February 28, 2018 The regular meeting of the Everett City Council was called to order at 12: 30 p. m., February 28, 2018, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Roberts presiding. Upon roll call, it was found that Mayor Franklin and Council Members Roberts, Moore, Murphy, McNeal, Bader, and Tuohy were present. Council Member Stonecipher was excused. Council Member Murphy led the Pledge of Allegiance. The minutes of the February 21, 2018, City Council meeting were approved as printed. The minutes of the February 21, 2018, City Council retreat were approved as printed. MAYOR Mayor Franklin had no comments. COUNCIL Council Member McNeal reported on her attendance at the Silver Lake Neighborhood meeting last night. Council Member Murphy provided a liaison report on his attendance last week at the monthly Public Facilities District ( PFD) Board meeting. President Roberts reported on his attendance at the Sound Transit North Corridor meeting. He stated he would like to add this topic as a future briefing item. President Roberts announced a discussion regarding districting will be held next week as part of the Council briefing agenda. ADMINISTRATION UPDATE ON PRIOR BUSINESS David Hall, Legal, provided comments relating to questions raised by council members at last week' s public hearing regarding proposed 78  February 28, 2018 ordinance ( Council Bill 1802- 07) amending the zoning code definition of Clinic" and repealing Sections 2, 4, and 5 of Ordinance No. 2708- 03. Deputy City Attorney Hall stated that in response to concerns, a revised ordinance was emailed to council members that would 1) bring the zoning code into compliance with existing law by eliminating all references to opiate substitution treatment facilities, and 2) prohibit any new clinic in the B- 3 Zone, with the understanding that this measure would be provisional to allow Council time to consider input from the public and allow staff to develop the requested information. Council Member Moore suggested a sunset date be added to the proposed ordinance. President Roberts stated the intent of the amendment is to allow for a thoughtful discussion on both B- 3 and the Metro Plan and to make a decision at the end of that process to bring codes into alignment with federal law. He stated he would ask staff to make changes to the draft and bring that forward for action next week. CITY ATTORNEY City Attorney Iles had no comments. CITIZEN COMMENTS Annie Lyman, Everett, spoke about the benefits of Street Yoga Training for the youth task force and police department. She stated the training will be held April 20- 22, 2018, at the Ryther Center in Seattle. Helene Mulema Tulu, Everett High School, spoke about the importance of student participation in community events and attendance at City Council meetings. Sharita Burton, Everett, spoke about the significance of celebrating Black History Month. 79  February 28, 2018 COUNCIL BRIEFING AGENDA: Adopt Resolution adopting the Everett Hazard Mitigation Plan Presented by Brent Stainer, Fire Division Chief Stainer stated the Hazard Mitigation Plan Executive Summary, which was provided in the Council agenda packet, was updated to change the year from 2017 to 2018 to reflect the date of adoption. Council Member Tuohy requested staff provide annual updates to review progress. President Roberts stated it would be helpful to understand the cost associated with each item as we go forward. Division Chief Stainer stated staff would be happy to provide annual updates. He also stated he will work toward getting numbers and providing this information to Council. Everett Transit Long Range Draft Plan Presented by Sabina Popa, Transit, and Aaron Gooze, Fehr & Peers Sharita Burton, Everett, spoke about the need for transit service outside of what is provided in the plan, such as service to Delta Neighborhood. Victor Harris, Everett, spoke about the growing housing market in Everett and the impact of service reduction to the economic independence of low- income and disabled citizens. PROPOSED ACTION ITEMS: COUNCIL BILL 1802- 12 SECOND READING: AN ORDINANCE creating a Special Construction Fund entitled Everett Performing Arts Building Chiller Replacement and Cooling 80  February 28, 2018 Tower Rebuild Project," Fund 342, Program 024, to accumulate all costs for the construction project and repealing Ordinance 3575- 17 CONSENT ITEMS: Moved by Council Member Tuohy, seconded by Council Member Moore, to approve the following consent items: RESOLUTION - CLAIMS To adopt Resolution No. 7222 acknowledging the payment of audited and approved claims against the City of Everett in the amount of 1, 790, 864. 82 for the period of February 10, 2018, through February 16, 2018. BID CALL — ANNUAL SUPPLY OF GRAVEL To authorize Bid Call 2018- 003 for annual supply of gravel. BID CALL — INTERSECTION SAFETY PROJECT To authorize Call for bids for Everett Mall Way - 4th Avenue to East Mall Drive Intersection Safety Project. ACTION ITEMS: AGREEMENT AMENDED — EVERETT TRANSIT LONG RANGE PLAN Moved by Council Member Bader, seconded by Council Member McNeal, to authorize the Mayor to sign Amendment No. 1 to the Professional Services Agreement with Fehr & Peers for the 81  February 28, 2018 development of the Everett Transit Long Range Plan at no additional cost. Roll was called with all council members voting yes, except Council Member Stonecipher who was excused. Motion carried. RESOLUTION — REGIONAL FARE SUMMARY REPORT FINDINGS Moved by Council Member Bader, seconded by Council Member Moore, to adopt Resolution No. 7223 adopting the findings of the Regional Fare Summary Report. Roll was called with all council members voting yes, except Council Member Stonecipher who was excused. Motion carried. AGREEMENT — BROADWAY TRANSIT CORRIDOR PROJECT DESIGN Concur with the recommendation of the Cultural Arts Commission and authorize the Mayor to sign the Professional Services Agreement with Brian Borrello for Broadway Transit Corridor Project for aesthetic design enhancements in the amount of $ 50, 000. RESOLUTION — RECOVERY OF ABATEMENT COSTS Adopt Resolution authorizing recovery of abatement costs pursuant to Everett Municipal Code 1. 20. 090 at 1222 Lombard Avenue.
