January 13, 2021 President Stonecipher announced that the Council is still abiding by Governor Inslee' s Stay Home Stay Healthy order, and as a result, City Council meetings will continue to be held remotely with all meetings scheduled at 6: 30 p. m. each Wednesday, except the fourth Wednesday of the month when the meeting is scheduled at 12: 30 p. m. She encouraged citizens to submit comments and concerns by email to council@everettwa. gov prior to the meeting or to call the Council office at 425- 257- 8703. The regular meeting of the Everett City Council was called to order at 6: 30 p. m., January 13, 2021, Council President Stonecipher presiding. Upon roll call, it was found that Mayor Franklin and Council Members Roberts, Murphy, Moore, Vogeli, Bader, Stonecipher, and Tuohy were present. The minutes of the January 6, 2021. City Council meeting were approved as printed. MAYOR PROCLAMATION Mayor Franklin shared a proclamation proclaiming Monday, January 18, 2021, as Reverend Dr. Martin Luther King, Jr. Community Celebration Day. Council Member Bader expressed concern about the disproportionate number of appointments to applicants residing north of 41st Street. Mayor Franklin stated that all applicants were interviewed, and staff worked to ensure there was good geographic, ethic, racial, and life experience diversity. She noted that for some of the commissions, there was a struggle to get applicants from south Everett; however, staff will continue to recruit and make communities aware of opportunities. Council Member Murphy suggested that council members, during neighborhood visits as part of Council liaison assignments, could serve as ambassadors over the next few months to raise the awareness about serving on boards and commissions. Roll was called with all council members voting yes. Motion carried. COUNCIL Council Member Vogeli reported on her attendance at the Westmont Holly Neighborhood meeting last evening. Council Member Roberts expressed appreciation to Council Member Tuohy for the tremendous work she accomplished as Council President in 2020. He reported on his ongoing Climate Action Plan ( CAP) work with Nick Harper and Kimberley Cline. Council Member Roberts also provided an update on Sound Transit realignment. 4  January 13, 2021 Council Member Moore thanked Council Member Tuohy for her 2020 service as Council President, noting she brought calm and comfort to citizens. He also congratulated newly- elected Council President Stonecipher. Council Member Tuohy reported on her attendance at the Cultural Arts Commission meeting yesterday. She thanked fellow colleagues for their kind remarks. Council Member Bader apologized to fellow council members for not providing notice prior to his comments last week regarding the formation of a regional fire authority ( RFA). He stated he would be more proactive as study on this topic continues. Council Member Murphy stated that it was a dark day on January 6 when a riotous mob of domestic terrorists stormed and attacked our Nation' s Capitol. He stated our hearts go out to families of those who lost their lives in the attack. He noted he was proud of congressional leaders from both parties who went back into the chambers to ratify the will of the people in connection of the 2020 presidential election. Council Member Murphy recited the Pledge of Allegiance in response to the number of months missed due to conducting virtual Council meetings. Council Member Stonecipher expressed shock over what occurred in the Nation' s Capitol over the past week and expressed sympathy to those affected by violence. She reported on her attendance at the Park Board meeting last night, and announced a Park Board virtual retreat is scheduled for Saturday, January 23, 2021, 9: 30 a. m. to 12: 30 p. m. ADMINISTRATION UPDATE Deputy Mayor Nick Harper had no administrative update. 5  January 13, 2021 CITY ATTORNEY City Attorney David Hall thanked Council Member Tuohy for her work as Council President in 2020. He also stated he looked forward to working with President Stonecipher during the coming year. PUBLIC COMMENTS Deb Williams, Council, stated two citizens provided written comments regarding Council Bill 2101- 02 relating to the Larch and Fir Street vacation. Peter Newland, an Everett resident representing the C2 Property Preservation Group, expressed concerns over the Everett Station District Alliance receiving a grant from the Washington State Department of Commerce to consider re- development plans for city- owned properties and calling the effort " out-sourcing" of City of Everett long- range planning. Considerable discussion ensued. Council members asked for a full briefing on the grant, study, the City' s role in how this planning effort planning