February 15, 2017 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., February 15, 2017, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Tuohy presiding. Upon roll call, it was found that Council Members Moore, Murphy, Franklin, Bader, and Tuohy were present. Mayor Stephanson and Council Members Roberts and Stonecipher were excused. Members of Cub Scout Pack 1 and 2 led the Pledge of Allegiance. The minutes of the February 8, 2017, City Council meeting were approved as printed. President Tuohy abstained from the vote. COUNCIL Council Member Moore provided an education update and stated he testified to the Washington State Appropriations Committee regarding the McCleary Decision on education funding. Council Member Murphy stated he attended the Wendt Award of Excellence Ceremony hosted by the Cultural Arts Commission. He also represented the City by providing welcoming remarks at the 2017 USA Curling National Championship on February 11. He reported on his attendance at the Port Gardner neighborhood meeting, where a presentation was givenby Ed Peterson of Housing Hope. He also provided liaison reports from the Snohomish Health District board meeting and the Fire Pension Board meeting. He commented on his attendance at the Lodging Tax Advisory Committee and the Everett Police Awards held on Wednesday. Council Member Bader also commented on his attendance at the 2017 USA Curling National Championship. He provided a liaison report on his attendance at the Riverside neighborhood meeting, where an auction was held to support the Animal Shelter. He also suggested adding security cameras to parks after the occurrence of vandalism at Legion Park in the last few days. Council Member Franklin provided an update from the Lodging Tax Advisory Committee. She commented on her attendance at the National 58  February 15, 2017 League of Cities, Human Development Federal Advocacy Committee, where they will discuss congressional city work in March, which will focus on gun violence, immigration reform, homelessness, and opioid addiction. She stated she attended the Everett Police Awards earlier today. She also announced a community engagement event to be held on March 4, at Evergreen Middle School from 9 a. m. to 4 p. m., hosted by the City Office of Neighborhoods. President Tuohy announced that agenda item number seven has been pulled from the agenda and moved to the February 22 agenda. She also commented on her attendance at the Everett Police Awards. She stated the For- Hire ordinance that was sent back Safety to the Public Subcommittee at the February 8 Council Meeting and placed on the March 8 Public Safety Subcommittee meeting agenda. President Tuohy stated she is working on the scheduling of the 2017 Council Retreat and asked each councilmember to identify two or three topics for discussion. ADMINISTRATION UPDATE ON PRIOR BUSINESS Debra Bryant, Administration, provided an update on the Service Center Redevelopment Project. She stated staff will be coming to Council to request a structural engineer be retained to investigate reinforcement options for the existing building. She also invited Paul Kaftanski, Administration, to provide a Transit update. CITY ATTORNEY City Attorney Iles had no comments. CITIZEN COMMENTS J. T.Dray, Everett, commented on Everett Transit schedules and the Transit Advisory Committee. 59  February 15, 2017 Jackie Minchew, Everett, spoke about fossil fuels and the end of environmental growth. Wendy McClure, City Office of Neighborhoods, welcomed members of the Diversity Advisory Board, and Ed Glazer read a letter from the Board to the Mayor and City Council thanking them for being a welcoming and inclusive community. Liz Vogeli, Everett, spoke about two groups she created, Everett in Solidarity with Immigrants and Refugees and Kind2BKind. Mark Ford, Seattle, spoke about his opposition to the proposed changes to the For- Hire Ordinance and Uber. COUNCIL BRIEFING AGENDA: Fire Alarm Retro Update Presented by Fire Chief Eric Hicks Council Member Murphy why some of the apartment questioned complexes have asked for exceptions reviews and a timeframe for those reviews. Chief Hicks stated the building department needs to perform inspections to determine if certain complexes qualify for those exceptions, and he will report back to Council. CONSENT ITEMS: Moved by Council Member Bader, seconded by Council Member Franklin, to approve the following consent items: RESOLUTION - CLAIMS To adopt Resolution No. 7080 acknowledging the payment of audited and approved claims against the City of Everett in the amount of 60  February 15, 2017 2, 587, 925. 