June 5, 2019 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., June 5, 2019, in the City Council Chambers of the William E. Moore Historic City Hall, Council Vice President Tuohy presiding. Upon roll call, it was found that Mayor Franklin and Council Members Murphy, Vogeli, Stonecipher, and Tuohy were present. Council Members Roberts, Moore, and Bader were excused. Council Member Murphy led the Pledge of Allegiance. The minutes of the May 29, 2019, City Council meeting were approved as printed. MAYOR Mayor Franklin had no comments. COUNCIL Council Member Murphy provided an update from the Budget Subcommittee meeting held earlier this evening. Council Member Vogeli provided a liaison report from the Westmont- Holly Neighborhood meeting. Council Member Stonecipher commented on her attendance at a special meeting held by the Port Garner Neighborhood regarding Housing Hope. She also stated she visited the Farmer' s Market outside of Everett Station today. Council Member Stonecipher announced that the next Public Safety Subcommittee meeting is scheduled for June 12, at 5: 15 p. m., in council chambers. ADMINISTRATION UPDATE ON PRIOR BUSINESS Lyle Ryan, Administration, had no report. 173  s June 5, 2019 CITY ATTORNEY City Attorney Iles had no comments. CITIZEN COMMENTS Mark Nysether, Everett, spoke about illegal parking, dumping, and camping in the public right- of-way around the Everett Station. Mayor Franklin invited Chief Dan Templeman, Police, to discuss the current enforcement of parking issues. Considerable discussion ensued regarding vacancies in parking enforcement, issuance of tickets, and towing of vehicles. Council Member Murphy inquired about the use of citizen volunteers to assist with parking enforcement. Chief Templeman stated that the Police Department would look into that suggestion. CONSENT ITEMS: Moved by Council Member Murphy, seconded by Council Member Vogeli, to approve the following consent items: RESOLUTION - CLAIMS To adopt Resolution No. 7381 acknowledging the payment of audited and approved claims against the City of Everett in the amount of$ 4, 895, 237. 30 for the period of May 18, 2019, through May 24, 2019. 174  June 5, 2019 Roll was called with all council members voting yes, except Council Members Roberts, Moore, and Bader, who were excused. Motion carried. PUBLIC HEARING— COUNCIL BILL 1905- 30: David Tyler, Planning, provided a brief overview of the changes made to the proposed ordinance. Vice President Tuohy opened a public hearing regarding Council Bill 1905- 30, a proposed ordinance concerning Sign standards, repealing and amending ordinances in accordance with Sections 1 and 2. There were no citizens who wished to speak. Moved by Council Member Murphy, seconded by Council Member Stonecipher, to close the public hearing. COUNCIL BILL 1905- 30 THIRD AND FINAL READING: AN ORDINANCE concerning Sign standards, repealing and amending ordinances in accordance with Sections 1 and 2, as amended Moved by Council Member Stonecipher, seconded by Council Member Vogeli, that this is the declared to be the third and final reading of Council Bill No. 1905- 30, and the City Clerk was directed to call the roll for the final disposition of the 175  June 5, 2019 ordinance. PUBLIC HEARING — WATERFRONT PLACE CENTRAL PLANNED DEVELOPMENT OVERLAY ZONE: Vice President Tuohy stated that portions of this public hearing constitute a quasi- judicial matter and asked if any council member had any reason not to participate in the proceedings to please state so for the record. No council member responded. Vice President Tuohy opened a public hearing regarding a proposed Resolution amending the Development Agreement for the Port of Everett Waterfront Place Central Planned Development Overlay Zone, amending Resolution No. 5382 as amended. Laura Gurley, Port of Everett, thanked staff for their hard work on the waterfront development. Moved by Council Member Murphy, seconded by Council Member Vogeli, to close the public hearing. Motion carried. 177  June 5, 2019 RESOLUTION - WATERFRONT PLACE CENTRAL PLANNED DEVELOPMENT OVERLAY ZONE Moved by Council Member Murphy, seconded by Council Member Stonecipher, to adopt Resolution No. 7382 amending the Development Agreement for the Port of Everett Waterfront Place Central Planned Development Overlay Zone, amending Resolution No. 5382 as amended. Roll was called with all council members voting yes, except Council Members Roberts, Moore, and Bader, who were excused. Motion carried. PUBLIC HEARING— RIVERDALE ADDITION: Darcie Byrd, Real Property, provided an overview of the proposed vacation. Vice President Tuohy opened the second public hearing regarding the proposed vacation of the east- west alleyway within Block 316, Plat of Riverdale Addition and direct staff to prepare an ordinance subject to the conditions as contained in the staff report. There were no citizens who wished to speak. Moved by Council Member Stonecipher, seconded by Council Member Murphy, to close the public hearing. Council Member Vogeli inquired about the usage of the funds from the vacation. 178  June 5, 2019 Paul Kaftanski, Administration, stated that vacation funds and sidewalks in the Delta Neighborhood will be discussed at the Government Subcommittee meeting scheduled for June 19. VACATION — RIVERDALE ADDITION Moved by Council Member Murphy, seconded by Council Member Vogeli, to approve the Proposed Vacation of the east- west alleyway within Block 316, Plat of Riverdale Addition and direct staff to prepare an ordinance subject to the conditions as contained in the staff report. Roll was called with all council members voting yes, except Council Members Roberts, Moore, and Bader, who were excused. Motion carried. ACTION ITEMS: AGREEMENT— RESIDENTIAL COUNSELOR SERVICES Julie Frauenholtz, Community Development, provided an update regarding a new program manager on site at St. Clare' s Place. Moved by Council Member Vogeli, seconded by Council Member Murphy, to authorize the Mayor to execute the Funding Agreement with Catholic Community Services for Residential Counselor Services at St. Clare' s Place Supportive Housing. Motion carried. 179  June 5, 2019 RESOLUTION — PROHIBITED AREAS Moved by Council Member Stonecipher, seconded by Council Member Murphy, to adopt Resolution No. 7383 establishing Prohibited Areas related to areas of drug trafficking. CONTRACT AWARD— 2019 BIOSOLIDS REMOVAL PROJECT Moved by Council Member Stonecipher, seconded by Council Member Murphy, to award contract for 2019 Biosolids Removal Project to American Process Group, Inc., in the amount of$ 611, 408. 12, including Washington State sales tax. Roll was called with all council members voting yes, except Council Members Roberts, Moore, and Bader, who were excused. Motion carried. AGREEMENT— NEAR- SITE CLINIC SERVICES Lyle Ryan introduced Marci Hammer, Human Resources; Susy Haugen, Finance; and Tim Benedict, Legal, to provide an overview of the health plan and the near- site clinic. Barry Chrisman, Everett, inquired about the impact of the charges based on participants. Discussion ensued regarding the contract, reimbursable costs, operations of the clinic, and protecting HIPPA information. 180  June 5, 2019 Moved by Council Member Vogeli, seconded by Council Member Murphy, to authorize the Mayor to sign the Administrative Service Agreement with Vera Whole Health for near- site clinic services.
