September 9, 2020 President Tuohy announced that the Council is still abiding by Governor Inslee' s Safe Start guidelines, and as a result, City Council meetings will continue to be held remotely with all meetings scheduled at 6: 30 p. m. each Wednesday, except the fourth Wednesday of the month when the meeting is scheduled at 12: 30 p. m. Citizens are encouraged to call or email public comments prior to the meeting. To speak under Public Comment during the meeting, calls are accepted one- half hour before the start of the meeting by calling 1. 425. 616. 3920, Conference ID 201 783 063#. Citizens may call in to listen to the Council meetings at 1. 425. 616. 3920, Conference ID: 724 887 726#, and meetings can be viewed on Everett Channel or on the City website. The regular meeting of the Everett City Council was called to order at 6: 32 p. m., September 9, 2020, Council President Tuohy presiding. Upon roll call, it was found that Council Members Roberts, Murphy, Vogeli, Bader, Stonecipher, and Tuohy were present. Mayor Franklin and Council Member Moore were excused. The minutes of the September 2, 2020, City Council meeting workshop were approved as printed. MAYOR Mayor Franklin was excused. President Tuohy, on behalf of Mayor Franklin, read a proclamation designating September as Childhood Cancer Awareness Month. President Tuohy read an email from John Estes, Everett, expressing appreciation for the proclamation. COUNCIL Council Member Murphy provided a liaison report from the Public Facilities District Board, where they discussed an ongoing homelessness issue around the Angel of the Winds arena during the pandemic. 262 September 9, 2020 Council Member Roberts stated that the Puget Sound Clean Air Agency has issued an air quality report due to wildfire smoke. He also provided an update from the Sound Transit Board. Council Member Vogeli provided a liaison report from the Westmont- Holly Neighborhood meeting held Tuesday night. She also commented on the ongoing issue around the Angel of the Winds arena and housing. Council Member Bader provided a liaison report from the Snohomish Health District Board meeting. President Tuohy provided a reminder to council members to submit budget concerns and questions to Administration. She also stated that the District Commission is seeking public input on the proposed districting map. The Commission is hosting six community meetings beginning September 10, and additional information on these meetings and contact information can be found on the City website at everettwa. gov/ districting. ADMINISTRATION UPDATE ON PRIOR BUSINESS Deputy Mayor Nick Harper provided an update regarding the Angel of the Winds arena issue brought up by Council Member Murphy. He stated he has been assured by Snohomish County that they will be keeping communications open to address this issue. CITY ATTORNEY City Attorney David Hall had no report. PUBLIC COMMENT The following people provided written comment prior to the meeting: Clifton Curd 263 r September 9, 2020 Mack Bauer Steven Armstrong Matthew Beucherie Tina Hokanson Megan Fairchild and Thomas Fairchild, both of Everett, spoke about the lack of housing options for the homeless during the pandemic. Katrina Lindahl, Everett, spoke in support of Council Briefing Item No. 17 and Proposed Action Item No. 11. Angela DeFilippo, Everett, spoke in support of Action Item No. 12 and Council Briefing Items Nos. 16 and 17. She also spoke about homelessness during the pandemic. Laura Reed, Everett, spoke about homelessness during the pandemic and about a police incident that occurred last week. CONSENT ITEMS: Moved by Council Member Bader, seconded by Council Member Roberts, to approve the following consent items: RESOLUTION - CLAIMS To adopt Resolution No. 7559 authorizing claims against the City of Everett in the amount of$ 1, 028, 064. 05 for the period of August 15, 2020, through August 21, 2020. RESOLUTION — PAYROLL CLAIMS To adopt Resolution No. 7560 authorizing payroll claims against the City of Everett in the amount of$ 3, 876, 362. 71 for the period ending August 15, 2020. 264 September 9, 2020 RESOLUTION — ELECTRONIC TRANSFER CLAIMS To adopt Resolution No. 7561 authorizing electronic transfer claims against the City of Everett in the amount of $ 5, 673, 903. 