April 27, 2022 The regular meeting of the Everett City Council was called to order at 12: 30 p. m., April 27, 2022, Council President Stonecipher presiding. Upon roll call, it was found that Mayor Franklin and Council Members Fosse, Rhyne, Schwab, Vogeli, Zarlingo, Stonecipher, and Tuohy were present. On behalf of the City Council, President Stonecipher acknowledged the original inhabitants of this place, the sduhubs people, and their successors, the Tulalip Tribes. Council Member Rhyne led the Pledge of Allegiance. The minutes of the April 20, 2022, City Council meeting were approved as printed. MAYOR Mayor Franklin stated that the City is observing Workers' Memorial Day, and Council Member Fosse will be reading a proclamation under her comments. COUNCIL Comments and liaison reports were provided by Council Members Fosse, Rhyne, Schwab, Vogeli, Zarlingo, Stonecipher, and Tuohy. Council Member Fosse read a proclamation recognizing April 28, 2022, as Workers' Memorial Day. ADMINISTRATION UPDATE ON PRIOR BUSINESS Administration had no comments. 1  April 27, 2022 CITY ATTORNEY City Attorney David Hall requested a 25- minute executive session regarding two legal matters pursuant to RCW 42. 31. 110 ( 1)( i), with a possible announcement to follow on one of the matters. PUBLIC COMMENT There were no people who wished to speak under Public Comment. CONSENT ITEMS: Moved by Council Member Zarlingo, seconded by Council Member Rhyne, to approve the following consent items: PURCHASE - 2022 POLARIS COMMERCIAL RANGER VEHICLE To award and authorize purchase of one ( 1) 2022 Polaris Commercial Ranger Vehicle from Raymond Handling Concepts from the Washington State Department of Enterprise Services Contract # 05916/ COE # 2018- 117 for a total of$ 34, 028. 59, including Washington state sales tax. AGREEMENT AMENDED - OWNER ADVISOR SERVICES To authorize the Mayor to sign Amendment No. 1 to the Professional Services Agreement with Brown and Caldwell for Owner Advisor services related to procurement of a Progressive Design- Build contractor for Reservoir 3 structural repairs. GRANT APPLICATION - LIBRARY CAPITAL IMPROVEMENT PROGRAM To authorize city staff to apply for and the Mayor to approve and sign all documents relating to the Library Capital Improvement Program Grant and all documents related to acceptance of the grant. 2  April 27, 2022 Roll was called with all council members voting yes. Motion carried. ACTION ITEMS: ELECTION — 2022 COUNCIL VICE PRESIDENT President Stonecipher opened the nominations for Council Vice President for 2022. Council Member Zarlingo nominated Council Member Tuohy. Council Member Fosse nominated Council Member Rhyne. The City Clerk took the roll, and four votes were cast for Council Member Tuohy, and three votes were cast for Council Member Rhyne. Council Member Tuohy held the majority and was elected Vice President for the year 2022. RESOLUTION — ABATEMENT COSTS AT 2010 LEXINGTON AVENUE Moved by Council Member Vogeli, seconded by Council Member Schwab, to adopt Resolution No. 7769 authorizing recovery of abatement costs pursuant to EMC 1. 20. 090 at 2010 Lexington Avenue. Roll was called with all council members voting yes. Motion carried. 3  April 27, 2022 APPLICATION — TWO DAY BOATING REGATTA ON SILVER LAKE Discussion ensued regarding the request to approve the Seattle Outboard Association application to hold a two- day boating regatta on Silver Lake on June 4 and 5, 2022. Moved by Council Member Zarlingo, seconded by Council Member Fosse, to amend the special use permit to only one day, June 4, 2022. Roll was called with Council Members Zarlingo and Schwab voting yes and Council Members Tuohy, Vogeli, Rhyne, Fosse, and Stonecipher voting no. Motion Failed. Moved by President Stonecipher, seconded by Council Member Fosse, to amend the approval to include reporting requirements from the Seattle Outboard Association post- event. Roll was called with all council members voting yes. Motion carried. Moved by Council Member Tuohy, seconded by Council Member Rhyne, to approve the Seattle Outboard Association application to hold a two- day boating regatta on Silver Lake on June 4 and 5, 2022, as amended. Roll was called with all council members voting yes, except Council Member Zarlingo, who voted no. Motion carried. 4  April 27, 2022 AGREEMENT— SCOOTER SHARE PROGRAM Moved by Council Member Vogeli, seconded by Council Member Tuohy, to authorize the Mayor to sign the contract with Bird Rides, Inc. to operate a Scooter Share Program within the City of Everett. Roll was called with all council members voting yes. Motion carried. EXECUTIVE SESSION The City Council recessed for an executive session at 2: 12 p. m., began the executive session at 2: 14 p. m., and reconvened at 2: 39 p. m. AGREEMENT— TRAFFIC COLLISION SETTLEMENT Moved by Council Member Tuohy, seconded by Council Member Vogeli, to authorize the Mayor to sign the settlement agreement with Allstate Insurance on behalf of their client Catherine Zamperin regarding a traffic collision with a city vehicle in the amount of$ 5, 985. 26.
