July 31, 2019 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., July 31, 2019, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Bader presiding. Upon roll call, it was found that Mayor Franklin and Council Members Roberts, Murphy, Vogeli, Bader, Stonecipher, and Tuohy were present. Council Member Moore was excused. Ella, Everett, led the Pledge of Allegiance. The minutes of the July 24, 2019, City Council meeting were approved as printed. MAYOR Mayor Franklin had no comments. COUNCIL Council Member Murphy provided a liaison report from his attendance at the meeting of the Public Facilities District Board ( PFD). He also commented about problems with crosswalks and sidewalk connections elicited during a walkabout of the Delta Neighborhood, and he stated he would work with city staff. Council Member Murphy announced the Budget Subcommittee is scheduled to meet on Wednesday, August 7, at 5: 30 p. m. in the council chambers. Council Member Vogeli commented on her attendance at the Alliance for Housing Affordability commission meeting and stated that she was recently appointed to the Alliance for Housing Affordability Joint Policy Board. Council Member Roberts thanked Council Member Murphy for his observations in the Delta Neighborhood and stated he felt there were opportunities for improvement in that area. He also announced the General Government Subcommittee would tentatively meet on August 14 or August 21. Council Member Stonecipher announced that the Public Safety Subcommittee is currently scheduled to meet on August 14. 226  July 31, 2019 President Bader reported he and Council Member Vogeli attended the VISION 2050 Puget Sound Regional Council Open House on Monday, and requested Administration coordinate a Council briefing with PSRC. President Bader provided a reminder that National Night Out is next Tuesday, August 6. He also noted that a sidewalk map is available on the City website. President Bader announced that Consent Item # 10 had been moved to the Action agenda. ADMINISTRATION UPDATE ON PRIOR BUSINESS Chief of Staff Lyle Ryan had no comments. CITY ATTORNEY City Attorney David Hall had no comments. CITIZEN COMMENTS Pamela Hanes, Everett, extended an invitation to the Shakespeare in the Park event hosted by the Delta Neighborhood Association. Victor Harris, Everett, spoke about traffic around the Delta Neighborhood and excessive speeds on 16th Avenue. COUNCIL BRIEFING AGENDA: Port Presentation Update. Presented by Les Reardanz, Port of Everett Mayor Franklin recognized Mr. Reardanz' for his contributions as Port CEO, and thanked him for his service and leadership to the City, community, and nation. She also congratulated him on his recent promotion to Naval Rear Admiral. 227  July 31, 2019 Council Member Stonecipher requested as copy of the recent job creation study that was commissioned by the Port. Mr. Reardanz stated a sanitized version of that report could be provided. William Parent Jr., Everett, spoke about the Port clean up and the need for additional transportation to services. Update of five retail cannabis establishments within the City with the intention of evaluating the economic benefits and social impact to the City. Presented by Lyle Ryan, Administration As a follow up to information requested at the July 24 Council meeting about the current five retail marijuana stores, Chief of Staff Ryan provided statistics on the average police calls per month from each shop, as well as detail on the various tax sources that provide revenue to the city. Council Member Murphy requested confirmation of the reason for the temporary closure of the marijuana retailer Kushmart. Police Chief Templeman stated they would seek additional information from the State Liquor and Cannabis Board. Chief Templeman spoke about the nature of the monthly police calls and confirmed that the majority of calls are property crime related. Council Member Stonecipher asked for information about the ability of the City to require retailers provide a medical marijuana component. She also asked city staff to conduct an analysis of the change in total sales experienced by other jurisdictions that have expanded the number of retail stores. Council Member Roberts also expressed concern about access to medical marijuana and the City' s ability to require this component. Moved by Council Member Vogeli to amend the current ordinance to allow an increase in the number of marijuana retail stores to 10. 