May 29, 2019 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., May 29, 2019, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Bader presiding. Upon roll call, it was found that Mayor Franklin and Council Members Roberts, Moore, Murphy, Vogeli, Bader, and Tuohy were present. Council Member Stonecipher was expected to be late. Council Member Roberts led the Pledge of Allegiance. The minutes of the May 22, 2019, City Council meeting were approved as printed. MAYOR Mayor Franklin had no comments. COUNCIL Council Member Murphy provided a liaison report for the Cascade View- Twin Creeks Neighborhood meeting last week. He also reported on his attendance at the Snohomish County Tomorrow meeting. Council Member Murphy stated the next Budget Subcommittee meeting is scheduled for June 5 at 5: 30 p. m. in council chambers. Council Member Vogeli stated she has heard concerns regarding the noise ordinance and rules governing loud vehicles and area noise. She also stated that second graders from Immaculate Conception School toured council chambers this afternoon for a civics lesson. Council Member Roberts stated the next General Government Subcommittee meeting is scheduled for June 19 at 5: 15 p. m. in council chambers. Council Member Tuohy provided a liaison report from the Silver Lake Neighborhood meeting. 162  May 29, 2019 ADMINISTRATION UPDATE ON PRIOR BUSINESS Lyle Ryan, Administration, had no report. CITY ATTORNEY City Attorney Iles had no comments. CITIZEN COMMENTS Jim Staniford, Everett, spoke about the safety and rules of the Lime e- scooter rental pilot program. Discussion ensued regarding availability of helmets, enforcement, and Lime' s schedule to put scooters back in their intended location. Charles Adkins, Everett, spoke about the Kimberly Clark site. Paula Townsell, Everett, spoke about the crowd in front of Pregnancy Aid. COUNCIL BREIFING AGENDA: Sound Transit Link Construction Presented by Peter Rogoff and Kamuron Gurol, Sound Transit Discussion ensued regarding the extension timeline, expansions to West Seattle and Ballard and the environmental studies required for those expansions, third party funding for future projects, an increase in Sounder Train schedules, parking access, and the future expansion into Everett. Ryan Weber, Everett, spoke about the representation on the Sound Transit Board. Peter Rogoff, Sound Transit, stated that the Board composition must be reconstituted in the year following the federal census and is required by RCW. 163  May 29, 2019 Authorize the Mayor to execute the Funding Agreement with Catholic Community Services for Residential Counselor Services at St. Clare' s Place Supportive Housing Presented by Julie Frauenholtz and Becky McCrary, Community Development; and Sarah Jayne Barrett, Catholic Community Services Discussion ensued regarding the budget for 2019 and future costs. Adopt Resolution amending the Development Agreement for the Port of Everett Waterfront Place Central Planned Development Overlay Zone, amending Resolution No. 5382 as amended Presented by Allan Giffen, Planning Adopt Resolution establishing Prohibited Areas related to areas of drug trafficking Presented by Lacey Offutt, Prosecutor' s Office Ryan Weber, Everett, spoke about prohibited areas around storage unit facilities. PUBLIC HEARING — RIVERDALE ADDITION President Bader opened the first of two public hearings regarding the proposed vacation of the east- west alleyway within Block 316, Plat of Riverdale Addition and direct staff to prepare an ordinance subject to the conditions as contained in the staff report, which will remain open until the conclusion of the second public hearing scheduled for June 5. Ryan Weber, Everett, spoke about the intended public benefit of the vacation. Council recessed at 7: 41 p. m. for a break and reconvened at 7: 47 p. m. Council Member Stonecipher entered council chambers at 7: 45 p. m. PUBLIC HEARING — COUNCIL BILL 1905- 26 President Bader opened a public hearing regarding the proposed ordinance amending the Shoreline Master Program and removing the Shoreline Land Use Element from the Comprehensive Plan, amending Ordinance Nos. 2600- 02 and 2021- 94, as amended. Karen Stewart, Planning, stated that members of the Shoreline Advisory Committee and the Department of Ecology were in attendance. AGREEMENT - BODY- WORN CAMERA POLICY AND IMPLEMENTATION PROGRAM GRANT Authorize the Mayor to sign all necessary documents and Agreements with the Department of Justice, Bureau of Justice Assistance regarding the application, utilization and acceptance of the FY 2019 Body- Worn Camera Policy and Implementation Program grant in the amount of$ 153, 004. Moved by Council Member Moore, seconded by Council Member Stonecipher, to find that reasonable geographic representation among the nominees exists and that these nominees are appointed to the Districting Commission. Discussion followed regarding geographic diversity of nominees, socioeconomic diversity of regions, and the selection process for the Districting Commission' s appointment of the ninth Commissioner. Mayor Franklin requested to change her nomination to provide greater geographic diversity by withdrawing her nomination of Nathan Shelby and selecting Benjamin Young, Valley View Neighborhood. Council Members concurred with her request and the motion was amended. Districting Commission Appointment of Ethel McNeal, Simone Tarver, Mary Fosse, Chris Geray, John Monroe, Kari Quaas, Benjamin Young, and James Langus to the Districting Commission.
