September 8, 2021 President Stonecipher announced that the Council is still abiding by Governor Inslee' s Healthy Washington guidelines, and as a result, City Council meetings will continue to be held remotely with all meetings scheduled at 6: 30 p. m. each Wednesday, except the fourth Wednesday of the month when the meeting is scheduled at 12: 30 p. m. She stated the City Council is prepared to open the Council chambers when public health considerations indicate it is safe to do so. President Stonecipher stated that public comments from the community are welcome on items that are up for discussion during the meeting. She noted that those wishing to provide public comment on agenda items, may call 1. 425. 616. 3920, Conference ID: 392 358 139#. She asked that comments be respectful, and remarks limited to three minutes. She added that the Council does not allow comments on certain issues such as: campaigning of any kind — whether for or against ballot measures or candidates running for office — is legally prohibited at the meeting, and comments focused on personal matters that are unrelated to City business. She stated that members of the public are always welcome to provide comments or concerns on any matter via email at Council@everettwa. gov. The regular meeting of the Everett City Council was called to order at 6: 39 p. m., September 8, 2021, Council President Stonecipher presiding. Upon roll call, it was found that Mayor Franklin and Council Members Roberts, Murphy, Vogeli, Bader, and Stonecipher were present. Council Members Tuohy and Moore were excused. 1  September 8, 2021 The minutes of the September 1, 2021, City Council meeting were approved as printed. Council Member Murphy abstained from the vote. MAYOR Mayor Franklin welcomed students and staff back to schools this week. COUNCIL Council Member Roberts reported that he met with Congressman Rick Larson to discuss Sound Transit' s realignment process. He also stated that he toured the new Hoff Foundation facilities on Broadway. Council Member Bader provided a report from the Puget Sound Regional Council Growth Management Board meeting. He also provided a liaison report from the Parks Board meeting held Tuesday. Council Member Bader asked if other council members support directing the city attorney to draft amending language to the current " No Sit, No Lie" ordinance that would allow it to be used in other areas that are disproportionally impacted by social services. Council Member Murphy supported the suggestion. President Stonecipher stated she would work to add this to a future Council agenda. Council Member Vogeli commented on possible changes to the " No- sit, No- lie" ordinance. Council Member Murphy provided a liaison report from the Police Department where they discussed the upcoming police assessment. Council Member Murphy also suggested resuming the Pledge of Allegiance at the beginning of Council meetings. Council Member Roberts supported the suggestion. President Stonecipher stated she would work with Administration to reinstate for future remote Council meetings. President Stonecipher reminded the community about the importance of the COVID- 19 vaccine. She stated that Providence Hospital is currently over capacity. 2  September 8, 2021 She also thanked the Mayor and Administration for their weekly briefing memo to the Council. President Stonecipher asked if the budget process that begins on September 29 will include the allocation of American Rescue Plan ( ARP) funds. Mayor Franklin stated this will be a separate process; however, the ARP fund allocations would still be presented to Council. President Stonecipher reminded colleagues and residents that Council meetings will be moving to the Zoom platform beginning next week. Additional information can be found on the Council website. ADMINISTRATION UPDATE ON PRIOR BUSINESS Lori Cummings, Administration, had no comments. CITY ATTORNEY City Attorney David Hall requested a 10- minute executive session regarding one labor contract matter pursuant to RCW 42. 30. 140( 4) with no announcement to follow. PUBLIC COMMENT Dylan Sluder, Bellevue, provided written comment regarding the Rethink Housing Action Plan. Dave Koenig, Everett, provided comments related to Council Bill 2108- 28. Joe Kunzler spoke about the Everett Transit Development Plan. 3  September 8, 2021 CONSENT ITEMS: Moved by Council Member Roberts, seconded by Council Member Murphy, to approve the following consent items: RESOLUTION - CLAIMS To adopt Resolution No. 7685 authorizing claims against the City of Everett in the amount of$ 1, 214, 858. 49 for the period of August 21, 2021, through August 27, 2021. PURCHASE— PLAYGROUND EQUIPMENT AND INSTALLATION To award and authorize purchase of playground equipment and installation from Buell Recreation LLC with the Purchase Order made to KCDA from KCDA 18- 315/ COE # 2018- 109 in the amount of $ 313, 424. 