Everett City Council

March 30, 2022 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., March 30, 2022, by President Stonecipher. Upon roll call, it was found that Mayor Franklin and Council Members Fosse, Vogeli, Tuohy, Rhyne, Schwab, Zarlingo and President Stonecipher were present. Council Member Tuohy led the Pledge of Allegiance. On behalf of the City Council, Council Member Vogeli acknowledged the original inhabitants of this place, the sduhubs people and their successors, the Tulalip Tribes. APPROVAL OF MINUTES The minutes of March 23, 2022, were approved as printed. Council Members Fosse, Vogeli, and Tuohy abstained from the vote. MAYOR Mayor Franklin stated that the City is grieving the loss of fallen Officer Dan Rocha, who was tragically killed in the line of duty while protecting our community. She expressed her deepest condolences to his family and all who knew and loved him, including our police chief and the entire police team, who have lost a beloved co- worker and friend. Everyday our police officers bravely put themselves in harm' s way to keep everyone of us safe. Our community is heartbroken and honors Officer Rocha' s memory, legacy, and ultimate sacrifice in service to our city. Mayor Franklin stated the memorial service for Officer Dan Rocha will be held on Monday, April 4, 2022, at 1: 00 p. m. at the Angel of the Winds Arena. The service will be open to the public. A memorial fund has been set up to honor Officer Rocha' s memory, with donations going to support his family. She thanked Coastal Community Bank and Victim' s Support Services for assisting the City in setting up this fund, and the community for the outpouring of support they have shown for Officer Rocha' s this terrible tragedy. Further family and our police team as they process 1  March 30, 2022 information on donations and the memorial service are located on the City of Everett' s website. COUNCIL PURCHASE— FOUR FORD VEHICLES The City has spent over $ 250, 000 on this contract year-to-date on prior vehicle purchases. In compliance with the Procurement Policy, this purchase and any additional purchases from this contract will be brought before Council for award. Due to supply chain challenges, the cut- off date set by Ford to purchase 2022 vehicles off of the Washington State Department of Enterprise Services Contract 05916/ COE # 2018- 117 is March 31, 2022. Therefore, the authorization to purchase the vehicles is time sensitive. The City has an Interlocal Agreement with Washington State Department of Enterprise Services that allows for purchases from its competitively awarded contracts. Moved by Council Member Tuohy, seconded by Council Member Schwab, to award and authorize the purchase of four Ford vehicles with Clary Longview, LLC., dba Bud Clary Ford — Hyundai from Washington State Department of Enterprise Services Contract# 05916/ COE # 2018- 117. Roll was called with all council members voting yes. Motion carried. President Stonecipher notified the public that Agenda Items # 16 and # 17 were pulled from the meeting agenda and would be discussed at later meetings. President Stonecipher announced that due to current events within the community, City officials have decided to postpone in- person council meetings until further notice. 2  March 30, 2022 Council Members expressed their deepest condolences on the tragic loss of Officer Dan Rocha, and their gratitude for his service and the ultimate sacrifice he made to keep our community safe. Comments and liaison reports were provided by Council Members Fosse, Vogeli, Tuohy, Rhyne, Schwab, Zarlingo and President Stonecipher. ADMINISTRATION Lori Cummings stated, on behalf of the City staff, that we are grieving and honor Officer Rocha' s ultimate sacrifice while serving our community. We stand ready, as a City team, to support and assist our Police Department in any way we can. Lori also reminded the public that Mayor Franklin with be delivering her State of the City address tomorrow, Thursday, March 31, 2022. CITY ATTORNEY City Attorney David Hall had no updates. PUBLIC COMMENT Deb Williams stated Council received one ( 1) written comment, and there were 2) members of the public who wished to speak. Harry Willis: Vaccination Requirement Concerns within the City of Everett, and Gender- Neutral Bathrooms John Ogorsolka: Agenda Item # 14 — Contract Award — Evergreen Pump Station Modifications Project CONSENT ITEMS: Moved by Council Member Tuohy, seconded by Council Member Rhyne, to approve the following consent items: RESOLUTION — CLAIMS 3  March 30, 2022 To adopt Resolution No. 7760 authorizing claims against the City of Everett in the amount of $1, 545, 473. 57 for the period of March 12, 2022, through March 18, 2022. RESOLUTION — PAYROLL CLAIMS To adopt Resolution No. 7761 authorizing payroll claims against the City of Everett in the amount of$ 4, 549, 017. 