60 for the period of June 1, 2020, through June 30, 2020. AGREEMENT AMENDED— DIKING IMPROVEMENT DISTRICT NO. 5 To authorize the Mayor to sign Amendment No. 2 to the Diking Improvement District 5 and City of Everett Management Agreement detailing annual payment for maintenance and improvements of the dikes and flood control facilities in Diking Improvement District No. 5 located south of 12th Street. AGREEMENT AMENDED - COMPUTER MAINTENANCE MANAGEMENT SYSTEM REPLACEMENT PROJECT To authorize the Mayor to sign Amendment No. 1 to the Professional Services i Agreement with LA Consulting Incorporated for the Asset Management Improvement and Computer Maintenance Management System Replacement Project extending the completion date to December 31, 2021. AGREEMENT- CITY BEAVER DAM MITIGATION PROJECT To authorize the Mayor to sign the right of entry granted by Thunder Dragon T LLC to the City for entry onto property in the Lake Chaplain watershed area for City beaver dam mitigation project. DONATION— EVERGREEN BRANCH LIBRARY ITEMS To authorize the Mayor to accept donations from the Friends of the Everett Public Library to be used to purchase designated items for the Evergreen Branch Library in the amount of$ 33, 157. 66. 265 September 9, 2020 AGREEMENT- INCREASED BANDWIDTH FOR EVERETT CHANNEL To authorize the Mayor to sign the cost schedule with Northwest Fiber, LLC on behalf of Ziply Fiber ( aka Frontier) to increase bandwidth for Everett Channel internet connection in the amount of$ 1, 200 annually, plus taxes and fees. Roll was called with all council members voting yes, except Council Member Moore who was excused. Motion carried. PROPOSED ACTION ITEMS: COUNCIL BILL 2008- 45 FIRST READING: AN ORDINANCE closing a special improvement project, entitled " Three Acre Park, Phase 1," Fund 308, Program 006, as established by Ordinance No. 3476- 16 Council Member Murphy requested a briefing regarding the park construction schedule. Deputy Mayor Nick Harper stated he would work to schedule a future briefing. COUNCIL BILL 2009- 46 FIRST READING: AN ORDINANCE creating a special improvement project, entitled " Garfield Park Path Overlay and Sport Court Seal Coat Project," Fund 354, Program 067, to accumulate all costs for the project 266 September 9, 2020 ACTION ITEMS: AGREEMENT— PORT SECURITY GRANT PROGRAM Moved by Council Member Bader, seconded by Council Member Stonecipher, to authorize the Mayor to sign all necessary documents and agreements with the Department of Homeland Security regarding the award acceptance and utilizations of the $ 81, 462. from the FY 2020 Port Security Grant Program. Discussion ensued regarding vessel registration funds, utilizing aerial drones in specific jurisdictional airspaces, drone training and education in the marine operations unit, the possibility of an audit of the grant by Department of Homeland Security, and Port of Everett involvement. Roll was called with all council members voting yes, except Council Member Moore who was excused. Motion carried. AGREEMENT- MOTEL VOUCHER PROGRAM Moved by Council Member Roberts, seconded by Council Member Vogeli, to authorize the Mayor to sign the Motel Voucher Program Agreement with the Snohomish County Human Services Division, to allow the Everett Police Department to utilize the $ 100, 000 in funds to help combat homelessness. Roll was called with all council members voting yes, except Council Member Moore who was excused. Motion carried. 267 0 September 9, 2020 AGREEMENT AMENDED— TRANSFER LOT 3 — NEAR PHIL JOHNSON BALLFIELDS Moved by Council Member Bader, seconded by Council Member Roberts, to authorize the Mayor to sign Amendment No. 1 to the Transfer Lot Agreement with Cadman Materials Inc. in substantially the form provided. Roll was called with all council members voting yes, except Council Member Moore who was excused. Motion carried. COUNCIL BRIEFING AGENDA: Authorize the Mayor to sign an Interlocal Agreement between the City of Everett and Snohomish County concerning the annexation of the unincorporated portion of Smith Island located within the City of Everett Municipal Urban Growth Area Presented by David Stalheim, Community, Planning & Economic Development Facilities Condition Assessment Update Presented by Jeff Harris, Facilities Council Member Stonecipher requested a prioritization list. Jeff Harris stated he would provide that list. Regarding the following Council Bills 2009- 47 and 2009- 48, President Tuohy asked if any council member had any conflict of interest that would disqualify them from participating in the conduct of these ordinances.
