July 10, 2019 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., July 10, 2019, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Bader presiding. Upon roll call, it was found that Mayor Franklin and Council Members Roberts, Moore, Murphy, Vogeli, Bader, Stonecipher, and Tuohy were present. Council Member Murphy led the Pledge of Allegiance. The minutes of the July 3, 2019, City Council meeting were approved as printed. Council Members Moore and Stonecipher abstained from the vote. MAYOR Mayor Franklin had no comments. COUNCIL Council Member Murphy provided a liaison report from his attendance at the Public Facilities District Board meeting. Council Member Vogeli commented on the success of the July 4th parade. Council Member Roberts thanked volunteers for their work on the July 4th parade and fireworks. He also noted that minutes from the June 19' General Government Subcommittee meeting were provided to council members. Council Member Tuohy echoed comments on the success of the July 4th festivities, and she thanked volunteers and Parks and Arts Commission staff. Presidet Bader thanked the Everett Police Department for their fireworks enforcement efforts. He announced that due to the number of attendees, the Consent Agenda would be moved to follow public comments relating to items not on the agenda. He also announced that the Public Hearing relating to the moratorium would follow the Consent Agenda. 202  July 10, 2019 ADMINISTRATION UPDATE ON PRIOR BUSINESS Chief of Staff Lyle Ryan had no comments. CITY ATTORNEY City Attorney David Hall requested a 15- minute executive session concerning a legal matter pursuant to RCW 42. 30. 110( 1)( i)( iii), with no announcement to follow. CITIZEN COMMENTS Sonja Bodge, Everett, commented on traffic safety concerns for pedestrians in the Delta Neighborhood. CONSENT ITEMS: Moved by Council Member Murphy, seconded by Council Member Roberts, to approve the following consent items: RESOLUTION — CLAIMS To adopt Resolution No. 7395 acknowledging the payment of audited and approved claims against the City of Everett in the amount of $ 3, 725, 364. 29 for the period of June 15, 2019, through June 21, 2019. RESOLUTION — PAYROLL CLAIMS To adopt Resolution No. 7396 acknowledging the payment of audited and approved payroll claims against the City of Everett in the amount of 4, 231, 765. 41 for the period ending June 22, 2019. 203  July 10, 2019 AGREEMENT— EASEMENT FOR SHORING WALL TIEBACKS To authorize the Mayor to sign the Easement Agreement with Evergreen Way Holding LLC for shoring wall tiebacks within Glacier Lane right of way. AGREEMENT AMENDED — WORKFORCE TELESTAFF SCHEDULING SOFTWARE FOR FIRE DEPARTMENT To authorize the Mayor to sign Amendment No. 4 to the Sales, Software Licensing and Services Agreement with Kronos at an additional cost of 98, 041. 39. PUBLIC HEARING — ORDINANCE NO. 3686- 19 ESTABLISHING A MORATORIUM ON SUPPORTIVE HOUSING IN SINGLE- FAMILY RESIDENTIAL ZONES: Council Member Moore recused himself from any discussion on this item based upon his employment with Everett Public Schools. Council Member Moore left the council chambers at 6: 37 p. m. Allan Giffen, Planning, provided an overview of Ordinance No. 3686- 19, which was adopted as an emergency ordinance on June 12, 2019, as well as regulation prior to the adoption of the 2016 ordinance. He stated the purpose of the public hearing was to take public testimony, discuss alternatives to current regulations, identify issues for further review by the Planning Commission, and to provide instruction and/ or direction for the Planning Commission and City staff. Mr. Giffen also reviewed potential considerations and options before Council. Council Member Roberts requested staff provide additional information about other housing models. President Bader opened the public hearing, explained the purpose, and invited public testimony. 