74 for the period ending March 12, 2022. AGREEMENT— TRANSIT EDUCATION AND FIELD TRIP PROGRAM To authorize the Mayor to sign the Agreement for Transit Education and Field Trip Program with Imagine Children' s Museum in the amount of $ 24, 000 annually. AGREEMENT— WATER QUALITY COMBINED FINANCIAL ASSISTANCE To authorize the Mayor to sign the Water Quality Combined Financial Assistance Agreement with the Washington State Department of Ecology in the amount not to exceed $ 255, 153. ACCEPTANCE— MS. KATHERINE HUFFENDICK FOR THE FUND FOR ANIMALS To approve the mayor' s acceptance of a $ 11, 494 bequest from the Katherine Huffendick Charitable Trust for the Fund for the Animals ( Fund 151). RFP AWARD— PARKS PARTNERSHIPS FOR CONSESSION SERVICES To award and authorize the Mayor to sign a contract for Concession Services at Phil Johnson Ballfields to Schnack Shack, LLC. Based on Proposal # 2021- 090 General RFP for Parks Partnerships RESOLUTION — SDR9 DUCTILE IRON PIPE SIZE HDPE SURPLUS AND SALE 4  March 30, 2022 To adopt Resolution No. 7762 declaring 1, 360 feet of 12- inch SDR9 ductile iron pipe size HDPE surplus and authorizing the sale to the Port of Everett in the amount of$ 47, 287. 20, plus Washington State Sales Tax. MEMORANDUM OF UNDERSTANDING — WASHINGTON STATE PATROL WSP) INTERAGENCY BOMB SQUAD To authorize the Mayor to sign the Memorandum of Understanding establishing the Everett Police Department as a member agency of the WSP Interagency Bomb Squad. PROPOSED ACTION ITEMS: COUNCIL BILL 2203- 09 SECOND READING: AN ORDINANCE creating a Special Improvement Project entitled, " 415t Street to Rucker Avenue Corridor Phase 2," Fund 303, Program 123, and repealing Ordinance No. 3836- 21. COUNCIL BILL 2203- 10 SECOND READING: AN ORDINANCE creating a Special Improvement Project entitled, " Water Filtration Plant ( WFP) Phase 2 Capital Upgrades," Fund 336, Program 021. 5  March 30, 2022 Discussion followed with Public Works Director Ryan Sass responding to Council questions. Council Member Rhyne requested a list of projects included in the WFP Phase 2 Capital Upgrades. PUBLIC HEARING— COMMUNITY SOLAR PROPERTY LEASE President Stonecipher opened the public hearing regarding the Community Solar Property Lease with Snohomish County PUD. Suzy Oversvee from Snohomish County PUD, and Ryan Sass, Public Works Director gave a brief presentation on the project' s roles, objectives, and outcomes; how the project can provide relief for individuals dependent on energy ( PRIDE); and site considerations and details. There were no members of the public who wished to speak. Moved by Council Member Fosse, seconded by Council Member Vogeli, to close the public hearing. Roll was called with all council members voting yes. Motion carried. RESOLUTION & PROPERTY LEASE— COMMUNITY SOLAR PROPERTY LEASE To adopt Resolution No. 7759 and authorize the Mayor to sign the Community Solar Property Lease with Snohomish County PUD in the form substantially provided. Discussion followed among Council Members Fosse, Vogeli, Tuohy, Rhyne, Schwab, Zarlingo and President Stonecipher. Moved by Council Member Vogeli, seconded by Council Member Fosse, to adopt Resolution No. 7759 and authorize the Mayor to sign the Community 6  March 30, 2022 Solar Property Lease with Snohomish County PUD in the form substantially provided. ACTION ITEMS: GRANT APPLICATION — 2023 CONGRESSIONALLY DIRECTED SPENDING Moved by Council Member Rhyne, seconded by Council Member Tuohy, to authorize city staff to apply for and the Mayor to approve and sign all documents relating to the 2023 Congressionally Directed Spending, including all documents related to acceptance of the grant. Discussion followed among Council Members Fosse, Vogeli, Tuohy, Rhyne, Schwab, Zarlingo and President Stonecipher. Roll was called with all council members voting yes. Motion carried. GRANT APPLICATION — 2022 LOW- NO AND 2022 BUS AND BUS FACILITIES Moved by Council Member Vogeli, seconded by Council Member Tuohy, to authorize city staff to apply for and the Mayor to approve and sign all documents relating to the 2022 Low- No and 2022 Bus and Bus Facilities for 16, 575,000 and all documents related to acceptance of the grant. Roll was called with all council members voting yes. Motion carried. 7  March 30, 2022 CONTRACT AWARD— EVERGREEN PUMP STATION MODIFICATIONS PROJECT Moved by Council Member Vogeli, seconded by Council Member Tuohy, to reject MSI claim of error, accept the MSI bid, and award the contract for the Evergreen Pump Station Modifications to MSI in the amount of $4, 863, 152. 90, and, in the case of MST' s failure to execute the contract as required, authorize the Mayor ( 1) to accept Alia bid and award contract to Alia in the amount of 5, 480, 782. 29, and ( 2) to take all necessary steps to enforce MST' s bid bond. RESOLUTION — 2022 SURFACE WATER COMPREHENSIVE PLAN Moved by Council Member Rhyne, seconded by Council Member Tuohy, to adopt Resolution No. 7758, approving the City of Everett 2022 Surface Water Comprehensive Plan. Roll was called with all council members voting yes. Motion carried. RESOLUTION — COUNCIL RULES & PROCEDURES This item was pulled from the agenda.
