November 2, 2016 The regular meeting of the Everett City Council was called to order at 6: 34 p. m., September 7, 2016, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Murphy presiding. Upon roll call, it was found that Mayor Stephanson and Council Members Roberts, Murphy, Franklin, Stonecipher, and Tuohy were present. Council Member Bader was excused. Vice President Tuohy led the Pledge of Allegiance. The minutes of the October 26, 2016, City Council meeting were approved as printed. MAYOR Mayor Stephanson stated the employee service awards ceremony was held this afternoon, and he congratulated Council Member Roberts who was recognized for 10 years of service. COUNCIL Council Member Tuohy commented that she visited the new Marriott Courtyard hotel on Saturday and encouraged citizens to check it out. Council Member Roberts thanked the Mayor for his comments. He reported that he attended a meeting today in Olympia held by the Joint Transportation Committee on rail safety. Council Member Roberts also commented that he toured the Francis Place facility in Bellingham last Thursday. ADMINISTRATION UPDATE ON PRIOR BUSINESS Debra Bryant, Administration, had no report. 351  November 2, 2016 CITY ATTORNEY City Attorney Iles requested an executive session, anticipated to last no longer than 15 minutes, concerning a legal matter pursuant to RCW 42. 30. 110( 1)( i)( c) and RCW 42. 30. 110( 1)( i)( h) with no announcement to follow. CITIZEN COMMENTS J.T. Dray, Everett, spoke about the counterproposal to the Charter Review Committee' s recommendation to establish a committee devoted exclusively to Everett Transit. He also talked about a new bus stop in North Everett that is not available to Everett Transit riders. Jeanine Warner, Everett, commented on the decline in " middle Everett" and the need for economic development, code enforcement, infrastructure improvement, and beautification along Evergreen Way. Jackie Minchew, Everett, spoke about climate change and justice relating to the recent trial held in Portland, Oregon, and events surrounding the Dakota Access Pipeline protests in North Dakota. John Dimas, Everett, thanked City Council for considering the proposed amendment to the zoning code to allow detached accessory dwelling units in single family zones. COUNCIL BRIEFING AGENDA: Adopt Resolution designating certain real property located near the intersection of Berkshire Drive and Evergreen Way as the preferred alternative for development of a 70- unit supportive housing facility. COUNCIL BILL 1610- 45 FIRST READING: AN ORDINANCE adjusting water, filtration, sewer and storm water rates as recommended Presented by Matt Welborn, Finance; and Tom Gould, HDR Engineering, Inc. Council Member Franklin expressed concern about the cumulative effect of increases. She requested information regarding populations of comparable municipalities and the median income of Everett ratepayers. Debra Bryant stated that information would be provided prior to the next Council meeting. 353  November 2, 2016 Council Member Roberts requested a copy of the rate study. Matt Welborn stated he would forward a copy of the study. President Murphy commented on the 30% increase in the surface water category, some of which is necessary to make up for costs incurred from the 2013 storm events. President Murphy asked if it were possible to issue a temporary one- time increase to replenish the fund rather than a permanent rate increase. Mr. Welborn stated a permanent increase is necessary in order to make the City' s bond payments over the next 25 years. Mayor Stephanson stated the State continues to look at water quality in the Puget Sound and the impact of storm water. He commented that it is likely that in the coming decades, the ever- increasing requirement to treat stormwater will have an impact on the City. COUNCIL BILL 1610- 46 AN ORDINANCE amending Ordinance 3440- 15 ( Everett Municipal Code 14. 04. 