Everett City Council

March 23, 2022 The regular meeting of the Everett City Council was called to order at 12: 30 p. m., March 23, 2022, by President Stonecipher. Upon roll call, it was found that Mayor Franklin and Council Members Rhyne, Schwab, Zarlingo and President Stonecipher were present. Council Member Fosse, Vogeli and Tuohy were excused. Council Member Rhyne led the Pledge of Allegiance. On behalf of the City Council, Council Member Schwab acknowledged the original inhabitants of this place, the sduhubs people and their successors, the Tulalip Tribes. APPROVAL OF MINUTES The minutes of March 9, 2022, were approved as printed. MAYOR Mayor Franklin congratulated Parks and Facilities Planning and Capital Development Manager, Chris Lark, on his retirement. COUNCIL Comments and liaison reports were provided by Council Members Rhyne, Schwab, Zarlingo, and President Stonecipher. Council Member Rhyne and Schwab discussed President Biden' s " Build Back Better" Act that was passed in November 2021. The Build Back better Bill provides funding, establishes programs, and otherwise modifies provisions relating to a broad array of areas, including education, labor, childcare, health care, taxes, immigration, and the environment. The grant funding opportunities are highly competitive and would require additional staff, internal or contract, for grant writing and funds granted. 1  March 23, 2022 Moved by Council Member Schwab, seconded by Council Member Rhyne, for Administration to create a proposal to bring to Council for discussion on the staff resources needed to manage the influx of grant opportunities, which could include contracting out for services for grant writing or hiring staff to manage grants and funds granted. Roll was called with all council members voting yes, except Council Member Fosse, Vogeli and Tuohy, who were excused. Motion carried. ADMINISTRATION UPDATE ON PRIOR BUSINESS Deputy Mayor Nick Harper had no updates. CITY ATTORNEY City Attorney David Hall had no updates. He requested a 25- minute Executive Session to discuss two ( 2) separate matters; a litigation matter, pursuant RCW 42. 30. 110( i) with Council action to follow; and a labor matter, pursuant RCW 42. 30. 140( 4) with no Council action to follow. PUBLIC COMMENT Deb Williams stated the Council received two ( 2) written comments, and there was one member of the public who wished to speak. RESOLUTION - CLAIMS To adopt Resolution No. 7755 authorizing claims against the City of Everett in the amount of$ 1, 471, 819. 86 for the period of March 5, 2022, through March 11, 2022. RESOLUTION — PAYROLL CLAIMS To adopt Resolution No. 7756 authorizing payroll claims against the City of Everett in the amount of$ 4, 423, 482. 05 for the period ending February 26, 2022. AGREEMENT — COMMUNITY- BASED INTERVENTIONS FOR INDIVIDUALS BEFORE EVERETT AND MARYSVILLE MUNICIPAL COURTS To authorize the Mayor to sign the Professional Services Agreement with the City of Marysville and Bridgeways in substantially the form provided. AGREEMENT AMENDMENT — DESIGN SERVICES FOR THE EVERETT MUNICIPAL BUILDING To authorize the Mayor to sign the Amendment No. 2 to the Professional Services Agreement with Mackenzie to provide design services for the Everett Municipal Building— Public Works Tenant Improvement Project. AGREEMENT — COMPLETION OF THE 1- 5 & US- 2 INTERCHANGE JUSTIFICATION REPORT ( IJR) PLANNING STUDY 3  March 23, 2022 To authorize the Mayor to sign the Local Agency A& E Professional Services Consultant Agreement with Parametrix for the completion of the 1- 5 & US- 2 Interchange Justification Report ( IJR) Planning Study in the amount of 2, 047, 633. CALL FOR BIDS— WATER MAIN REPLACEMENT " W" PROJECT To authorize Call for Bids for the Water Main Replacement " W" Project. CALL FOR BIDS— SILVER LAKE TRAIL PROJECT To authorize Call for Bids for the Silver Lake Trail Project. ACTION ITEMS: COUNCIL BILL 2203- 07 THIRD AND FINAL READING: AN ORDINANCE amending Ordinance No. 3804- 21 entitled " Fire Station No. 2 and Fire Station No. 6 Additions and Alterations," Fund 342, Program 029, to increase construction funds a total of$ 95, 000 for the project. Council President Stonecipher requested a briefing on water, sewer, and stormwater rate projections. Review draft Resolution establishing the City Council Rules of Procedure for the conduct of Council and repealing Resolution No. 7719. EXECUTIVE SESSION: The City Council recessed for an Executive Session at 2: 11 p. m. The Executive Session began at 2: 12 p. m. The Executive Session concluded at 2: 35 p. m. The City Council meeting reconvened at 2: 36 p. m. City Attorney David Hall provided an overview of a lawsuit settlement with Erin Kearney. SETTLEMENT— ERIN KEARNEY Moved by Council Member Zarlingo, seconded by Council Member Schwab, to authorize the Mayor to sign the settlement agreement with Erin Kearney in the amount of$ 32, 500.
