April 6, 2016 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., April 6, 2016, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Murphy presiding. Upon roll call, it was found that Council Members Roberts, Moore, Murphy, Bader, Stonecipher, and Tuohy were present. Mayor Stephanson and Council Member Franklin were excused. Council Member Roberts led the Pledge of Allegiance. The minutes of the March 30, 2016, City Council meeting were approved as printed. Council Members Moore and Tuohy abstained from the vote. MAYOR Mayor Stephanson was excused. COUNCIL Council Member Moore provided a liaison report for the Council Budget Subcommittee meeting held this evening. He announced that the 2017 budget calendar will be available soon for viewing on the City of Everett website. Council Member Roberts thanked Port of Everett CEO/ Executive Director Les Reardanz and his staff for providing an opportunity to tour Port properties. President Murphy announced that citizens will have an opportunity to learn more about the Sound Transit 3 ( ST3) proposal at an open house to be held at Everett Station on April 25, 2016, 5: 30 to 7: 30 p. m. p. m. Presentations begin at 6: 00 p. m. Information about submitting comments may be found by visiting www.soundtransit.org. President Murphy announced that he would be leaving the Council meeting at approximately 7: 15 p. m. for a speaking engagement, and that Vice President Tuohy would preside over the remainder of the meeting. 109  April 6, 2016 ADMINISTRATION UPDATE ON PRIOR BUSINESS Debra Bryant, Administration, had no comments. CITY ATTORNEY City Attorney Iles had no comments. CITIZEN COMMENTS Cletus Skrabak, Everett, spoke about the yearly adoption of the City of Everett budget, and he encouraged the Council to adopt an ordinance to change the process to a biennial budget adoption. Jackie Minchew, Everett, spoke about climate action, and provided a report on his attendance at the " Keeping Fossil Fuel Underground" Seattle Town Hall event held on Monday. Elizabeth Stenhouse, Everett, voiced concern about pending land use action BSP15- 003 ( Soundview business park). Allan Giffen, Planning, provided additional information about the scope of the project. President Murphy asked that citizens with questions about the appeal process be referred to City staff. COUNCIL BRIEFING AGENDA: Snohomish County Tourism Bureau Annual Report Presented by Amy Spain, Snohomish County Tourism Bureau 110  April 6, 2016 COUNCIL BILL 1603- 15 FIRST READING: AN ORDINANCE relating to Drug Paraphernalia and Marijuana, repealing Ordinance 1653- 89, Section 8 ( Chapter 10. 35. 080 EMC) Presented by Flora Diaz, Legal CONSENT ITEMS: Moved by Council Member Bader, seconded by Council Member Moore, to approve the following consent items: RESOLUTION - CLAIMS To adopt Resolution No. 6970 acknowledging the payment of audited and approved claims against the City of Everett in the amount of 856, 189. 82 for the period of March 19, 2016, through March 25, 2016. RESOLUTION - PAYROLL To adopt Resolution No. 6971 acknowledging payment of audited and approved payroll claims against the City of Everett in the amount of$ 3, 682, 642. 30 for the period ending March 19, 2016. PUBLIC HEARING — COUNCIL BILL 1603- 13 President Murphy opened a public hearing regarding Council Bill No. 1603- 13, a proposed ordinance expanding the Multiple Family Property Tax Exemption Area, and amending Ordinance No. 2347- 98, as amended EMC Chapter 3. 78). 111  April 6, 2016 Allan Giffen, Planning, provided a brief overview of the proposed ordinance. President Murphy invited public comment. Robert Cramer, Everett, asked for more information about the criteria developers must meet to qualify for tax exemptions. He also expressed concern that the housing shortage in Everett could expand the program even further if the City is unable to find affordable housing. Allan Giffen responded that there are additional requirements, outlined in EMC 3. 