January 20, 2016 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., January 20, 2016, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Murphy presiding. Upon roll call, it was found that Mayor Stephanson and Council Members Roberts, Moore, Murphy, Franklin, Bader, Stonecipher, and Tuohy were present. Council Member Roberts led the Pledge of Allegiance. The minutes of the January 13, 2016, City Council meeting were approved as printed. MAYOR OATH — POLICE OFFICERS Moved by Council Member Roberts, seconded by Council Member Tuohy, to concur with the appointment of Mark Gist, Shawn Bell, and Tad Halbert as new police officers. Roll was called with all council members voting yes. Motion carried. The Deputy City Clerk administered the oath of office and Mayor Stephanson presented the officers with their badges. APPOINTMENTS/ REAPPOINTMENTS Moved by Council Member Moore, seconded by Council Member Bader, to concur with the following appointments: CHIP Loan Review Committee Appointment of Joel Haack to Position 3 for the remainder of a four- year term, ending December 31 , 2017. 15  January 20, 2016 Reappointment of Gene Lilley to Alternate Position 3 for of a four- year term, ending December 31, 2019. Lodging Tax Advisory Board Appointment of Cassie Franklin to Position 5 for the remainder of a four-year term, ending December 31, 2018. Roll was called with all council members voting yes. Motion carried. COUNCIL Council Member Moore provided a liaison report on his attendance at the Public Facilities District Board meeting. Council Member Franklin reminded the public about two community events: Housing First Forum on February 1, 2016, at 6: 30 p. m., at the Historic Everett Theatre; Fifth annual Shakaroo benefit concert for the Everett Animal Shelter on February 13, 2016, at the Everett Performing Arts Center from 7: 00 p. m. to 9: 30 p. m. Council Member Roberts stated that he received several emails regarding noise levels and an exhaust fumes in the city. He forwarded the concern regarding air quality to the Puget Sound Clean Air Agency. Council Member Tuohy provided a liaison report on her attendance at the Library Board meeting last evening. President Murphy reminded citizens that they are welcome to attend the City Council retreat, which will be held on January 23, 2016, 8: 00 a. m. to noon, at the Carl Gipson Senior Center. 16  January 20, 2016 President Murphy read the names of the applicants for the Charter Review Committee. President Murphy asked the Mayor and council members to provide their member nominations to serve on the Charter Review Committee. Mayor Stephanson announced the names of his nominees: Terrie Battuello, Dave Koenig, Jo Metzger- Levin, Tom Norcott, Clair Olivers, Angie Sievers, and Michael Trujillo. Council Member Moore nominated Walter White. Council Member Franklin nominated Reid Shockey. Council Member Bader nominated Michael Swanson. Council Member Stonecipher nominated Megan Dunn. Council Member Roberts nominated Erica Temple. Council Member Tuohy nominated Steven Graham. President Murphy nominated Christopher D. Adams. Moved by Council Member Moore, seconded by Council Member Roberts, to appoint Terrie Battuello, Dave Koenig, Jo Metzger-Levin, Tom Norcott, Clair Olivers, Angie Sievers, Michael Trujillo, Walter White, Reid Shockey, Michael Swanson, Megan Dunn, Erica Temple, Steven Graham, and Christopher D. Adams to the Charter Review Committee. Roll was called with all council members voting yes. Motion carried. 17  January 20, 2016 ADMINISTRATION UPDATE ON PRIOR BUSINESS Debra Bryant, Administration, had no report. CITY ATTORNEY City Attorney Iles had no comments. CITIZEN COMMENTS Jackie Minchew, Everett, commented on the warmth of the planet and the methane leak in California. He also spoke about the Delta 5 trial. J. T. Dray, Everett, commented on a future of Everett Transit. Shelley Weyer, Everett, spoke about staffing, support, and funding for the Office of Neighborhoods. COUNCIL BRIEFING AGENDA: Adopt Resolution for expenditure of 2016 Human Needs funds in the amount of$ 423, 200. 00. Presented by Becky McCrary, Planning Council Member Franklin recused herself from participating in any discussion and decision making involving this item. She stated that she is employed by Cocoon House and there could be a conflict of interest. Council Member Tuohy also recused herself from participating in any discussion and decision making involving this item. She stated that she works for the Arts Council of Snohomish County and there could be a conflict of interest. Council Member Stonecipher that a list of the requests that the City has received from agencies, and the funding level for these requests, be presented to the Council before the vote. 18  January 20, 2016 Authorize the Mayor to sign the Professional Services Agreement with Friendship Diversion Services for supervision of diversion programs in an amount not to exceed $ 80, 000. 00. Presented by Hil Kaman, Legal; and Barbara Miller, Executive Director of Friendship Diversion Services President Murphy expressed his interest in the statistics related to the number of participants, work crews, and level of supervision provided. He asked that these statistics be presented to the Council at the end of 2016. Debra Bryant, Administration, stated this item will be revisited in January of 2017. COUNCIL BILL 1601- 01 FIRST READING: AN ORDINANCE creating a special improvement project entitled South Everett Forest Preserve Recreation Improvements", Fund 354, Program 047, to accumulate all costs for the improvement project Presented by Paul Kaftanski, Parks CONSENT ITEMS: Moved by Council Member Moore, seconded by Council Member Roberts, to approve the following consent items: RESOLUTION - CLAIMS To adopt Resolution No. 6940 acknowledging the payment of audited and approved claims against the City of Everett in the amount of 1, 249, 041. 43 for the period of January 1, 2016, through January 8, 2016. 19  January 20, 2016 Roll was called with all council members voting yes. ACTION ITEMS: RESOLUTION —WASHINGTON STATE LEGISLATURE' S PRIORITIES Moved by Council Member Roberts, seconded by Council Member Bader, to adopt Resolution No. 6941 regarding the City' s priorities for the Washington State Legislature' s 2016 Session. Council Member Roberts complimented the Mayor and city staff for their work. President Murphy echoed Council Member Roberts comments. Roll was called with all council members voting yes. GRANT —MARINE PATROL FEDERAL FINANCIAL ASSISTANCE Moved by Council Member Franklin, seconded by Council Member Bader, to authorize the Mayor to sign all necessary documents with the Washington State Parks and Recreation Commission regarding application, utilization, award and acceptance of the $ 17, 912. 00 Federal Fiscal Year 2016 Marine Patrol Federal Financial Assistance Grant Program and the Request for the Federal Financial Assistance Grant and Boating Safety Program Approval. Motion carried. 20  January 20, 2016 AGREEMENT —SETTLEMENT WITH ARTHUR WEST Moved by Council Member Roberts, seconded by Council Member Moore, to authorize the Mayor to sign the agreement to settle all claims with Arthur West in the amount of $45, 000. 00. Roll was called with all council members voting yes. Motion carried. AGREEMENT — EVERETT STATION OPERATION AND MAINTENANCE AGREEMENT Moved by Council Member Bader, seconded by Council Member Moore, to authorize the Mayor to sign the Everett Station Operations and Maintenance Agreement with Sound Transit.