025) relating to discounted rates for water and sewer services for low- income, senior residents Presented by Matt Welborn, Finance PROPOSED ACTION ITEMS: COUNCIL BILL 1610- 44 SECOND READING: AN ORDINANCE closing a Special Improvement Project entitled North Everett Pedestrian and Bicycle Safety" Fund 303 Program 093 as established by Ordinance No. 3243- 11 354  November 2, 2016 CONSENT ITEMS: Moved by Council Member Roberts, seconded by Council Member Franklin, to approve the following consent items: RESOLUTION - CLAIMS To adopt Resolution No. 7044 acknowledging the payment of audited and approved claims against the City of Everett in the amount of 2, 957, 166. 53 for the period of October 15, 2016, through October 21, 2016. RESOLUTION — PAYROLL To adopt Resolution No. 7045 acknowledging payment of audited and approved payroll claims against the City of Everett in the amount of$ 3, 677, 050. 19 for the period ending October 15, 2016. BID CALL —PURCHASE OF TRANSIT UNIFORMS To authorize Call for Bids 2016- 081 for purchase of Transit uniforms. JOB COMPLETE —WATER MAIN " P" REPLACEMENT PROJECT To accept the Water Main " P" Replacement Project as complete and authorize the Mayor to sign the Certificate of Completion with Allied Construction Associates, Inc. allowing the release of held retention. Motion carried. 355  November 2, 2016 ACTION ITEMS: RESOLUTION — PROPERTY TAX LEVY LIMIT Moved by Council Member Roberts, seconded by Council Member Franklin, to adopt Resolution No. 7046 finding a substantial need for using the 101% limit factor under Chapter 84. 55 RCW with regard to the levying of regular property taxes and emergency medical services property taxes, and authorizing the same to be used to fund the City General Fund and the Emergency Medical Services Fund. COUNCIL BILL 1610- 43 THIRD AND FINAL READING: AN ORDINANCE authorizing the issuance of Water and Sewer Revenue bonds in the principal amount not to exceed 82, 500, 000 for the purpose of refunding certain outstanding revenue bonds of the City Moved by Council Member Roberts, seconded by Council Member Stonecipher, that this is declared to be the third and final reading of Council Bill No. 1610- 43, and the city clerk is directed to call the roll for the final disposition of the ordinance. AGREEMENT — LEASE WITH WORKFORCE DEVELOPMENT COUNCIL FOR SPACE AT EVERETT STATION Moved by Council Member Tuohy, seconded by Council Member Franklin, to authorize the Mayor to sign a Lease Agreement with Workforce Development Council Snohomish County for space at Everett Station. AGREEMENT AMENDED — WFP PROGRAMMED LOGIC CONTROLLERS REPLACEMENT PROJECT Moved by Council Member Tuohy, seconded by Council Member Roberts, to authorize the Mayor to sign Amendment No. 2 to the Professional Services Agreement with Tetra Tech, Inc. for constructionengineering support for the Water Filtration Plant Programmed Logic Controllers Replacement Project in the amount of 166, 770. PUBLIC HEARING — 2017 BUDGET: Council President Murphy opened the second public hearing regarding the 2017 Budget. Debra Bryant, CAO/ CFO, stated Finance would be reviewing year-over- year changes within the budget. She introduced Susy Haugen and Rae Ann Weighter, Finance, and announced that department heads were also in the audience this evening. Susy Haugen, Finance, presented a review of the 2017 city-wide expenditure budget, city-wide staffing budget, and the general government expenditure budget; the general government fund changes from the 2016 original adopted budget to 2017 proposed budget, excluding labor cost changes related to cost- of- living adjustments, step increases, or benefit changes; and a review of the non- general government funds. 359  November 2, 2016 Council Member Stonecipher asked about the number of inmates being housed in Yakima as a result of the agreement with Yakima County Corrections. She suggested this topic be referred to the Public Safety Subcommittee for further discussion. Council Member Franklin requested information about the potential impacts of a minimum wage increase and labor law changes on the budget. Debra Bryant stated they could provide an estimate. She also stated the personnel contingency fund is available for these types of unknown expenditures. Council President Murphy invited public comment. There was no response. Council President Murphy continued the public hearing to the November 9, 2016, City Council meeting. Kirin Vreeland, Silver Lake, asked for clarification as to what M& O stands for. Debra Bryant stated M& O is the acronym for maintenance and operation.