78, that go above and beyond the development standards, as well as exemptions that encourage the development of more housing. Moved by Council Member Roberts, seconded by Council Member Bader, to close the public hearing. Roll was called with all council members voting yes, except Council Member Franklin who was excused. COUNCIL BILL 1603- 14 THIRD AND FINAL READING: AN ORDINANCE creating a special improvement project entitled " Kasch Park Multipurpose Fields 2 and 3 — Replacement and Renovation," Fund 354, Program 049, to accumulate all costs for the improvement project Moved by Council Member Roberts, seconded by Council Member Bader, that this is declared to be the third and final reading of Council Bill No. 1603- 14. 113  April 6, 2016 Vice President Tuohy requested a letter from the Everett School District regarding the installation of artificial turf that uses crumb rubber at Kasch Park be entered into the record. BID AWARD —KASCH PARK SYNTHETIC TURF REPLACEMENT AND RENOVATION PROJECT Moved by Council Member Bader, seconded by Council Member Moore, to waive immaterial irregularity and award the construction contract for the synthetic turf replacement and renovation project on Kasch Park multipurpose fields 2 and 3 to Premier Field Development in the amount of $ 2, 860, 100. 00 plus Washington State sales tax. Motion carried. 114  April 6, 2016 AGREEMENT —SHARING OF RADIO SYSTEM WITH WATERSHED PATROL PERSONNEL Moved by Council Member Moore, seconded by Council Member Bader, to authorize the Mayor to sign the Radio Sharing Agreement with the Washington Department of Natural Resources to share frequencies on their radio system with Watershed Patrol personnel. Motion carried. 41ST BID AWARD — STREET TO WEST MARINE VIEW DRIVE CORRIDOR IMPROVEMENTS PROJECT 41st Vice President Tuohy stated this item is bid regarding the a award Street to West Marine View Drive Corridor Improvements Project. The apparent low bidder is Valley Electric; however, the recommended bid award is to Marshbank Construction as the lowest responsive and responsible bidder. A bid protest regarding an award to Marshbank Construction has been filed by Valley Electric. Graham Anderson, Port of Everett, spoke in favor of the project. He stated the Port, as a funding partner, supports the City staff recommendation. Ryan Sass, Public Works, provided a brief summary of the project protest and staff recommendation. City Attorney Iles asked Vice President Tuohy to provide the amended action. Moved by council Member Moore, seconded by Council Member Bader, to reject the protest from Valley Electric, reject the bid from Valley Electric as non- responsive, and award the contract bid for the 41st Street to West Marine View Drive Corridor Improvements Project 115  April 6, 2016 to Marshbank Construction of Lake Stevens, WA, in the amount of 2, 758, 753 including Washington State sales tax. BID AWARD —2016 BIOSOLIDS DISPOSAL PROJECT Moved by Council Member Moore, seconded by Council Member Stonecipher, to award the 2016 Biosolids Disposal Project contract to Karl Needham Enterprises Inc., for transport and disposal of biosolids from the Water Pollution Control Facility, in the amount of 664,492. 92 including Washington State sales tax. Roll was called with all council members voting yes, except Council Members Murphy and Franklin who were excused. Motion carried. BID AWARD —2016 BIOSOLIDS REMOVAL PROJECT Moved by Council Member Bader, seconded by Council Member Roberts, to award 2016 Biosolids Removal Project contract to American Group Inc., for removal of biosolids from the Process Water Pollution Control Facility, in the amount of $ 553, 065. 98 not including Washington State sales tax. Motion carried. 116  April 6, 2016 AGREEMENT —NORTH BROADWAY BUS STOP SAFETY IMPROVEMENTS Moved by Council Member Roberts, seconded by Council Member Moore, to authorize the Mayor to sign the State Capital Construction Grant Agreement No. GCB2316 for North Broadway Bus Stop Safety Improvements with the Washington State Department of Transportation. Roll was called with all council members voting yes, except Council Members Murphy and Franklin who were excused. Motion carried. AGREEMENT — PURCHASE CARGO CONTAINERS FOR STORAGE OF DISASTER- RELATED SUPPLIES Moved by Council Member Stonecipher, seconded by Council Member Bader, to authorize the Mayor to sign the Homeland Security Grant Agreement with Snohomish County to receive grant funds to purchase three cargo containers for storing disaster-related supplies.
