February 3, 2021 President Stonecipher announced that the Council is still abiding by Governor Inslee' s Safe Start guidelines, and as a result, City Council meetings will continue to be held remotely with all meetings scheduled at 6: 30 p. m. each Wednesday, except the fourth Wednesday of the month when the meeting is scheduled at 12: 30 p. m. The regular meeting of the Everett City Council was called to order at 6: 32 p. m., February 3, 2021, Council President Stonecipher presiding. Upon roll call, it was found that Mayor Franklin and Council Members Roberts, Moore, Vogeli, Bader, Stonecipher, and Tuohy were present. Council Member Murphy was excused. The minutes of the January 27, 2021, City Council meeting were approved as printed. Council Member Moore abstained. MAYOR Police Chief Dan Templeman introduced new police officer trainee Jordan Franco. OATH OF OFFICE— POLICE OFFICER Moved by Council Member Tuohy, seconded by Council Member Roberts, to concur with the appointment of Jordan Franco as a new police officer. Roll was called with all council members voting yes, except Council Member Murphy who was excused. Motion carried. 1  February 3, 2021 The City Clerk administered the oath of office. COUNCIL Council Member Bader provided a liaison report from the Animal Shelter Advisory Board meeting. Council Member Vogeli acknowledged Black History Month. She stated she has received two emails from citizens: the first requesting the city to establish an ethics committee and the second regarding protests at Planned Parenthood in downtown Everett. Council Member Roberts stated he attended the Sound Transit Board meeting last week. Council Member Moore stated that Monday will be the first day of in- person learning for kindergarten and first grade students at Everett Public Schools, and warned drivers of the increase in busses and small children on the streets. President Stonecipher brought forward the following unscheduled agreement: AGREEMENT— 4TH OF JULY FIREWORKS SHOW Moved by Council Member Bader, seconded by Council Member Tuohy, to authorize the Mayor to sign the Agreement with Western Display Fireworks, LTD, for a 4th of July Fireworks Show in the amount of$ 72, 000. Discussion ensued regarding the cancellation clause, costs associated with cancellation, constraints if rescheduling is needed, the possibility of alternative fireworks productions that includes a few small events rather than one large event, and the time sensitivity of this contract. Council Member Moore requested that future contracts allow adequate time for discussion to address a variety of formats and venues to allow access to the most residents. 2  February 3, 2021 Roll was called with all council members voting yes, except Council Member Murphy who was excused. ADMINISTRATION UPDATE ON PRIOR BUSINESS Lori Cummings, Administration, stated that staff discussion is in progress regarding the two emails by Council Member Vogeli — the first, addressed suggesting the formation of an ethics committee and the second, which proposes a 75- foot buffer for protesters outside Planned Parenthood. CITY ATTORNEY City Attorney David Hall had no comment. CONSENT ITEMS: Moved by Council Member Bader, seconded by Council Member Tuohy, to approve the following consent items: RESOLUTION - CLAIMS To adopt Resolution No. 7605 authorizing claims against the City of Everett in the amount of$ 3, 203, 395. 72 for the period of January 16, 2021, through January 22, 2021. LITIGATION - EAST CLEARWELL ROOF To approve Litigation against East Clearwell Roof Contractor and Subcontractors. AGREEMENT- PRELIMINARY ENGINEERING FOR CSO STORAGE To authorize the Mayor to sign Professional Services Agreement in the amount of$ 323, 082 with Jacobs Engineering Group, Inc. for preliminary engineering for CSO Storage at 36th Street. AGREEMENT— OVERTIME COST REIMBURSEMENT To authorize the Mayor to sign the Joint Law Enforcement Operations Task Force Obligation document with the United States Department of Justice, Marshals Service for overtime cost reimbursement in the amount of$ 6, 000. Motion carried. 4  February 3, 2021 PUBLIC HEARING: President Stonecipher opened the public hearing on Council Bill 2101- 04. There were no citizens who wished to speak. Moved by Council Member Roberts, seconded by Council Member Bader, to close the public hearing. Roll was called with all council members voting yes, except Council Member Murphy who was excused. COUNCIL BILL 2101- 04 THIRD AND FINAL READING AN ORDINANCE adopting the State Fire Code with local amendments, amending Ordinance No. 3196- 10 and 1041- 84 as amended, and repealing Ordinance No 1902- 92 as amended Moved by Council Member Tuohy, seconded by Council Member Bader, that this is declared to be the third and final reading of Council Bill No. 2101- 04. Council Member Moore stated he would abstain from the vote since he works for Everett Public Schools, and one of the amendments affects the school district. The City Clerk was directed to call the roll for the final disposition of the ordinance. COUNCIL BRIEFING AGENDA: 2021 Economic Development update Presented by Dan Eernissee, Economic Development Greg Lineberry, Everett, spoke about the importance of updating the Home Occupation Permit for businesses operating within a private residence. Council Member Vogeli requested a briefing on parking and creating a walkable city. Request for Proposal# 2020- 061 Public Private Partnership - Park Properties Presented by Bob Leonard, Parks Commerce Shelter Grant- Pallet Shelter Pilot Presented by Julie Willie, Community Development 6  February 3, 2021 Discussion ensued regarding a " No- Sit Zone" ordinance and the legality of such an ordinance. Council Members Roberts, Tuohy, and Stonecipher requested details regarding the management and rules of the proposed program. Council Member Tuohy asked for a tour of the potential site for this pilot project. Ms. Willie stated she would arrange a tour. Council Member Stonecipher asked about the bidding process for this type of project. David Hall stated that Tim Benedict, Legal, will provide this additional information to Council. President Stonecipher announced that the next meeting is a retreat scheduled for Wednesday, February 10, at 4 p. m.