95 for the period of January 28, 2017, through February 3, 2017. BID CALL - WATER MAIN REPLACEMENT " Q" EVERGREEN WAY PROJECT To authorize the Call for Bids for the construction of the Water Main Replacement " Q" Evergreen Way Project. Roll was called with all voting yes, except Council council members Members Roberts and Stonecipher who were excused. Motion carried. ACTION ITEMS: PURCHASE- PETERBILT TRUCK CHASSIS Moved by Council Member Bader, seconded by Council Member Moore, to authorize the purchase of a Peterbilt truck chassis from Washington State Contract 01513 in the amount of $ 165, 079. 13 including Washington State Sales tax. AGREEMENT — RIVERSIDE BUSINESS PARK Moved by Council Member Franklin, seconded by Council Member Moore, to authorize the Mayor to sign Amendment No. 1 to Riverside Business Park Public Access Agreement and Associated Covenant Terminations regarding the Riverside Business Park, all in substantially the form provided. 61  February 15, 2017 Roll was called with all council members voting yes, except Council Members Roberts and Stonecipher who were excused. PUBLIC HEARING - COUNCIL BILL 1701- 07 President Tuohy opened a public hearing regarding Council Bill No. 1701- 07, a proposed ordinance pertaining to Accessory Dwelling Units, amending Ordinance Nos. 1847- 92, 2146- 96, 2397- 99 and 2503- 01, as amended ( EMC Title 15 and 19). Allan Giffen, Planning, stated the Planning Commission held four public workshops and a public hearing to review the current regulations. He stated the major change recommended is to allow additions of detached accessory dwelling units to all single family zones. Council President Tuohy invited public comment. John Dimas, Everett, thanked Council for the opportunity to bring forth the updates to the current municipal code and expressed his support of the ordinance. Moved by Council Member Franklin, seconded by Council Member Moore, to close the public hearing. COUNCIL BILL 1701- 07 THIRD AND FINAL READING: AN ORDINANCE pertaining to Accessory Dwelling Units, amending Ordinance Nos. 1847- 92, 2146- 96, 2397- 99 and 2503- 01, as amended ( EMC Title 15 and 19) 62  February 15, 2017 Moved by Council Member Moore, seconded by Council Member Murphy, that this is declared to be the third and final reading of Council Bill No. 1701- 07, and the city clerk was directed to call roll for the final disposition of the ordinance. RESOLUTION — 2017 HUMAN NEEDS GRANT FUNDING Resolution for expenditure of 2017 Human Needs Grant Funding in the amount of$ 434, 000. This item was pulled from the agenda and rescheduled for February 22. AGREEMENT- ON CALL SURVEYING SERVICES Moved by Council Member Bader, seconded by Council Member Franklin, to authorize the Mayor to sign the professional services agreements for 2017- 2018 on- call surveying services. BID AWARD - WATER FILTRATION PLANT ( WFP) OPERATIONS BUILDING SEISMIC RETROFIT PROJECT Moved by Council Member Murphy, seconded by Council Member Bader, to award the construction contract for the Water Filtration Plant (WFP) Operations Building Seismic Retrofit Project to Kassel & 63  February 15, 2017 Associates, Inc. in the amount of $ 756, 942, including Washington State sales tax. AGREEMENT AMENDED —SMITH ISLAND RESTORATION PROJECT Moved by Council Member Franklin, seconded by Council Member Moore, to authorize the Mayor to sign Amendment No. 3 to the Professional Services Agreement with ICF Jones & Stokes, Inc. for the Smith Island Restoration Project in the amount of$ 86, 328. Roll was called with all council members voting yes, except Council Members Roberts and Stonecipher who were excused. Motion carried. AGREEMENT AMENDED —SMITH ISLAND RESTORATION PROJECT Moved by Council Member Bader, seconded by Council Member Murphy, to authorize the Mayor to sign Amendment No. 1 to the Smith Island Restoration Project Interlocal Agreement with Snohomish County with an estimated cost to the city of $1, 172, 780.
