November 27, 2019 The regular meeting of the Everett City Council was called to order at 12: 30 p. m., November 27, 2019, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Bader presiding. Upon roll call, it was found that Council Members Murphy, Bader, and Tuohy were present. Council Member Moore was expected to be late. Mayor Franklin and Council Members Roberts, Vogeli, and Stonecipher were excused. Council Member Moore entered Council Chambers at 12: 30 p. m. just after roll call. Council Vice President Tuohy led the Pledge of Allegiance. The minutes of the November 20, 2019, City Council meeting were approved as printed. MAYOR Mayor Franklin was excused. COUNCIL Council Member Murphy encouraged residents to shop locally for Small Business Saturday and wished everyone a Happy Thanksgiving. Council Member Moore also encouraged residents to shop locally for Small Business Saturday and wished everyone a Happy Thanksgiving. Council Vice President Tuohy wished everyone a Happy Thanksgiving. President Bader wished everyone a Happy Thanksgiving. He also provided a liaison report from the Transportation Advisory Committee. President Bader, in Mayor Franklin' s absence, asked for concurrence with an appointment to the Lodging Tax Advisory Committee. 355  A November 27, 2019 APPOINTMENTS Moved by Council Member Tuohy, seconded by Council Member Moore, to concur with the following appointment: Lodging Tax Advisory Committee Appointment of Kimberlee Valvick to Position 4 for the remainder of a four- year term expiring December 31, 2021. Roll was called with all council members voting yes, except Council Members Roberts, Vogeli, and Stonecipher who were excused. Motion carried. ADMINISTRATION UPDATE ON PRIOR BUSINESS A Chief of Staff Lyle Ryan had no report. CITY ATTORNEY City Attorney David Hall had no report. PUBLIC COMMENT Roy Holman, Everett, spoke about concerns regarding 5G technology and cell phone radiation. CONSENT ITEMS: Moved by Council Member Murphy, seconded by Council Member Moore, to approve the following consent items: A 356  November 27, 2019 RESOLUTION - CLAIMS To adopt Resolution No. 7453 authorizing claims against the City of Everett in the amount of $ 2, 826, 498. 31 for the period of November 9, 2019, through November 15, 2019. AGREEMENT AMENDED— JURY MANAGEMENT SERVICES To authorize the Mayor to sign Amendment No. 1 to the agreement with Snohomish County Superior Court for jury management services. AGREEMENT— COMMERCIAL USE PERMIT/ TEMPORARY VENDOR PERMIT To authorize the Mayor to sign the Washington State Parks & Recreation Commission Commercial Use Permit/ Temporary Vendor Permit & Application. AGREEMENT AMENDED— MANAGEMENT SERVICES AT EVERPARK GARAGE To authorize the Mayor to sign Amendment No. 1 to the Parking Management Agreement with the Downtown Everett Association for management services at EverPark Garage. AGREEMENT AMENDED— ENERGY SMART INDUSTRIAL— WASTEWATER ENERGY COACHING To authorize the Mayor to sign Amendment No. 3 to Miscellaneous Service Contract No. CW2228764, with Snohomish County PUD for Energy Smart Industrial- Wastewater Energy Coaching. AGREEMENT— STRUCTURAL REPAIRS AND VENTILATION IMPROVEMENTS To authorize the Mayor to sign the Professional Services Agreement with CG Engineering to design structural repairs and ventilation improvements at Reservoir# 3 in the amount not to exceed $ 146, 598. 357  November 27, 2019 Roll was called with all council members voting yes, except Council Members Roberts, Vogeli, and Stonecipher who were excused. ACTION ITEMS: AGREEMENT AMENDED— BASIC LIFE SUPPORT AMBULANCE SERVICES Moved by Council Member Moore, seconded by Council Member Tuohy to authorize the Mayor to sign Amendment No. 1 to the contract for Basic Life Support Ambulance Services between the City of Everett and NW Ambulance. Council Member Murphy stated he received an email from another ambulance service, American Medical Response, and wished to table this agreement to get more information on a potential public bid process. Considerable discussion ensued regarding the financial amendments to the contract, the time extension on the contract, and a public bid process. Mike Andrews and KC McCoy, of American Medical Response, encouraged Council to oppose the proposed agreement and encouraged a public bid process. Council Member Murphy asked if it was possible to terminate the current contract early. David Hall, City Attorney, stated he would get back to Council with that information. Moved by Council Member Murphy, seconded by Council Member Moore to table action on this agreement in order to consider a public bid process and for further discussion. RESOLUTION -- EVERETT STATION DISTRICT BIA PUBLIC HEARING Moved by Council Member Tuohy, seconded by Council Member Murphy, to adopt Resolution No. 7454, setting a public hearing before the Everett City Council on December 11, 2019, at 6: 30 p. m. to receive comments on the City' s intent to establish an Everett Station District Business Improvement Area ( BIA), approve a 2020 budget, and provide for the levy of a special assessment for five years. Brock Howell, Cory Burke, and Craig Skotdal, all of Everett, spoke in support of the proposed BIA. Discussion ensued regarding the west- side of Broadway addition, the budget for the BIA, and the acceptance rate of the BIA that was adopted in 2017. Roll was called with all council members voting yes, except Council Members Roberts, Vogeli, and Stonecipher who were excused. Laura Reed and Alan Dorway, both of Everett, spoke in opposition to the proposed ordinance. Fred Safstrom, Everett, spoke about the zoning issue at hand and in opposition to the proposed ordinance.
