January 17, 2018 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., January 17, 2018, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Roberts presiding. Upon roll call, it was found that Mayor Franklin and Council Members Roberts, Moore, Murphy, McNeal, Bader, and Tuohy were present. Council Member Stonecipher was excused. Council Member Moore led the Pledge of Allegiance. The minutes of the January 10, 2018, City Council meeting were approved as printed. The minutes of the January 10, 2018, special meeting were approved as printed. MAYOR APPOINTMENT/ REAPPOINTMENTS Moved by Council Member Bader, seconded by Council Member McNeal, to concur with the following appointments: Transportation Advisory Committee Appointment of Renee Quistorf to Position 5 for a six- year term ending December 31, 2023. Reappointment of Tyler Rourke to Position 6 for a six- year term ending December 31, 2023. Roll was called with all council members voting yes, except Council Member Stonecipher who was excused. Motion carried. 24  January 17, 2018 APPOINTMENTS Moved by Council Member Murphy, seconded by Council Member Tuohy, to concur with the following appointments: Senior Center Advisory Board Appointment of Mary Blakely to Position 6 for a six- year term ending December 31, 2023. Appointment of Lynne Worley to Position 7 for a six- year term ending December 31, 2023. Roll was called with all council members voting yes, except Council Member Stonecipher who was excused. Motion carried. COUNCIL Council Member Bader provided an update from the Delta Neighborhood meeting. Council Member Tuohy provided a liaison report from the Everett Library Board and stated the Library has begun their 2018 reading challenge. President Roberts commented on his attendance at the Martin Luther King Jr. celebration. He stated he sent out a draft of the 2018 liaison assignments to Council and expects to finalize assignments by Friday. He also proposed adding a subcommittee for economic development and real estate. Additionally, he stated he plans to schedule a council retreat in February to discuss council procedures and budget process procedures. ADMINISTRATION UPDATE ON PRIOR BUSINESS Lyle Ryan, Administration, had no report. 25  January 17, 2018 CITY ATTORNEY City Attorney Iles requested an executive session, anticipated to last no longer than 20 minutes, concerning a legal matter pursuant to RCW 42. 30. 110( 1)( i)( c) with no announcement to follow. CITIZEN COMMENTS Sean Renfro, Everett, spoke about a police matter and the Police Department reporting process. Victor Harris, Everett, thanked the city for efforts in creating televised meetings with closed captioning and providing a standard PowerPoint for Council presentations. He reminded council members to speak loudly and clearly into the microphones. COUNCIL BREIFING AGENDA: Naval Station Everett' s nomination for a Joint Land Use Study Presented by Bob Bolerjack, Administration and Kernen Lien, Community Planning and Liaison Officer for Naval Station Everett Discussion ensued regarding the timing and potential outcomes of the study, other local jurisdiction involvement and Everett acting as lead agency, grant amount and cost, and potential overlap with the Shoreline Master Program. COUNCIL BILL 1801- 02 FIRST READING: AN ORDINANCE creating a Special Improvement Project entitled, Phil Johnson Ballfields Renovation," Fund 354, Program 054, to accumulate all costs for the improvement project Presented by Bob Leonard, Parks 26  January 17, 2018 Authorize purchase of an Aerial Ladder Truck from Pierce Manufacturing through Hughes Fire Equipment, Inc., utilizing contract VH11574, in the amount of $ 1, 243, 057. 20, including Washington State sales tax Presented by Theresa Bauccio- Teschlog, Purchasing COUNCIL BILL 1801- 03: FIRST READING: AN ORDINANCE Relating to For- Hire Vehicles, amending Ordinance No. 3553- 17 ( chapter 5. 68 EMC) Presented by Katie Rathbun, Legal Caleb Weaver, Uber, spoke about the number of moving violations in the proposed ordinance. Council Member Murphy questioned the number of moving violations in the current proposed ordinance versus the number that Uber proposed. President Roberts requested that Legal work with Police to review the proposed ordinance. Ms. Rathbun stated she would follow up. CONSENT ITEMS: Moved by Council Member Murphy, seconded by Council Member Bader, to approve the following consent items: RESOLUTION - CLAIMS To adopt Resolution No. 7207 acknowledging the payment of audited and approved claims against the City of Everett in the amount of 1, 449, 680. 33 for the period of December 30, 2017, through January 5, 2018. 27  January 17, 2018 RESOLUTION — ELECTRONIC TRANSFERS To adopt Resolution No. 7208 acknowledging payment of audited and approved electronic transfer claims against the City of Everett in the amount of $ 8, 968, 822. 06 for the period of October 1, 2017, through October 31, 2017. ACTION ITEMS: AGREEMENT — COMMERCIAL USE PERMIT/ TEMPORARY VENDOR PERMIT AND APPLICATION Moved by Council Member Bader, seconded by Council Member Tuohy, to authorize the Mayor to sign the Washington State Parks and Recreation Commission Commercial Use Permit/ Temporary Vendor Permit and Application. RESOLUTION — PROHIBITED AREAS OF PROSTITUION Moved by Council Member Bader, seconded by Council Member Tuohy, to adopt Resolution No. 7209 establishing prohibited areas related to areas of prostitution. 28  January 17, 2018 Roll was called with all council members voting yes, except Council Member Stonecipher who was excused. MEMORANDUM OF UNDERSTANDING - DUI RELATED POLICE TRAINING Moved by Council Member Murphy, seconded by Council Member Tuohy, to authorize the Mayor to sign the Memorandum of Understanding with Snohomish County for Driving Under the Influence ( DUI) related police training. Roll was called with all council members voting yes, except Council Member Stonecipher who was excused. Motion carried. MEMORANDUM OF UNDERSTANDING — PEDESTRIAN SAFETY CAMPAIGN Moved by Council Member Bader, seconded by Council Member McNeal, to authorize the Mayor to sign the Memorandum of Understanding with Snohomish County for a pedestrian safety campaign. Roll was called with all council members voting yes, except Council Member Stonecipher who was excused. Motion carried. COUNCIL BILL 1801- 01: THIRD AND FINAL READING: AN ORDINANCE closing a Special Improvement Project entitled, Pigeon Creek / Burlington Northern Santa Fe Pedestrian 29  January 17, 2018 Overcrossing," Fund 303, Program 080, as established by Ordinance No. 3081- 08 Moved by Council Member Tuohy, seconded by Council Member Murphy, that this is declared to be the third and final reading of Council Bill No. 1801- 01, and the city clerk was directed to call the role for the final disposition of the ordinance. AGREEMENT — EMERGENCY MANAGEMENT OPERATIONS Moved by Council Member Tuohy, seconded by Council Member McNeal, to authorize the Mayor to sign Grant Agreement E18- 069 with the Washington State Military Department to receive funding for emergency management operations in the amount of$ 61, 498.