10, including Washington State sales tax. AGREEMENT AMENDED - PARKING MANAGEMENT SERVICES To authorize the Mayor to sign Amendment No. 1 to the Parking Management Services Agreement with the Downtown Everett Association. BID AWARD - HVAC MAINTENANCE & REPAIR SERVICES To award Invitation for Bid # 2021- 010 Heating, Ventilation and Air Conditioning HVAC) Maintenance & Repair Services to D. K. Systems, Inc for two ( 2) years, with three( 3) additional one- year extension options for approximately$ 250, 000 annually. AGREEMENT— WEB- BASED TRANSIT SERVICE PLANNING PLATFORM To award and authorize the Mayor to sign services agreement with Via Transportation, Inc., dba Remix Technologies LLC, for three years in the amount of$ 57, 000 per year, not including Washington State sales tax. 4  September 8, 2021 AGREEMENT- STRATEGIC ENERGY MANAGEMENT ( SEM) FUNDING To authorize the Mayor to sign the Strategic Energy Management ( SEM) Funding Agreement with Public Utility District No. 1 of Snohomish County governing participation in the Clean Water Energy Cohort Program. AGREEMENT— SEVERE STORM FEDERAL DISASTER DECLARATION GRANT To authorize the Mayor to sign the D21- 293 Public Assistance Grant Agreement allowing the City of Everett to seek reimbursement for 75% of approved costs related to damages from this disaster. AGREEMENT— TRANSIT INFRASTRUCTURE DESIGN To award and authorize the Mayor to sign a Professional Services Agreement with Elcon Associates, Inc. in the amount of$ 56, 810. 88. AGREEMENT AMENDED - ENERGY SMART INDUSTRIAL — WASTEWATER ENERGY COACHING To authorize the Mayor to sign Amendment No. 4 to Miscellaneous Service Contract No. CW2228764 MISC with Snohomish County PUD for Energy Smart Industrial —Wastewater Energy Coaching. RESOLUTION — SURPLUS FIRE ENGINE To adopt Resolution No. 7686 declaring a 1996 Emergency One Hurricane fire engine (J0012) surplus and authorizing sale at public auction. Melinda Adams, Transit, provided an overview of the development plan and annual report. Council Member Bader asked if additional information could be brought forward at a future date to discuss the shortfall for operating the Everett Station. Moved by Council Member Murphy, seconded by Council Member Roberts, to close the public hearing. Roll was called with all council members voting yes, except Council Members Tuohy and Moore who were excused. Motion carried. PUBLIC HEARING — COUNCIL BILL 2108- 28 7  September 8, 2021 President Stonecipher opened the public hearing regarding Council Bill 2108- 28, a proposed ordinance amending Title 19 ( Zoning) regarding Home Occupation Development regulations, amending Ordinance 3774- 20. There were no citizens who wished to speak. President Stonecipher stated Council would be taking public comment and the recommendation at this time is to extend the public hearing to a later date when staff is able to address amendments to the proposed ordinance. Discussion ensued regarding the following elements that need to be amended prior to adoption of the proposed ordinance: limitations on retail, parking, employee parking limits, and enforcement of regulations. Moved by Council Member Roberts, seconded by Council Member Bader, to table Council Bill 2108- 28. Roll was called with all council members voting yes, except Council Members Tuohy and Moore who were excused. Motion carried. President Stonecipher stated the public hearing would remain open to allow time for staff to revise the proposed ordinance and to present amendments. ACTION ITEMS: RESOLUTION - CLARIFICATION OF NEW LAW ENFORCEMENT STANDARDS AND REQUIREMENTS Moved by Council Member Bader, seconded by Council Member Murphy, to adopt Resolution No. 7689 requesting the Governor, the Washington State Legislature and State Attorney General assist in providing clarification of new Law Enforcement Standards and Requirements. 8  September 8, 2021 Roll was called with all council members voting yes, except Council Members Tuohy and Moore who were excused. COUNCIL BRIEFING AGENDA: A Resolution adopting the Rethink Housing Action Plan Presented by Becky Ableman- McCrary, Community, Planning, and Economic Development Discussion ensued regarding possible revenue streams, the rental market, mixed use of retail and housing, accessory dwelling units, duplexes in single- family neighborhoods, displacement strategy, implementation, and design guidelines. Council Members Roberts and Murphy asked for additional time to review the documents in the Rethink Housing Action Plan. President Stonecipher stated she would work with staff to schedule action prior to October 15, which is the date the plan is due to the Department of Commerce.
