy, to authorize the purchase of one Braun NW North Star Aid Car from Snohomish County Fire District 3 contract in the amount of$ 177, 792. 89, including Washington State sales tax. Sullivan Park Capital Construction Project," Fund 354, Program 016, as established by Ordinance No. 2474-00 Moved by Council Member Murphy, seconded by Council Member Tuohy, that this is declared to be the third and final reading of Council Bill No. 1504- 12 and the City Clerk is directed to call the roll for the final disposition of the ordinance.
