August 11, 2021 President Stonecipher announced that the Council is still abiding by Governor Inslee' s Healthy Washington guidelines, and as a result, City Council meetings will continue to be held remotely with all meetings scheduled at 6: 30 p. m. each Wednesday, except the fourth Wednesday of the month when the meeting is scheduled at 12: 30 p. m. She stated a reopening plan is being developed, and the Council will be prepared to make an announcement at a future meeting. President Stonecipher announced that citizens are encouraged to view meetings live on Comcast Channel 21, Frontier Channel 29, and on the City website at www. everettwa. gov/ citycouncil. Individuals may also call in to listen to the live meeting at any point by dialing 425. 616. 3920, Conference ID 724 887 726#. She stated the public is welcome to provide comments on any matter via email at council@@everettwa. gov, and for community members wishing to participate by phone during the meeting, a weekly conference ID number may be obtained by calling the Council office at 425. 257. 8703 or via email at council@everettwa. gov. She asked that comments be respectful, and remarks limited to three minutes. She added that the Council does not allow comments on certain issues such as: campaigning of any kind — whether for or against ballot measures or candidates running for is legally prohibited at the meeting, and comments focused on office— personal matters that are unrelated to City business. The regular meeting of the Everett City Council was called to order at 6: 30 p. m., August 11, 2021, Council President Stonecipher presiding. Upon roll call, it was found that Mayor Franklin and Council Members Roberts, Moore, Murphy, Vogeli, Stonecipher, and Tuohy were present. Council Member Bader was expected to be a few minutes late. The minutes of the August 4, 2021, City Council meeting were approved as printed. MAYOR Mayor Franklin issued a word of caution regarding the excessive heat warning that will remain in effect for the next few days. She reminded the public to seek cooling 41  August 11, 2021 centers such as the Everett libraries and malls, and she encouraged everyone to share this information with friends and neighbors. COUNCIL Council Member Murphy reported that he attended the Mother of All Garage Sales ( MOAGS) event in northwest neighborhood on Saturday. He thanked Kari Quaas, Northwest Neighborhood Association, and the entire committee for coordinating this event. Council Member Vogeli announced a school campus clean- up in the Westmont- Holly Neighborhood is scheduled for Saturday, beginning at 10: 00 a. m. Council Member Roberts also thanked Kari Quaas, Northwest Neighborhood Association, for her work on another successful MOAGS event. He reported that the Sound Transit ( ST) Board, following months of discussions and engagement with jurisdictions and stakeholders, unanimously adopted a realignment plan on August 5. Council Member Roberts also reviewed the impacts of the realignment plan for Everett. Council Member Bader provided a liaison report from his attendance at the Parks Board meeting this week. He commented on the ST realignment plan, and thanked Council Member Roberts and the other Snohomish County representatives for their work. Council Member Moore thanked Council Member Bader for his comments regarding the ST realignment plan. President Stonecipher also commented on Council Member Bader' s comments regarding the ST realignment plan. She requested that Administration schedule a briefing in the next few months to present the City' s plans to meet the needs that will emerge as Everett grows. 2  August 11, 2021 ADMINISTRATION UPDATE Lori Cummings, Administration, stated Administration would compile information for Council regarding planning efforts. CITY ATTORNEY City Attorney David Hall had no comments. PUBLIC COMMENTS: Deb Williams, Council, received one written comment from Joe Zlab, Everett. Mr. Zlab also provided public comment on the clearing of a homeless encampment located on the 2600 block of Rockefeller Avenue. CONSENT ITEMS: Moved by Council Member Roberts, seconded by Council Member Bader, to approve the following consent items: RESOLUTION — CLAIMS To adopt Resolution No. 7671 authorizing claims against the City of Everett in the amount of $ 1, 335, 158. 83 for the period of July 24, 2021, through July 30, 2021. COUNCIL BRIEFING AGENDA: Police Legislative Update — Update on new laws and potential impacts to city operations and police response Presented by Police Chief Dan Templeman; Lacey Offutt, Legal Police Chief Templeman and Assistant City Attorney Offutt provided information on the impacts of new bills passed during the 2020- 2021 Legislative Session related to police reform ( Engrossed Substitute House Bill 1054, Engrossed 2nd Substitute House Bill 1310, Engrossed 2nd Substitute Senate Bill 5051, Engrossed Senate Bill 5476). Council Member Murphy expressed concern that in the Legislature' s rush, the new legislation has left the Police Department without clear guidance. He asked if it would be possible to seek clarification from the Attorney General as soon as possible. 