May 1, 2019 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., May 1, 2019, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Bader presiding. Upon roll call, it was found that Mayor Franklin and Council Members Roberts, Moore, Murphy, Vogeli, Bader, Stonecipher, and Tuohy were present. Council Member Stonecipher led the Pledge of Allegiance. The minutes of the April 24, 2019, City Council meeting were approved as printed. MAYOR Mayor Franklin announced that there are nearly 40 applicants for the Districting Commission and would provide those to Council for review. Mayor Franklin invited Police Chief Templeman to introduce new police officers. OATH - POLICE OFFICERS Moved by Council Member Murphy, seconded by Council Member Tuohy, to concur with the appointments of Margret Ingimarsdottir, Daniel Rocha, Chad House, and Joshua Gottas as new police officers. Roll was called with all council members voting yes. Motion carried. The Deputy City Clerk administered the Oath of Office, and Mayor Franklin presented the officers with their badges. COUNCIL Council Member Murphy provided an update from the Budget Subcommittee meeting held earlier this evening. 129  111 May 1, 2019 Council Member Roberts commented on his attendance at the Arboretum' s Spring Open House on Saturday. He also provided a liaison report from the Evergreen Neighborhood meeting. Council Member Roberts commented on the next steps for the Climate Action Plan. Council Member Tuohy announced that the 2019 William F. Brown Awards are scheduled for Saturday, May 4, at 10: 30 a. m. at Everett Station. Council Member Stonecipher announced that there is no Public Safety Subcommittee meeting scheduled in May. President Bader echoed Council Member Tuohy' s comments regarding the William F. Brown Awards. ADMINISTRATION UPDATE ON PRIOR BUSINESS Lyle Ryan, Administration, had no report. CITY ATTORNEY City Attorney Iles had no comments. CITIZEN COMMENTS Ben Young, Everett, spoke about gang related intervention and justice. Sharita Burton, Everett, spoke about juvenile gang justice. COUNCIL BREIFING AGENDA: COUNCIL BILL 1904- 22 FIRST READING: 130  May 1, 2019 AN ORDINANCE amending Ordinance No. 3589- 18, entitled Phil Johnson Ballfields Renovation," Fund 354, Program 054, to accumulate the design and construction costs for the project Presented by Bob Leonard, Parks COUNCIL BILL 1904- 23 FIRST READING: AN ORDINANCE relating to Limited Commission Officers, amending Ordinance No. 284- 74 Presented by Chief Dan Templeman, Police Discussion ensued regarding diversity in the Police force and in the general workforce, diversity and bias training, and authority by other officers, including Animal Control, Code Enforcement, and Park Rangers. COUNCIL BILL 1904- 24 FIRST READING: AN ORDINANCE amending the critical areas regulations in the Zoning Code to apply city- wide, including areas within jurisdiction of the Shoreline Master Program and Local Project Review Procedures, amending Ordinance Nos. 1671- 89, 2909- 06, and 2530- 01, as amended Presented by David Tyler, Planning CONSENT ITEMS: Moved by Council Member Roberts, seconded by Council Member Murphy, to approve the following consent items: 131  May 1, 2019 RESOLUTION- CLAIMS To adopt Resolution No. 7365 authorizing claims against the City of Everett in the amount of$ 2, 181, 553. 63 for the period of April 13, 2019, through April 19, 2019. RESOLUTION — ELECTRONIC TRANSFER CLAIMS To adopt Resolution No. 7366 authorizing claims made by electronic transfer against the City of Everett in the amount of $6, 898, 974. 51 for the period of February 1, 2019, through February 28, 2019. PURCHASE — ELECTRICAL CIRCUIT BREAKERS To authorize the purchase of breakers from Platt Electric in the amount of$ 133, 835. 20 including Washington State sales tax. AGREEMENT — VESSEL REGISTRATION FEE To authorize the Mayor to sign the Distribution of Vessel Registration Fee Agreement with Snohomish County for 2019 and subsequent years. PUBLIC HEARING — RIVERFRONT DEVELOPMENT President Bader opened a public hearing regarding the Riverfront Development and read the proposed ordinances and agreement. He stated there were a few revisions to Council Bill 1904- 20 outlined in a staff memo to Council on April 29. Copies were made available to the public at the meeting. President Bader stated that portions of this public hearing constitutes a quasi- judicial matter and asked if any council member had any reason not 132  May 1, 2019 to participate in the proceedings to please state so for the record. No council member responded Dan Eernissee, Economic Development; Allan Giffen, Planning; and Tim Benedict, Legal, provided an overview of the proposed ordinances and agreement. Discussion ensued regarding the phased approach to construction, revenue from construction and future retail areas, materials being used for construction, the Multi- Family Tax Exemption, and how the design differs from the original proposed development. Chester Craig, Everett, spoke in opposition to the development due to increased traffic and water usage, and overpopulation of schools. Katrina Lindahl, Everett, spoke in favor of the development and urged the developers to allow adequate access to the Snohomish River. Moved by Council Member Roberts, seconded by Council Member Moore, to close the public hearing. Roll was called with all council members voting yes. Motion carried. Council members discussed parking, access to businesses, access to the Snohomish River, traffic impacts, fulfilling the public wishes for the development, and Shelter Holdings ability to meet the deadlines of the proposed phases of development. Eric Evans, Shelter Holdings, provided an overview of parking and access to the river. Janice Green, Everett, spoke about property taxes and incorporating affordable housing. Mr. Giffen and Mr. Eernissee explained more about the Multi- Family Tax Exemption and property values to address Ms. Green' s comments. 133  May 1, 2019 Council Members thanked staff and Shelter Holdings for their work on the two proposed ordinances and the proposed agreement. COUNCIL BILL 1904- 20 THIRD AND FINAL READING: AN ORDINANCE amending the Development Agreement for the Everett Riverfront District Properties related to the Landfill Site, amending Section 1 of Ordinance No. 3121- 09 Moved by Council Member Moore, seconded by Council Member Murphy, that this is the declared to be the third and final reading of Council Bill No. 1904-20, and the City Clerk was directed to call the roll for the final disposition of the ordinance, as amended to include revisions from a staff memo provided to council on April 29. ACTION ITEMS: RESOLUTION — PLAT OF RIVERDALE ADDITION Moved by Council Member Roberts, seconded by Council Member Moore, to adopt Resolution No. 7367 accepting the petition and setting May 29, 2019, at 6: 30 p. m., as the date and time of the public hearing for the proposed vacation of the east-west alleyway within Block 316, Plat of Riverdale Addition. AGREEMENT — MAPLE HEIGHTS SEISMIC RETROFIT PROJECT Moved by Council Member Stonecipher, seconded by Council Member Tuohy, to authorize the Mayor to sign the Local Agency Agreement with TranTech Engineering, Inc. for the design of the Maple Heights Seismic Retrofit Project in the amount of$ 267, 925.
