July 17, 2019 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., July 17, 2019, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Bader presiding. Upon roll call, it was found that Mayor Franklin and Council Members Murphy, Vogeli, Bader, Stonecipher, and Tuohy were present. Council Members Roberts and Moore were excused. Mayor Franklin led the Pledge of Allegiance. The minutes of the July 10, 2019, City Council meeting were approved as printed. MAYOR APPOINTMENTS Moved by Council Member Tuohy, seconded by Council Member Vogeli, to concur with the following appointment: Everett Housing Authority Board Appointment of Koren Smith to Position 3, for the remainder of a five- year term ending December 31, 2020 Roll was called with all council members voting yes, except Council Members Roberts and Moore who were excused. Moved by Council Member Vogeli, seconded by Council Member Tuohy, to concur with the following appointments: Citizens Advisory Committee Appointment of Charles Adkins to Position 2, for the remainder of a six- year term ending December 31, 2020 210  July 17, 2019 Appointment of Kathy Lynott to Position 8, for the remainder of a six- year term ending December 31, 2021 Appointment of Ben Breeden to Position 10, for the remainder of a six- year term ending December 31, 2022 Roll was called with all council members voting yes, except Council Members Roberts and Moore who were excused. Motion carried. Mayor Franklin spoke about the formation of the Mayor' s Youth Advisory Board. COUNCIL Council Member Vogeli commented on children' s concerts at Thornton A. Sullivan Park. She spoke about a positive impact on a community around the new retail marijuana store and requested the full briefing regarding operation, revenue, and public safety concerns around all retail marijuana stores in Everett. Lyle Ryan, Administration, stated that the briefing will be provided in the next two weeks. Council Member Stonecipher provided a liaison report on her attendance at the Cultural Advisory Committee meeting at Denney Juvenile Justice Center. She also spoke about her meeting with Citlalli Zarate from the Delta Neighborhood. President Bader provided a liaison report on his attendance at the Puget Sound Regional Council ( PSRC) Growth Management Policy Board meeting. He also announced that the final draft of Vision 2050 Plan is open for public comment and the workshop and open house for Vision 2050 is scheduled on July 29 at the Everett Station. 211  July 17, 2019 ADMINISTRATION UPDATE ON PRIOR BUSINESS Lyle Ryan, Administration, provided an update on the Grand Avenue Park Bridge. CITY ATTORNEY City Attorney Hall requested a 15- minute executive session concerning a legal matter, pursuant to RCW 42. 30. 110 ( 1)( i)( 3), with no announcement to follow. CITIZEN COMMENTS Jim Langus, Everett, shared his personal perspective regarding law enforcement. COUNCIL BRIEFING AGENDA: SR 526 Corridor Improvement Project Presented by Ryan Sass, Public Works and Cathy George and Adam Emerson, WSDOT President Bader asked about local traffic impact data. Adam Emerson stated he will provide this information at a later date. Victor Harris, Everett, expressed his concern regarding a proposed use of shoulder option and a lack of space for driver emergencies. COUNCIL BILL 1907- 33 FIRST READING: AN ORDINANCE revising the definition of Stormwater Management Manual to include the effective date for new revised versions Presented by Ryan Sass, Public Works 212  July 17, 2019 CONSENT ITEMS: Moved by Council Member Murphy, seconded by Council Member Stonecipher, to approve the following consent items: RESOLUTION - CLAIMS To adopt Resolution No. 7398 acknowledging the payment of audited and approved claims against the City of Everett in the amount of $ 1, 417, 974. 