6  August 11, 2021 Chief Templeman stated he has heard the Attorney General is in receipt of a request for guidance; however, a timeframe for an official opinion is not known at this time. Council Member Tuohy requested regular updates from the Police Department on the impacts and challenges created by the new legislation. The meeting was temporarily interrupted at 7: 50 p. m. due to technical difficulties. The meeting was reconvened at 8: 03 p. m. Council Member Vogeli extended kudos to the Police Department for its use of de- escalation techniques before it was common practice. Council Member Roberts requested that the Police Department bring forward recommendations to be included in the City' s legislative agenda. He also requested the Police Department provide a best estimate regarding the impacts of unfunded mandates. Council Member Bader expressed concern that the impacts of the new legislation may impact the City' s ability to hire and retain Everett police officers. He also stated it may be helpful for the public to receive information about the new legislative changes. Council Member Bader requested the City' s legal team draft a resolution asking the Governor to call the legislature back into special session to address the challenges that have been created by the new legislation and to request that the Attorney General immediately release the model policies rather than at some time in the future. Council Member Scott Murphy provided support for this action. City Attorney Hall stated the Legal Department will draft a resolution for Council' s consideration. Council Member Moore expressed agreement with the action brought forward by Council Member Bader. He encouraged Administration to join with others on this issue. 7  August 11, 2021 President Stonecipher stated she was struck by legislative agenda coming from a place to address some perceived wrongs. She asked Chief Templeman to help council members understand some of the typical calls officers face that will be changed or impacted by most of these laws. Chief Templeman reviewed some of the types of calls impacted by the new legislation. Mayor Franklin thanked Chief Templeman, Lacey, and the entire team who spent hundreds of hours analyzing the impacts to the Police Department. She stated Administration will continue to update Council and will work on ways to share information with the public. City Update Re: Homelessness - Update on current and future strategies to address challenges and opportunities Presented by Julie Willie, Community Development; Police Chief Templeman Julie Willie provided an update on the City' s response to homelessness and the City' s goals for working in partnership across the County. Council Member Murphy inquired about the legality of sidewalk encampments and what services are currently being offered to those individuals. He also asked about the current capacity at the pallet shelter project. Council Member Tuohy inquired about the current capacity of the mission and feeding centers. With the protections for renters and homeowners for closures and evictions in place, Council Member Tuohy asked about any plans in place to assist. Julie stated she would provide additional information regarding plans for protections at a future date. Council Member Vogeli stated the Council can assist by writing policy to create more affordable and abundant housing. 8  August 11, 2021 Council Member Roberts requested that Julie come back to Council as soon as possible when better information is obtained on the CARES Act allocation and information on rental assistance and the impacts on Everett' s housing marketplace due to COVID- 19. He stated he would like to hear recommendations on the best approach to find more resources for housing to assist the City in developing appropriate requests at the federal, state, and local levels. Council Member Bader suggested the use of American Rescue Plan ( ARP) funds for additional pallet shelter units. He also expressed concern about the unsafe nature of public camping and the need to focus on individuals who will not accept help. Council Member Bader also spoke about the negative impacts on residents and suggested a possible challenge to the Martin vs. Boise Supreme Court case be considered. Council Member Moore spoke about the impacts of homelessness on the community and the need to take a stronger stance on public policy. President Stonecipher stated she would like more detailed information about Everett' s homeless population, more information about the plan, and what needs to be accomplished. Council Member Murphy asked President Stonecipher to consider scheduling a separate workshop in the next 2- 3 months.
