May 27, 2020 President Touhy announced that the Council is still abiding by COVID- 19 shelter- in- place and social distancing orders, and as a result, City Council meetings will continue to be held remotely with all meetings scheduled at 12: 30 p. m. on each Wednesday, except the first Wednesday of the month, when the meeting is scheduled at 6: 30 p. m. Citizens are encouraged to view meetings live on Comcast Channel 21, Frontier Channel 29, and on the City website at www. everettwa. gov/ council. The special meeting of the Everett City Council was called to order at 12: 34 p. m., May 27, 2020, Council President Tuohy presiding. Upon roll call, it was found that Mayor Franklin and Council Members Roberts, Moore, Murphy, Bader, Stonecipher, and Tuohy were present. Council Member Vogeli was excused. The minutes of the May 20, 2020, City Council meeting were approved as printed. MAYOR Mayor Franklin spoke about rising tensions across the country spurred by recent events, and the increase in violence and the ongoing violence against black men. She extended a heartfelt message to grieving families and asked for tolerance, compassion, and support for one another, adding there is no place for violence and hate in our community. Mayo Franklin announced that due to the volume of input received from the Woods Creek community and neighbors, City staff was instructed to remove this item from the surplus property list being considered at today' s public hearing. She added that this property will be brought back for consideration at a future date, and the City will proactively reach out to this neighborhood prior to that date to 157  May 27, 2020 ensure citizens are aware and to allow for additional comments prior to comprehensive discussions about the property. COUNCIL Council Member Bader reported on his attendance at the Bayside Neighborhood meeting. He also provided an update from the Snohomish Health District, and encouraged citizens to engage in good practices such as wearing masks, washing hands, etc. Council Member Stonecipher also reported on her attendance at the Bayside Neighborhood meeting. She thanked the Mayor for removing the Woods Creek item from today' s agenda, and she asked for a review into some of the ways the City could carve out some of the developable property. Council Member Murphy provided a liaison report on his attendance at the Northwest Neighborhood meeting. He also noted the Public Facilities District PFD) Board meets tomorrow, and he will provide an update at the next Council meeting. Council Member Murphy thanked the Downtown Everett Association and DEA President Patrick Hall for stepping in to ensure the continuation of the downtown flower program this He announced the DEA is planning a year. volunteer effort this Saturday and to visit downtowneverettwa. org for additional information. He also thanked Homage Senior Services for providing senior lunches at the Carl Gipson Senior Center. Council Member Moore echoed Council Member Stonecipher' s comments about the Woods Creek property. He stated he would be interested in a refresher on the tragic loss of homes at the lower end and the relationship geologically of this property so that the City can be sure this is a sustainable decision over time. Council Member Roberts also thanked citizens for their input and City staff for fielding questions on the Wood Creek property. He also thanked those doing good work in the community, including Patrick Hall, DEA, and Homage Senior Services. Council Member Roberts stated he provided a copy of an email to Council 158  May 27, 2020 members from Peter Rogoff of Sound Transit, that addressed the future budget for the realignment of the Sound Transit system. President Tuohy reported on her attendance at the Pinehurst Neighborhood meeting last week. She stated that individuals waiting to speak about the Woods Creek property today would be moved to the general public comments section of the agenda. To accommodate more speakers wishing to enter the queue, she announced the Council would recess for three minutes. The Council recessed at 12: 52 p. m. and reconvened at 12: 55 p. m. ADMINISTRATION UPDATE Deputy Mayor Nick Harper had no comments. CITY ATTORNEY City Attorney David Hall had no comments. PUBLIC COMMENTS Deb Williams, Council, announced that the Council office received 35 written comments, a petition with 115 signatures, and approximately 14 individual requests to speak about the Woods Creek property today. The following Valley View residents spoke about the potential surplus of the Woods Creek property: Timothy Long Kelsey Lance Erika Rominger Sherry Lawrence Tanya Roost 159  May 27, 2020 Jay Himmelman Babby Skowyra Michael Wright Jim Angell, Everett, spoke about the Shore Avenue property that is on the surplus list for consideration at today' s public hearing. Chris Jarman, Everett, spoke about the constitutional right of due process and requested that all surplus property discussions be tabled until the COVID pandemic resolves. CONSENT ITEMS: Moved by Council Member Murphy, seconded by Council Member Roberts, to approve the following consent items: RESOLUTION — CLAIMS To adopt Resolution No. 7517 authorizing claims against the City of Everett in the amount of $2, 928, 395. 