activities, corresponds with the work in this area that was just completed with the Everett Metro plan, and logical steps to be taken after the group' s plan is complete. Council President Stonecipher said she would work with Administration to schedule a briefing. Council Member Tuohy also requested a copy of the grant. Deputy Mayor Harper stated Administration did not sponsor and is not a co- signer on the grant application; therefore, there is no conflict between the interests of Administration or the Council. He also provided a snapshot of details surrounding the grant. City Attorney Hall clarified the planning process is not " outsourcing" of the City' s usual planning process; it is an independent process. 6  January 13, 2021 CONSENT ITEMS: President Stonecipher announced that Consent Item No. 4 was moved to the Action Item agenda to allow for Council discussion. Moved by Council Member Roberts, seconded by Council Member Vogeli, to approve the following consent items: RESOLUTION — CLAIMS To adopt Resolution No. 7600 authorizing claims against the City of Everett in the amount of $ 1, 053, 761. 91 for the period of December 26, 2020, through December 31, 2020. AGREEMENT- 4000 RAILWAY PARCEL CLEANUP To authorize the Mayor to sign the Settlement Agreement and Release with the Chubb Insurers. BID CALL— CONSTRUCTION OF RESERVOIR 2 REPLACEMENT PROJECT To authorize Call for Bids for the construction of the Reservoir 2 Replacement Project. AGREEMENT— GRANT FOR WOOD CREEK OPEN SPACE PLANNING Moved to Action Item agenda. AGREEMENT AMENDED — LEASE FOR SPACE AT 2722 COLBY AVENUE POLICE EVIDENCE ROOM To authorize the Mayor to sign Amendment No. 6 to the Lease Agreement with JB Everett LLC for space at 2722 Colby Avenue for the Police Evidence Room. 7  0 January 13, 2021 RESOLUTION — APPLICANT AGENT DESIGNATION FOR WASHINGTON HAZARD MITIGATION GRANT PROGRAM APPLICATION To adopt Resolution No. 7601 designating Applicant Agent for Washington Hazard Mitigation Grant Program Application. MEMORANDUM OF AGREEMENT— 2021- 2025 WATER SUPPLY FORUM To authorize the Mayor to sign the 2021- 2025 Water Supply Forum Memorandum of Agreement. AGREEMENT AMENDED— WFP FILER PILOT TECHNICAL SUPPORT To authorize the Mayor to sign Amendment No. 2 to the Water Filtration Plant Filer Pilot Technical Support Professional Services Agreement with CHM2Hill Engineering Inc., a wholly owned subsidiary of Jacobs in the amount of$ 67, 000 for a total contract amount of$ 122, 500. ACTION ITEMS: AGREEMENT— GRANT FOR WOOD CREEK OPEN SPACE PLANNING Moved by Council Member Roberts, seconded by Council Member Vogeli, to authorize the Mayor to sign the SCPP Grant Agreement in the form generally provided with Snohomish County for the funding of the Wood Creek Open Space Planning. Council Member Vogeli expressed interest in learning more about how this action went from a possible City sale of surplus land to possible park land. 8  January 13, 2021 Council Member Roberts thanked County Councilmember Megan Dunn, Mayor Franklin, Deputy Mayor Harper, Paul McKee and other public works staff, as well as Forterra. He noted this grant will allow completion of some of the work that is essential to evaluation of the property. Council Member Tuohy thanked neighborhood citizens who brought this to the attention of the Council when the property was proposed as surplus. Council Member Bader asked if the study also considers the City' s obligation to the Growth Management Act to accommodate a certain level of growth. Council Member Murphy expressed concern that the City cannot take surplus property that is owned by the Utility Fund without making the Utility Fund whole as a fiduciary responsibility to rate payers. Deputy Mayor Harper presented information regarding the Wood Creek property area, which was originally designated as a water supply for Everett and belongs to the City Utility Division. He noted the property has not been used for its intended purpose for approximately 100 years, and therefore was placed on the surplus list until concern was expressed by neighbors and habitat advocates. He stated the study will involve Forterra ( Cascade Land Conservancy) and look at geotechnical and environmental issues with the property. Roll was called with all council members voting yes. BID CALL AND CONTRACT AWARD — 2021 BIOSOLIDS AND BACKWASH SOLIDS REMOVAL PROJECT Moved by Council Member Bader, seconded by Council Member Moore, to ratify prior Call for Bids and award contract for the 2021 Biosolids and Backwash Solids Removal Project to Merrell Bros Inc. in the amount of $ 1, 038, 792. 30 including Washington State sales tax. 9  January 13, 2021 Council Member Murphy noted the contract amount is about $ 120, 000 less than the engineer' s estimate.
