November 9, 2016 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., November 9, 2016, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Murphy presiding. Upon roll call, it was found that Mayor Stephanson and Council Members Roberts, Moore, Murphy, Franklin, Bader, Stonecipher, and Tuohy were present. Council Member Moore led the Pledge of Allegiance. The minutes of the November 2, 2016, City Council meeting were approved as printed. Council Member Bader abstained from the vote. MAYOR Mayor Stephanson thanked Council Member Roberts for his work on the Sound Transit 3 ( ST3) proposal. APPOINTMENT Moved by Council Member Tuohy, seconded by Council Member Roberts, to concur with the following appointment: Everett Public Library Board Appointment of Robert Bertoldi to Position 1 for the remainder of the 5- year term expiring December 31 , 2020. Roll was called with all council members voting yes. Motion carried. OATH — POLICE OFFICER Moved by Council Member Tuohy, seconded by Council Member Franklin, to concur with the appointment of Blake Wintch, Chris Rolling, Roberto Quemada, Rey Palacol, and Jason MacDonald as new police officers. 361  November 9, 2016 Roll was called with all council members voting yes. Motion carried. The Deputy City Clerk administered the oaths of office, and Mayor Stephanson presented the officers with badges. COUNCIL Council Member Moore thanked Council Member Roberts and the Mayor for their work on the Sound Transit 3 ( ST3) proposal. He also congratulated Everett Police Chief Templeman on the new hires. Council Member Bader provided a liaison report on his attendance at the Puget Sound Regional Council Growth Management Policy Board meeting last week. Council Member Franklin reported on her attendance at the Map Restoration event held at the Everett Public Library. Council Member Roberts thanked the community, the Mayor, and staff for supporting the ST3 proposal. He also reported on his attendance at the Association of Washington Cities Legislative Priorities Committee meeting. Council Member Roberts announced the General Government Subcommittee is scheduled to meet on Wednesday, November 30, at 5: 15 p. m. President Murphy provided a liaison report on his attendance at the Snohomish Health District Board meeting yesterday. He also announced that City of Everett boards and commissions vacancies are posted on the website and encouraged citizens to apply. ADMINISTRATION UPDATE ON PRIOR BUSINESS Debra Bryant, Administration, had no report. 362  November 9, 2016 CITY ATTORNEY City Attorney Iles had no comments. CITIZEN COMMENTS Jackie Minchew, Everett, spoke about the Dakota Access Pipeline protest and climate change. COUNCIL BRIEFING AGENDA: Everett Transit 3rd Quarter 2016 Briefing. Presented by Tom Hingson, Everett Transit COUNCIL BILL 1611- 47 FIRST READING: AN ORDINANCE relating to Municipal Court Judge positions, amending Ordinance No. 1259- 86 as amended by Ordinance No. 2228- 97 Presented by Jim Iles, Legal Mayor Stephanson shared challenges related to the slim pool of applicants. He also announced his intent to bring forward for appointment Superior Court Judge Thomas Wynne if this amendment passes. PROPOSED ACTION ITEMS: COUNCIL BILL 1610- 45 SECOND READING: AN ORDINANCE adjusting water, filtration, sewer and storm water rates as recommended 363  November 9, 2016 COUNCIL BILL 1610- 46 SECOND READING: AN ORDINANCE amending Ordinance 3440- 15 ( Everett Municipal Code 14. 04. 025) relating to discounted rates for water and sewer services for low- income, senior residents CONSENT ITEMS: Moved by Council Member Franklin, seconded by Council Member Tuohy, to approve the following consent items: RESOLUTION - CLAIMS To adopt Resolution No. 7047 acknowledging the payment of audited and approved claims against the City of Everett in the amount of 2, 133, 780. 86 for the period of October 22, 2016, through October 28, 2016. BID CALL —2017 BIOSOLIDS REMOVAL To authorize the Call for Bids for the 2017 Biosolids Removal Project. BID CALL —ANNUAL SUPPLY OF POLICE AMMUNITION To authorize the Call for Bids 2016- 082 for the annual supply of police ammunition. ACTION ITEMS: COUNCIL BILL 1610- 44 THIRD AND FINAL READING: AN ORDINANCE closing a Special Improvement Project entitled North Everett Pedestrian and Bicycle Safety" Fund 303 Program 093 as established by Ordinance No. 3243- 11 Moved by Council Member Bader, seconded by Council Member Tuohy, that this is declared to be the third and final reading of Council Bill No. 1610- 44, and the city clerk is directed to call the roll for the final disposition of the ordinance. AGREEMENT — EXTERIOR LIGHTING UPGRADE AT THE SOUTH POLICE PRECINCT Moved by Council Member Bader, seconded by Council Member Tuohy, to authorize the Mayor to sign an Energy Efficiency Contract with Snohomish County Public Utilities District for an exterior lighting upgrade at the South Police Precinct in the amount of 5, 337. 50. AGREEMENT — POLICE HEADQUARTERS CLEANING AND REPAIR PROJECT Moved by Council Member Tuohy, seconded by Council Member Stonecipher, to authorize the Mayor to sign Change Order No. 1 to the Police Headquarters Cleaning and Repair project with Alpine Waterproofing in the amount of$ 246, 620. AGREEMENT — INTERNET EVIDENCE FINDER DIGITAL FORENSICS SOFTWARE Moved by Council Member Bader, seconded by Council Member Tuohy, to authorize the Mayor to sign this and subsequent Magnet Forensics estimates accepting their End- User License Agreement in the amount of $2, 593. 50. RESOLUTION — PREFERRED ALTERNATIVE FOR SUPPORTIVE HOUSING FACILITY Council Member Bader stated that he is employed by the Archdiocese of Seattle and the head of this corporation is also the head of Catholic Housing Services. He stated that community members may perceive that he has divided loyalties in this matter, and therefore, recused himself from participating in any discussion and decision making involving this item. 366  November 9, 2016 Council Member Bader left the Council Chambers at 7: 17 p. m. Moved by Council Member Franklin, seconded by Council Member Moore, to adopt Resolution No. 7048 designating certain real property located near the intersection of Berkshire Drive and Evergreen Way as the preferred alternative for development of a 70- unit supportive housing facility. Everett Police Chief Templeman provided an overview on crime issues in the surrounding neighborhood. City Attorney Iles clarified that there is no legal conflict to prevent Council Member Bader from participating in discussion and voting on items related to the low- barrier housing. Mr. Iles stated that Council Member Bader chose not to participate for perception purposes. Considerable discussion ensued. PUBLIC HEARING — 2017 BUDGET: Council President Murphy opened the third public hearing regarding the 2017 Budget. Council Member Roberts suggested incorporating recommendations from the climate action report presented by Climate Solutions into the budget. Considerable discussion ensued. Council members agreed to take a deeper look at climate action options and provide specific directions to staff. Council members also talked about a possibility to refer this topic to the General Government Subcommittee, the Budget Subcommittee, Vision Committee, and have a discussion during the annual retreat. Council Member Tuohy suggested looking at the Parks Department staffing replenishment next year. President Murphy inquired about two vacant parking enforcement officer positions and suggested maximizing recruitment efforts. 368  November 9, 2016 Police Chief Templeman provided an update on parking enforcement officer recruitment. Council President Murphy invited public comment. There was no response. Moved Council Member Stonecipher, seconded by Council by Member Roberts, to close the public hearing.