27 for the period of May 9, 2020, through May 15, 2020. RESOLUTION — PAYROLL CLAIMS To adopt Resolution No. 7518 authorizing payroll claims against the City of Everett in the amount of$ 4, 127, 796. 72 for the period ending May 9, 2020. AGREEMENT— VEHICLE REPLACEMENT PURCHASES To award and authorize services with Dwayne Lanes Dodge using Washington State Department Enterprise Services Contract # 015916/ EVT# 2018- 117 in an amount not to exceed $ 150, 000. 160  May 27, 2020 AGREEMENT— ELEVATOR MODERNIZATION PROJECT To authorize the Mayor to sign an Energy Services Agreement with the Washington State Department of Enterprise Services and McKinstry for the Everett Municipal Building Elevator Modernization Project and the Police Headquarters Window Replacement Project in the amount of$ 53, 239. PUBLIC HEARINGS: PROPOSED VACATION — BAKER HEIGHTS PLAT Paul McKee, Real Property, presented information on the proposed vacation of Larch and Fir Streets lying South of 14th Street and North of 15th Street in the plat of Baker Heights. He noted a revised staff report, which removes the provision for the City to retain a public utility easement, was distributed to Council earlier today. Moved by Council Member Bader, seconded by Council Member Roberts, to open the public hearing. President Tuohy opened the public hearing and asked for comments from the Council. Discussion ensued about the restoration of Pine Street to the grid; Everett Housing Authority' s overall plan, which includes city and land use; the timing of the appraisal order; and the distribution of the proceeds. Paul McKee stated he would arrange to have the Everett Housing Authority present additional information to Council. 161  May 27, 2020 President Tuohy invited the public to comment. There were no citizens who wished to speak. Moved by Council Member Bader, seconded by Council Member Robert, to close the public hearing. Moved by Council Member Moore, seconded by Council Member Roberts, to grant the petition for the proposed vacation of Larch and Fir Streets lying South of 14th Street and North of 15th Street in the plat of Baker Heights, and direct staff to prepare an ordinance vacating said streets subject to the conditions as contained in the revised staff report. Roll was called with all council members voting yes, except Council Member Vogeli who was excused. Motion carried. RESOLUTION — DECLARING CERTAIN CITY OWNED PROPERTIES AS SURPLUS AND AUTHORIZING SALE AND DISPOSITION Moved by Council Member Murphy, seconded by Council Member Roberts, to open the public hearing. President Tuohy opened the public hearing to adopt a Resolution authorizing the declaration of certain city owned properties as surplus and authorizing the sale and disposition of those properties. She added that the Public Hearing will be continued with action on June 3, 2020. 162  May 27, 2020 Paul McKee presented information relating to the following City- owned properties being considered for surplus and subsequent sale and disposition, excluding the Woods Creek property that was removed from discussion. 1. 3121 Shore Avenue 2. 6331 Kenwood Drive 3. 903 East Marine View Drive 4. 3015 Colby Avenue — Culmback Building Considerable discussion took place that included the continued need to increase density in Everett and provide more affordable housing; was there a reasonable expectation in light of official City documents that the property would or would not be developed in a certain way?; importance of stewarding utility rate payer properties; retention of the historic façade of the Culmback Building; types of marketing strategies used in the disposition of properties to enhance the value. In response to Mr. Angel' s comments about the Shore Avenue property, provided earlier under general public comments, Council Member Moore asked about the reconstruction of the stormwater outflow below the property and the full disclosure when the property is sold that will protect the City from liability from what might be considered unstable slopes. Council Member Bader left the meeting at 1: 55 p. m. President Tuohy announced the public hearing would remain open until June 3, 2020, and any action on the Woods Creek property would not be considered at that time.