04 for the period of June 29, 2019, through July 5, 2019. LEASE AGREEMENT— SENATOR MARIA CANTWELL To authorize the Mayor to execute the Lease Agreement with Senator Maria Cantwell for space at 2930 Wetmore Avenue. PUBLIC HEARING- COUNCIL BILL 1906- 32 AND RESOLUTION NO. 7399 ADOPTING 2019 SHORELINE PUBLIC ACCESS PLAN: President Bader opened the public hearing regarding a proposed Ordinance concerning the City' s Shoreline Public Access Plan, repealing Ordinance No. 2692- 03 adopting the 2003 Shoreline Public Access Plan and a proposed Resolution adopting the 2019 Shoreline Public Access Plan. Karen Stewart, Planning, provided a brief overview of the proposed ordinance and resolution, including proposed amendments regarding potential public access / viewpoint at the west- end of the former Kimberly Clark Waste Treatment facility. President Bader invited public comment. 213  July 17, 2019 Laura Gurley, Port of Everett, spoke in opposition to the proposed amendment to the 2019 Shoreline Public Access Plan. Moved by Council Member Murphy, seconded by Council Member Tuohy, to close the public hearing. Roll was called with all council members voting yes, except Council Members Roberts and Moore who were excused. Motion carried. COUNCIL BILL 1906- 32 THIRD AND FINAL READING: AN ORDINANCE concerning the City' s Shoreline Public Access Plan, repealing Ordinance No. 2692- 03 adopting the 2003 Shoreline Public Access Plan Discussion took place regarding potential public access, grant funding, rubble cleanup timeline, and the coordination with the Naval Station Everett for any potential project. Moved by Council Member Stonecipher, seconded by Council Member Vogeli to include the proposed amendment regarding public access piece. City Attorney David Hall clarified that the proposed ordinance doesn' t include the adoption of the 2019 Shoreline Public Access Plan and this amendment can be offered for the resolution. Council Member Stonecipher withdrew her motion. Moved by Council Member Murphy, seconded by Council Member Tuohy, that this is declared to be the third and final reading of Council Bill No. 1906- 32, and 214  July 17, 2019 the city clerk was directed to call the roll for the final disposition of the ordinance. RESOLUTION — 2019 SHORELINE PUBLIC ACCESS PLAN Moved by Council Member Murphy, seconded by Council Member Vogeli to adopt Resolution No. 7399 adopting the 2019 Shoreline Public Access Plan. Moved by Council Member Stonecipher, seconded by Council Member Vogeli to amend the proposed 2019 Shoreline Public Access Plan to include additional language regarding potential public access presented on the project summary sheet, entire table as revised, including the figures. Discussion took place regarding a need for coordination with Naval Station Everett for any potential future projects. Council Member Murphy stated that he cannot support the proposed amendment due to a concern regarding potential trail or viewpoint for public access raised by Naval Station Everett, Port of Everett, and Economic Alliance of the Snohomish County. Roll was called with all council members voting yes, except Council Member Murphy who voted no, and Council Members Roberts and Moore who were excused. ACTION ITEMS: AGREEMENT— SALE OF THE CITY—OWNED LIBRARY PARKING LOT Moved by Council Member Vogeli, seconded by Council Member Murphy, to authorize the Mayor to execute to Real Estate Purchase and Sale Agreement for sale of the City—owned Library Parking Lot to Williams Investments I, LLC. Council Member Stonecipher asked that sale proceeds be discussed at the next Budget Subcommittee meeting. Motion carried. 216  July 17, 2019 RESOLUTION — 2018 SUPPLEMENTAL II COMMUNITY DEVELOPMENT BLOCK GRANT AND HOME FUNDS Moved by Council Member Tuohy, seconded by Council Member Stonecipher, to adopt Resolution No. 7400 concerning 2018 Supplemental II Community Development Block Grant and HOME Funds reallocations and Annual Action Plan Amendment. Roll was called with all council members voting yes, except Council Members Roberts and Moore who were excused. Motion carried. RESOLUTION — " SWARTOUT HOUSE" LOCATED AT 3909 26TH STREET Moved by Council Member Tuohy, seconded by Council Member Vogeli, to adopt Resolution No. 7401 placing the " Swartout House," located at 3909 26th Street on the Everett Register of Historic Places. Roll was called with all council members voting yes, except Council Members Roberts and Moore who were excused. Motion carried.
