July 22, 2020 President Tuohy announced that the Council is still abiding by Governor Inslee' s Safe Start guidelines, and as a result, City Council meetings will continue to be held remotely with all meetings scheduled at 12: 30 p. m. each Wednesday, except the first Wednesday of the month when the meeting is scheduled at 6: 30 p. m. Citizens are encouraged to call or email public comments prior to the meeting. To speak under Public Comment during the meeting, calls are accepted one- half hour before the start of the meeting by calling 1. 425. 616. 3920, Conference ID 875 431 875#. Citizens may call in to listen to the Council meetings at 1. 425. 616. 3920, Conference ID: 724 887 726#, and meetings can be viewed on Everett Channel or on the City website. The special meeting of the Everett City Council was called to order at 12: 34 p. m., July 22, 2020, Council President Tuohy presiding. Upon roll call, it was found that Mayor Franklin and Council Members Roberts, Murphy, Moore, Vogeli, Bader, Stonecipher, and Tuohy were present. Moved by Council Member Murphy, seconded by Council Member Stonecipher, to amend the minutes of the July 15, 2020, Council meeting and add the following language, " During the executive session, Council Member Murphy took exception to the legality and purpose of the substance, which was a grant issue brought forward by Administration on a housing option for transient homeless. Upon questioning the legality of the executive session, the City Attorney immediately narrowed the scope and then also asked a private business party to sign off from the executive session call who had apparently been asked to participate by the Administration in the Council' s executive session." Discussion ensued regarding the executive session. Roll was called with all council members voting yes, except Council Members Moore and Bader who abstained. Motion carried. The minutes of the July 15, 2020, City Council meeting were approved as amended. Council Members Moore and Bader abstained from the vote. 210  July 22, 2020 MAYOR Mayor Franklin provided an update on the COVID- 19 pandemic. Mayor Franklin also provided an overview of a large fire that occurred on a construction site at the Port of Everett on Thursday. She thanked the Everett Fire Department and surrounding departments who assisted in mitigating the fire. Mayor Franklin presented the following emergency resolution for council concurrence due to a damaged fire apparatus and an ambulance from the fire at the Port. Mike Calvert, Fire Department, and Theresa Bauccio- Teschlog, Purchasing, provided an overview of the damage to the fire apparatus and ambulance and the need for declaring an emergency to waive competitive bidding requirements. RESOLUTION — EMERGENCY FIRE APPARATUS/ AMBULANCE REPAIRS Moved by Council Member Bader, seconded by Council Member Roberts, to adopt Resolution No. 7543 declaring an Emergency Regarding Procurement of Repair of Fire Apparatus and Repair or Replacement of Ambulance. Roll was called with all council members voting yes. Motion carried. COUNCIL Council members thanked Everett Fire and surrounding fire departments for the response to the fire at the Port of Everett on Thursday. Council Member Stonecipher expressed concern over the fact that the City provides fire services to the Port of Everett, but the Port is not subject to property taxes and therefore the burden of fire services for the Port is on Everett taxpayers. 211  July 22, 2020 Council Member Stonecipher requested an estimate of the cost of this Fire. Mayor Franklin stated they would provide that to Council. Council Member Murphy concurred with Council Member Stonecipher' s comments. Council Member Roberts also concurred with Council Member Stonecipher' s comments. He stated he attended the Delta Neighborhood meeting held Tuesday night. Council Member Vogeli proposed an emergency ordinance regarding homeless encampments during the COVID - 19 pandemic: AN EMERGENCY ORDINANCE AMENDING THE 45- Day Notice and Public Meeting for a homeless encampment EMC 19. 41. 