228  July 31, 2019 President Bader suggested referral of this item to Public Safety Subcommittee if there is no second to the motion. The motion died for lack of a second. Council Member Vogeli withdrew the motion. Discussion ensued regarding the need for more information from the Liquor and Cannabis Board; what requirements are allowable for medical marijuana; obtaining harder information on revenue throughout the state; a review of available maps, restrictions and setbacks; and any additional information that may be available about police calls. Mayor Franklin stated City staff would be available to address questions unrelated to public safety. Adopt Resolution concerning the delegation of the establishment and modification of public parking rates at the Municipal EVERPARK Garage, repealing Resolution No. 4562 as amended. Presented by Paul Kaftansi, Administration Discussion took place regarding Council notification of quarterly rate adjustment reviews. Mr. Kaftanski stated that Council would be notified. PROPOSED ACTION ITEMS: COUNCIL BILL 1907- 34 SECOND READING: AN ORDINANCE relating to Mobile Food Unit Licensing, repealing Chapter 21 of Ordinance No. 295- 74, as amended ( Chapter 5. 84 EMC) and amending Chapter 9 of Ordinance No. 295- 74, as amended ( Chapter 5. 36 EMC) 229  July 31, 2019 Council Member Murphy expressed concern about the potential impact on the Public Facilities District and the need for potential modifications to protect the PFD. Dan Eernissee, Economic Development, provided information on possible no- congestion zone alternatives to the area protection zone. Discussion took place regarding penalties for street permit violations, administrative process to assist food truck operators with the arena event schedule, parking concerns, and regulation of the number of food trucks, and the need for regular updates to Council. CONSENT ITEMS: Moved by Council Member Roberts, seconded by Council Member Stonecipher, to approve the following consent items: RESOLUTION — CLAIMS To adopt Resolution No. 7404 acknowledging the payment of audited and approved claims against the City of Everett in the amount of $ 1, 597, 871. 81 for the period of July 13, 2019, through July 19, 2019. PURCHASE — LIBRARY FURNITURE To authorize the purchase of library furniture from Saxton Bradley in the amount of$ 115, 656. 73, including Washington State sales tax. PURCHASE— 2018 1000G PAVER To authorize the purchase of one 2018 1000G Paver from LeeBoy using Sourcewell Contract# 052417- VTL- EVT# 2019- 066 in the amount of$ 106, 135. 42, including Washington State sales tax. 230  July 31, 2019 RESOLUTION — PURCHASE OF ROTORK ACTUATORS AND GEARBOXES To adopt Resolution No. 7405 waiving public bidding requirements and approving multiple year sole- source purchase of Rotork Actuators and Gearboxes from Beaver Equipment, Inc. RESOLUTION — SURPLUS/ AGILENT ICP- MS To adopt Resolution No. 7406 declaring Agilent ICP- MS 7500ce surplus and authorizing sale at public auction. Roll was called with all council members voting yes, except Council Member Moore who was excused. Motion carried. ACTION ITEMS: AGREEMENT— INTERLOCAL COOPERATIVE PURCHASING Council Member Murphy recused himself due to his current appointment to the PFD Board and left the council chambers at 8: 38 p. m. Moved by Council Member Tuohy, seconded by Council Member Stonecipher, to authorize the Mayor to sign the Interlocal Cooperative Purchasing Agreement with Everett Public Facilities District. Roll was called with all council members voting yes, except Council Member Moore who was excused and Council Member Murphy who was recused. Motion carried. Council Member Murphy returned to the council chambers at 8: 38 p. m. 231  July 31, 2019 COUNCIL BILL 1907- 33 THIRD AND FINAL READING: AN ORDINANCE Relating to Surface and Storm Drainage, amending Ordinance No. 3528- 16 ( Chapter 14. 28 EMC), as previously amended Moved by Council Member Roberts, seconded by Council Member Stonecipher, that this is declared to be the third and final reading of Council Bill No. 1907- 33. The City Clerk was directed to call the roll for the final disposition of the ordinance.
