July 24, 2019 The regular meeting of the Everett City Council was called to order at 12: 30 p. m., July 24, 2019, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Bader presiding. Upon roll call, it was found that Mayor Franklin and Council Members Roberts, Moore, Murphy, Vogeli, Bader, Stonecipher, and Moore were present. Council Member Moore led the Pledge of Allegiance. The minutes of the July 17, 2019, City Council meeting were approved as printed. Council Members Roberts and Bader abstained from the vote. MAYOR OATHS— POLICE OFFICERS Moved by Council Member Murphy, seconded by Council Member Tuohy, to concur with the appointments of Erich Slaybaugh and Shane Thrift as new police officers. Roll was called with all council members voting yes. Motion carried. The City Clerk administered the oath of office, and Mayor Franklin presented the officers with their badges. COUNCIL Council Member Murphy provided a liaison report on his attendance last evening at the Pinehurst- Beverly Park Neighborhood meeting. He also stated that in response to the recent moratorium, he encouraged city staff to contact Housing Hope and the developer to discuss the availability of the former K- Mart site as a possible site for a future supportive housing project. 219  July 24, 2019 Mayor Franklin stated she would follow up with Council. Council Member Vogeli reported on her attendance at the Historical Commission meeting last evening. Council Member Roberts announced that the Puget Sound Region Council ( PSRC) released the VISION 2050 draft plan on Monday. He reported on his attendance yesterday at the meeting of the Snohomish County Committee for Improved Transportation ( SCCIT). Council Member Tuohy thanked Council Member Murphy for his comments relating to Housing Hope. She also urged citizens to be patient during a busy construction time in downtown Everett. President Bader announced that PSRC is hosting an Everett VISION 2050 Open House on Monday, July 29, on the Snohomish County campus. He encouraged residents and business owners to attend. ADMINISTRATION UPDATE ON PRIOR BUSINESS Lyle Ryan, Administration, had no comments. CITY ATTORNEY City Attorney David Hall had no comments. CITIZEN COMMENTS Ed Rubatino, Rubatino Refuse Removal, provided information about an upcoming rate increase. Council Member Roberts requested a copy of the information that was submitted by Rubatino Refuse to the Washington Utilities and Transportation Commission. 220  July 24, 2019 Mr. Rubatino stated he would provide that information. At the request of Council Member Stonecipher, Mr. Rubatino also provided an update on the recycling portion of the business. Kurtis Hallquist, Everett, expressed concern about a future homeless camp at the Cascade View Presbyterian Church. Mayor Franklin stated she would ask Julie Frauenholtz, community development director, to provide a future update on the Cascade View Presbyterian Church safe parking pilot program, which is managed by Interfaith, a nonprofit organization. Judy Palm, Everett, spoke about the need for psychiatric and mental health preventative care in Everett. Jim Langus, Everett, spoke about gang violence and crime associated with homelessness and illegal drug use, and urged City Administration and Council to commit to making public safety Everett' s highest priority. Council Member Murphy expressed a desire to follow up with City Administration and the Police Department to learn more about the point system at Denney Youth Center, as well as convening a group of individuals from various organizations. Council Member Stonecipher asked for an update on the Safe Streets Initiative at the Public Safety Subcomittee meeting in September. Mayor Franklin stated she would be happy to provide an update to the Public Safety Subcommittee. Council Member Moore noted that in coordination with budget development timelines, it would be important to hear from Administration if enhancements in staffing or programs are required. 221  July 24, 2019 COUNCIL BREIFING AGENDA: Housing Strategy and Consolidated Plan Planning Process Update. Presented by Julie Frauenholtz and Rebecca McCrary, Community, Planning & Economic Development Julie Frauenholtz provided a brief update on the status of the Cascade View Presbyterian Church safe parking program. Council Member Stonecipher requested the partners in the safe parking program provide a briefing to Council. Rebecca McCrary presented a housing strategy update relating to housing in Everett. In response to strategies that Council could consider as next steps, suggestions included: ( 1) bring forward an ordinance or resolution to allow the City to access the tax provisions outlined in HB 1406, ( 2) retain a professional economist to perform an analysis on factors that exist in Everett and the Puget Sound region, and ( 3) look at different build types and alternative methods of construction. COUNCIL BILL 1907- 34 FIRST READING: AN ORDINANCE relating to Mobile Food Unit Licensing, repealing Chapter 21 of Ordinance No. 295- 74, as amended ( Chapter 5. 84 EMC) and amending Chapter 9 of Ordinance No. 295- 74, as amended ( Chapter 5. 36 EMC) Presented by Dan Eernissee, Economic Development Council Members Murphy and Moore expressed concern about the elimination of the protection zone around Angel of the Winds Arena and what options may be available. Katie Rathbun, Legal, stated she could look more closely at possible options. 222  July 24, 2019 Council Member Murphy inquired about provisions in the ordinance to address the impact of food trucks on the Business Improvement Area. Council Member Stonecipher asked for information about the required fees charged to food truck operators. Council Members Murphy and Moore left the council chambers at 2: 15 p. m. The following individuals expressed support of the food truck ordinance: Madison Miller, Everett Brock Howell, Everett Station District Alliance Dana Oliver, Downtown Everett Association Victor Harris, Everett PROPOSED ACTION ITEMS: COUNCIL BILL 1907- 33 SECOND READING: AN ORDINANCE revising the definition of Stormwater Management Manual to include the effective date for new revised versions CONSENT ITEMS: Moved by Council Member Stonecipher, seconded by Council Member Tuohy, to approve the following consent items: RESOLUTION — CLAIMS To adopt Resolution No. 7402 acknowledging the payment of audited and approved claims against the City of Everett in the amount of $1, 415, 186. 58 for the period of July 6, 2019, through July 12, 2019. 223  July 24, 2019 RESOLUTION — PAYROLL CLAIMS To adopt Resolution No. 7403 authorizing payroll claims against the City of Everett in the amount of$ 4, 997, 101. 64 for the period ending July 6, 2019. AGREEMENT— INTERLOCAL FOR SEX OFFENDER ADDRESS AND RESIDENCY VERIFICATION PROGRAM SERVICES To authorize the Mayor to sign the Interlocal Agreement with Snohomish County for Sex Offender Address and Residency Verification Program Services. PURCHASE — LIBRARY BOOK SHELVING To authorize purchase of Library book shelving from Demco, Inc. using Buyboard Contract # 584- 19/ EVT # 2019- 046 in the amount of $ 108, 889. 93, including Washington State sales tax. AGREEMENT— EVENTS CENTER SECURITY To authorize the Mayor to sign the Law Enforcement Services Agreement with Global Spectrum, L. P. for Events Center Security. ACTION ITEMS: BID CALL— EVERETT STATION PARKING EXTENSION Moved by Council Member Vogeli, seconded by Council Member Tuohy, to authorize the Call for Bids for the Everett Station Parking Extension. 224  July 24, 2019 Roll was called with all council members voting yes, except Council Members Moore and Murphy who were excused. BID AWARD — DIVERSION DAM ROAD PHASE 3 ROAD RECONSTRUCTION AND HAYBECKER CREEK CULVERT REPLACEMENT Moved by Council Member Roberts, seconded by Council Member Tuohy, to reject the bid from Ponderosa Pacific, Inc. as not responsible and award the construction contract for the Diversion Dam Road Phase 3 Road Reconstruction and Haybecker Creek Culvert Replacement to Weber Construction, Inc. in the amount of$ 419, 958.
