Everett City Council

April 13, 2022 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., April 13, 2022, by President Stonecipher. Upon roll call, it was found that Mayor Franklin and Council Members Tuohy, Rhyne, Schwab, Fosse, Zarlingo, Vogeli, and President Stonecipher were present. Council Member Tuohy led the Pledge of Allegiance. On behalf of the City Council, Council Member Fosse acknowledged the original inhabitants of this place, the sduhubs people and their successors, the Tulalip Tribes. APPROVAL OF MINUTES The minutes of April 6, 2022, were approved as printed. MAYOR Mayor Franklin recommended that the following applicants be appointed to a City of Everett Board or Commission. Each candidate has been interviewed by staff. Attributes, including equity, geographic location, diversity of thought, and applicable background were taken into consideration with each appointment. APPOINTMENTS/ RE- APPOINTMENTS Moved by Council Member Tuohy, seconded by Council Member Zarlingo, to concur with the following appointments: Everett Historical Commission POS 7, Theresa Gemmer: 6— year term POS 8, Ashli Bush: 6— year term Roll was called with all council members voting yes. Motion carried. 1  April 13, 2022 COUNCIL President Stonecipher noted that she will be absent at the next Council meeting. Council Member Tuohy will preside over next week' s meeting. President Stonecipher stated that as the Council Rules and Procedures were passed at last week' s council meeting, the election for Council Vice President will appear on the agenda for the April 27, 2022, Council meeting and will be sending out instructions for the nomination and election process. Comments and liaison reports were provided by Council Members Tuohy, Rhyne, Schwab, Fosse, Zarlingo, Vogeli, and President Stonecipher. ADMINISTRATION Lori Cummings stated that a summary of information will be sent to Council in the coming days regarding the recently signed Move Ahead Washington Transportation Package, which is an unprecedented direct funding opportunity for public transportation. Transit agencies must adopt a fair-free policy for all customers, ages 18 years and younger by October 1, 2022, to be eligible for this program. CITY ATTORNEY City Attorney David Hall had no updates. He requested a 40- minute Executive Session to discuss four ( 4) litigation matters, pursuant RCW 42. 30. 110( 1)( i), with potential council action to follow on one ( 1) of those matters. PUBLIC COMMENT Deb Williams stated Council received no written comments, and there was one member of the public who wished to speak. Joe Rzeczkowski— Homelessness Concerns and Public Safety 2  April 13, 2022 CONSENT ITEMS: Moved by Council Member Tuohy, seconded by Council Member Vogeli, to approve the following consent items: RESOLUTION — CLAIMS To adopt Resolution No. 7766 authorizing claims against the City of Everett in the amount of $ 506, 862. 57 for the period of March 26, 2022, through April 1, 2022. RESOLUTION — PAYROLL CLAIMS To adopt Resolution No. 7767 authorizing payroll claims against the City of Everett in the amount of$ 4, 391, 973. 04 for the period ending March 26, 2022. AGREEMENT AMENDMENT— JETTY ISLAND FERRY SERVICE To authorize the Mayor to sign Amendment No. 3 to contract# 2018- 009 for Jetty Island Ferry Service to Argosy, LLP. REQUEST FOR PROPOSAL— TRIPLE COMBINATION PUMPERS To authorize the Request for Proposals ( RFP) # 2022- 023 Triple Combination Pumpers. AGREEMENT— POLICE IN- SERVICE TRAINING SESSIONS To authorize the Mayor to sign Interlocal Government Agreement for Police In- Service Training Sessions in the amount of$ 1, 600. 00 annually. Motion carried. 3  April 13, 2022 PROPOSED ACTION ITEMS: COUNCIL BILL 2203- 12 SECOND READING: AN ORDINANCE creating a Special Improvement Project entitled, " Everett Smelter Draining," Fund 336, Program 028. COUNCIL BILL 2203- 13 SECOND READING: AN ORDINANCE closing a Special Improvement Project entitled, " Jackson Park Area Stormwater Separation and Treatment," Fund 336, Program 012, as established by Ordinance No. 3745- 20. ACTION ITEMS: COUNCIL BILL 2203- 11 THIRD AND FINAL READING: AN ORDINANCE approving the appropriation of the 2022 revised City of Everett Budget and amending Ordinance no. 3838- 21. Moved by Council Member Tuohy, seconded by Council Member Vogeli, that this is declared to be the third and final reading of Council Bill No. 2203- 11. The City Clerk was directed to call the roll for the final deposition of the Ordinance. Discussion followed with Principal Engineer, Tom Hood, responding to questions from Council Members Tuohy, Rhyne, Schwab, Fosse, Zarlingo, Vogeli, and President Stonecipher. Roll was called with all council members voting yes. Motion carried. COUNCIL BRIEFING AGENDA: EVERETT POLICE DEPARTMENT STUDY UPDATE Presented by: Police Chief Dan Ternpleman and Richard Brady from Matrix Consulting Group Discussion followed among Council Members Tuohy, Rhyne, Schwab, Fosse, Zarlingo, Vogeli, and President Stonecipher. EXECUTIVE SESSION: The City Council recessed for an Executive Session at 8: 00 p. m., began the Executive Session at 8: 01 p. m. The Executive Session concluded at 8: 41 p. m. The City Council meeting reconvened at 8: 44 p. m. City Attorney David Hall provided an overview of a lawsuit settlement with Jay Taylor. 5  April 13, 2022 SETTLEMENT— JAY TAYLOR Moved by Council Member Zarlingo, seconded by Council Member Tuohy, to authorize the Mayor to sign the settlement agreement with Jay Taylor in the amount of$ 356, 160. 44.