204  July 10, 2019 The following individuals urged the Council to repeal the emergency ordinance establishing a moratorium on supportive housing in single- family residential zones: Joseph Erickson, Everett Camille Harden, Everett Michelle Fessler, Snohomish County Democratic Socialists of America Hayden Jones, Snohomish County Democratic Socialists of America Christopher Andersson, Everett Raven Campbell, Everett Duane Leonard, Housing Authority of Snohomish County Earl Hall, Everett Fred Safstrom, Housing Hope Ashley Lommers- Johnson, Everett Housing Authority Mark Smith, Housing Consortium of Everett and Snohomish County Ed Peterson, Housing Hope Pam Kepford, Everett Carla Antonelli, Everett The following residents urged the Council to maintain the moratorium, and requested Council consider the protection of green space, distribution of supportive housing, pedestrian access, and the development of guidelines for a public process: Amy Frost, Everett Elizabeth Koenig, Everett James Ivory, Everett Greg Benson, Everett Molly Deardorff, Everett Andrea Tucker, Everett Cherie LaMaine, Everett Andrea Hubbard, Everett John Witters, Everett Sonja Bodge, Everett Ryan Webber, Everett 205  July 10, 2019 William Parent Jr., Everett, spoke about homelessness and the need for more jobs in Everett. Moved by Council Member Roberts, seconded by Council Member Stonecipher, to close the public hearing. Roll was called with all council members voting yes. Motion carried. President Bader announced the Council would take a five- minute break. The Council reconvened at 8: 28 p. m. President Bader suggested the Council consider the following: ( 1) Should the moratorium be continued and referred to the Planning Commission?, and if referred ( 2) Are there other concerns the Council would like the Planning Commission to consider regarding the current regulations? Considerable discussion ensued. Moved by Council Member Stonecipher, seconded by Council Member Roberts, to continue the moratorium and refer to the Planning Commission. Roll was called with all council members voting yes. Motion carried. President Bader enumerated the topics presented by Council for evaluation by the Planning Commission. Moved by Council Member Tuohy, seconded by Council Member Vogeli, to refer thefollowing topics to the Planning Commission for review: ( 1) types of assisted housing and management, ( 2) inclusion of supportive housing in single- family 206  July 10, 2019 zones, ( 3) public notice process, ( 4) parking standards, ( 5) sidewalks, ( 6) height and density issues ( 7) proximity to human and health services, ( 8) public process for challenging proposals, ( 9) impact on green space, ( 10) requiring developer to address impacts on neighborhoods, and ( 11) 500- foot transit limit. Roll was called with all council members voting yes. Motion carried. Council Member Moore returned to the council chambers at 8: 56 p. m. ACTION ITEMS: RESOLUTION — COMPENSATION FOR THE VACATION OF STREETS AND ALLEYS Paul Kaftanski, Administration, provided a brief presentation. Council Member Vogeli commented on the Delta Neighborhood' s need for full sidewalks in the red zone. Council Member Roberts stated discussion took place regarding city sidewalk projects at the General Government Subcommittee meeting on June 16, 2019. Ryan Webber, Everett, urged Council to consider adding part or all of the missing sidewalks around Jackson Park. Mary Fosse, Everett, spoke about safety and requested the Council consider the need for sidewalks around Jackson Park. Sonja Bodge, Everett, spoke about pedestrian safety in the Delta Neighborhood and the need for sidewalks. Brian Pardington, Everett, spoke about the lack of sidewalks in the Delta Neighborhood. 207  July 10, 2019 Moved by Council Member Moore, seconded by Council Member Vogeli, to adopt Resolution No. 7397 concerning compensation for the vacation of streets and alleys, amending Resolution No. 3147 as amended. Presented by Erika Frost, Public Works Pam Kepford, Everett, thanked the City for the " Bring Your Bag Everett" program. Housing Strategy and Consolidated Plan Planning Process Update. Item moved to July 24, 2019, meeting. Adopt Resolution concerning 2018 Supplemental II Community Development Block Grant and HOME Funds reallocations and Annual Action Plan Amendment. Rebecca McCrary, Community Development Mayor Franklin thanked staff for their work on the complex process of reallocating funds.