090( J)( 4)( a)( 1) and amending the Posting of Notice ( 2)( a)( i)( ii) She requested Council' s support to send the proposed ordinance to the Legal Department for review and potential Council action next week. Council Member Stonecipher seconded the motion to send the ordinance to Legal department for review. Discussion ensued regarding housing issues, public notice, encampments, additional homelessness brought on by the COVID- 19 pandemic, and the City' s housing strategy. Council Member Moore provided a liaison report from the Diversity Committee meeting held Monday. Council Member Bader encouraged citizens to follow the COVID- 19 guidelines for wearing masks and social distancing. President Tuohy stated she attended the Cultural Arts Commission meeting on Monday. 212  July 22, 2020 ADMINISTRATION UPDATE ON PRIOR BUSINESS Deputy Mayor Nick Harper provided an update on how Snohomish County will be some of the $ 143 million CARES grant fund. He stated they will keep allocating Council informed as more details are received. CITY ATTORNEY City Attorney David Hall had no comments. Brian Partington, Everett, spoke about the fire at the Port of Everett and in support of the ordinance presented by Council Member Vogeli. Council Member Moore left the meeting at 1: 30 p. m. 213  July 22, 2020 CONSENT ITEMS: Moved by Council Member Bader, seconded by Council Member Roberts, to approve the following consent items: RESOLUTION - CLAIMS To adopt Resolution No. 7544 authorizing claims against the City of Everett in the amount of $ 2, 866, 588. 80 for the period of July 4, 2020, through July 10, 2020. RESOLUTION — PAYROLL CLAIMS To adopt Resolution No. 7545 authorizing payroll claims against the City of Everett in the amount of$ 6, 123, 763. 84 for the period ending July 4, 2020. AGREEMENT— FIVE SCULPTURE PIECES To concur with the recommendation of the Everett Cultural Arts Commission and authorize the Mayor to sign a Professional Services Agreement with Susan Zoccola for the design, fabrication, and installation of five sculptural pieces, total budget of$ 60, 000. AGREEMENT- 22 BIKE RACKS AND FOUR SCULPTURAL PIECES To concur with the recommendation of the Everett Cultural Arts Commission and authorize the Mayor to sign a Professional Services Agreement with Brian Borello, Inc. for the design, fabrication, and installation of 22 bike racks and four sculptural pieces, total budget of$ 110, 000. MEMORANDUM OF UNDERSTANDING— MARINE PARK To authorize the Mayor to sign a Memorandum of Understanding between the City of Everett, Snohomish County, and the Port of Everett concerning their 214  July 22, 2020 mutual rights and responsibilities with respect to Marine Park in substantially the form provided. Roll was called with all council members voting yes, except Council Member Moore who was excused. Motion carried. COUNCIL BRIEFING AGENDA: Authorize the Mayor to sign a Certificate Form stating the City of Everett agrees to act as a Coordinated Applicant with Snohomish County in their grant application to apply to the Washington State Department of Commerce for increased shelter capacity. Presented by Julie Willie, Community Development Discussion ensued regarding sheltering options and allocation of funds throughout the county if the grant is received. Council Member Stonecipher requested additional information on the roll of the Everett Housing Authority. Mayor Franklin stated she will work on scheduling an Everett Housing Authority briefing at a future meeting. Authorize the Mayor to sign the Interagency Agreement with Washington State Department of Commerce to seek reimbursement for eligible COVID- 19 related costs through the CARES Act Coronavirus Relief Fund for Local Governments. Presented by Nick Harper, Administration; Dan Eernissee, Economic Development; and Sarah LaVelle, Fire Discussion ensued regarding rental assistance and small business grants. 215  July 22, 2020 Council Member Stonecipher requested an itemization of the expenses the city is reimbursing itself for, including staffing costs. Mayor Franklin stated that will be provided to Council. Council Member Bader left the meeting prior to 2: 51 p. m. COUNCIL BILL 2007- 41: FIRST READING: AN ORDINANCE approving the appropriations of the 2020 City of Everett Budget and Amending Ordinance No. 3750- 20 Presented by Lori Cummings, Administration and Susy Haugen, Finance Council Member Vogeli requested details for the Criminal Justice Coronavirus Emergency Supplemental Funding Grant. Susy Haugen stated they would provide the requested information to Council. 2021 Budget Development Update.
