October 14, 2020 President Tuohy announced that the Council is still abiding by Governor Inslee' s Safe Start guidelines, and as a result, City Council meetings will continue to be held remotely with all meetings scheduled at 6: 30 p. m. each Wednesday, except the fourth Wednesday of the month when the meeting is scheduled at 12: 30 p. m. Citizens are encouraged to call or email public comments prior to the meeting. The regular meeting of the Everett City Council was called to order at 6: 33 p. m., October 14, 2020, President Tuohy presiding. Upon roll call, it was found that Mayor Franklin and Council Members Roberts, Moore, Murphy, Vogeli, Bader, Stonecipher, and Tuohy were present. The minutes of the October 7, 2020, City Council workshop were approved as printed. MAYOR OATH — POLICE OFFICERS Moved by Council Member Roberts, seconded by Council Member Stonecipher, to concur with the appointment of Louis Chan, Jose Vargas, Jason Suarez, and Alan Richards as new police officers. Roll was called with all council members voting yes. Motion carried. The City Clerk designee administered the oath of office. 311  October 14, 2020 Mayor Franklin proclaimed the week of October 12 — 16, 2020, as an affordable housing week in Everett. COUNCIL Council members welcomed the newly hired police officers. Council Member Bader provided a liaison report on his attendance at the Snohomish Health District Board meeting. Council Member Roberts provided a report from the Sound Transit Board meeting. He also spoke about the Snohomish County Citizens for Improved Transportation SCCIT) work on the legislative agenda for the 2021 session. Council Member Roberts requested a broader discussion regarding shelter grant process. Council Member Vogeli provided a liaison report on her attendance at the Westmont- Holly Neighborhood meeting. Council Member Murphy provided a liaison report from Public Facilities Districts Board meeting. Council Member Moore encouraged citizens to get connected with local school districts. President Tuohy provided a liaison report from her attendance at the Cultural Arts Commission meeting. ADMINISTRATION UPDATE Julie Willie, Administration, provided an update on the Department of Commerce Shelter Grant and asked council members to forward her any questions regarding this topic. 312  October 14, 2020 Discussion ensued regarding the need for a briefing, more details about the proposal, and general outline of available options. President Tuohy encouraged council members to forward their questions to Ms. Willie and stated that she will work with administration on scheduling a briefing. COUNCIL BILL 2009- 50 SECOND READING AND PUBLIC HEARING: 316  October 14, 2020 AN ORDINANCE amending the Everett Comprehensive Plan Land Use Map for Housing Hope at the Sequoia Field Site Council Member Bader asked for clarification if there is a binding clause requiring resident of this development to have student who attends Sequoia High School. Council Member Murphy asked what would happen over time as students living in these homes graduate from Sequoia High School and there will be no students in Everett Public Schools. He also requested information regarding equitable distribution of supportive housing throughout the city and if this should have been taking into consideration. City Attorney Hall stated that we can not regulate supportive housing or low- income housing any differently then any other type of multi- family housing. David Stalheim, Planning, stated that the policy on concentration of housing is a consideration for project funding proposals. Council Member Vogeli stated that the priorities for potential residency are listed in the Everett Public Schools lease agreement with Housing Hope. Council Member Vogeli requested more information regarding the source of equitable distribution of supportive housing numbers. PUBLIC HEARING - COUNCIL BILLS 2009- 51 and 2009- 52: President Tuohy opened the public hearing regarding Council Bills 2009- 51 and 2009- 52. She stated that public hearing will remain open until third and final reading. COUNCIL BILL 2009- 51 SECOND READING AND PUBLIC HEARING: AN ORDINANCE amending Chapter One, Introduction and Chapter Two, Land Use Element of the Everett Comprehensive Plan 317  October 14, 2020 COUNCIL BILL 2009- 52 SECOND READING AND PUBLIC HEARING: AN ORDINANCE amending Title 2 ( Chapter 2. 96, Historical Commission), Title 13 ( Chapter 13. 68, Street Construction and Private Construction), Title 15 ( Local Project Review Procedures), Title 18 ( Land Division), Title 19 Zoning) and Title 20 ( Chapter 20. 04, Environmental Policy) There were no citizens who wished to speak. PUBLIC HEARING — COUNCIL BILL 2009- 49: President Tuohy opened the public hearing regarding Council Bill 2009- 49. David Stalheim, Planning, reminded council about the two proposed options. Council Member Bader asked how many stores in Everett have medical endorsement. David Stalheim stated that two of Everett' s stores have the medical endorsement. Council Member Murphy asked if stores with medical endorsement are required to sell medical products or these stores can sell recreational products only. David Stalheim stated that Washington State Department of Health has requirements regarding the medical endorsement. Council Member Stonecipher stated that there is an additional fee for the medical endorsement and medical endorsements require a certified marijuana consultant on staff. She also noted that recreational marijuana products are in the highest demand, and there is a lack of availability of medical marijuana products. COUNCIL BILL 2009- 49 THIRD AND FINAL READING: AN ORDINANCE increasing the number of permitted Recreational Marijuana Retail Stores to not more than eight, amending Section C of Ordinance No. 3486- 16 ( EMC 19. 39. 145, as amended) Moved by Council Member Vogeli, seconded by Council Member Stonecipher, that this is declared to be the third and final reading of Council Bill No. 2009- 49 option 1. Council Member Stonecipher as a chair of Public Safety Subcommittee provided an overview of the work of the committee on this topic: public safety calls for service related to marijuana retailers, the availability of marijuana products to youth, the use of marijuana products by youth, and a compliance rate for cannabis retailers. She also spoke against legalized monopoly created by the state and stated that in the consumer driven economy the marketplace will determine who will succeed. Council Member Bader expressed concerns regarding the image that additional cannabis stores will give to Everett, as Everett will have half of the stores in the Snohomish County. He stated the need for neighboring jurisdictions to provide medical marijuana. He also noted that the increase of the number of the stores will not increase tax revenue or jobs in Everett. Council Member Roberts concurred with Council Member Stonecipher' s comments and thanked the Public Safety Subcommittee for the work on this topic. He stated that the increase of the number of stores will help to drive out black market and support fair market economy. He spoke about positive neighborhood efforts of the retail marijuana stores. 319  October 14, 2020 Council Member Vogeli stated that the City of Lynwood started to discuss allowing marijuana stores in the City of Lynnwood. She spoke about marijuana stores' efforts on being good neighbors. Council Member Vogeli also underlined the need of medical products in the community. Council Member Murphy also thanked Public Safety Subcommittee and Police Chief Templeman. He spoke about an importance of medical endorsement requirement added to the new stores and the availability of medical products to the public. He also criticized the monopoly that exists with the limited number of marijuana stores. Council Member Moore spoke about an importance of medical endorsement and availability of medical products. He stated that additional stores will not bring additional tax revenue. He encouraged every store to offer a variety of medical products to the community. President Tuohy spoke about the work of the Public Safety Subcommittee and underlined an importance of keeping the 2, 500 feet separation requirement. The City Clerk was directed to call the roll for the final disposition of the ordinance.
