Everett City Council

May 4, 2022 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., May 4, 2022, Council President Stonecipher presiding. Upon roll call, it was found that Council Members Rhyne, Vogeli, Zarlingo, Tuohy, Fosse, Schwab, and Stonecipher were present. Mayor Franklin was excused. Council Member Schwab led the Pledge of Allegiance. On behalf of the City Council, Council Member Zarlingo acknowledged the original inhabitants of this place, the sduhubs people and their successors, the Tulalip Tribes. APPROVAL OF MINUTES The minutes of April 27, 2022, were approved as printed. MAYOR Mayor Franklin was excused. PUBLIC COMMENT Deb Williams stated Council received no written comments, and there was one ( 1) member of the public who wished to speak. Brock Howell: Agenda Item No. 6 — Call for Bids; and Smith Avenue shooting that occurred on May 3, 2022. COUNCIL Comments and liaison reports were provided by Council Members Rhyne, Vogeli, Zarlingo, Tuohy, Fosse, Schwab, and Stonecipher. President Stonecipher reminded the public that the Wendt and Mayor' s Arts Awards will be presented Thursday, May 12, 2022 at the Everett Performing Arts 1  May 4, 2022 Center at 6: 00 p. m. The recipient of the Wendt Award is Rob Hunt, the Executive Producer at Village Theatre. ADMINISTRATION Administration acknowledged the Wendt Award recipient Rob Hunt and the contributions he' s made. CITY ATTORNEY City Attorney David Hall had no updates. He requested a 15- minute Executive Session to discuss one litigation matter, pursuant RCW 42. 30. 110( 1)( i), with potential council action to follow. CONSENT ITEMS: Moved by Council Member Vogeli, seconded by Council Member Tuohy, to approve the following consent items: RESOLUTION — CLAIMS To adopt Resolution No. 7770 authorizing claims against the City of Everett in the amount of $ 1, 680, 977. 46 for the period of April 9, 2022 through April 15, 2022. RESOLUTION — CLAIMS To adopt Resolution No. 7771 authorizing claims against the City of Everett in the amount of $4, 075,458. 00 for the period of April 16, 2022 through April 22, 2022. RESOLUTION — PAYROLL To adopt Resolution No. 7772 authorizing payroll claims against the City of Everett in the amount of$ 4,465, 085. 89 for the period ending April 9, 2022. 2  May 4, 2022 AGREEMENT AMENDMENT— AQTRN BUS- 1719- COE- 0005 To authorize the Mayor to sign Amendment No. 1 to agreement No. AQTRNBUS- 1719- COE- 0005 between the State of Washington Department of Ecology and City of Everett. AGREEMENT AMENDMENT- 2022 HIGH VISIBILITY ENFORCEMENT GRANT To authorize the Mayor to sign Amendment No. 1 to the Interagency Agreement with Washington Traffic Safety Commission regarding the 2022 High Visibility Enforcement Grant. CALL FOR BIDS — INTERURBAN TRAIL TO YMCA PEDESTRIAN IMPROVEMENTS PROJECT To authorize a Call for Bids for the Interurban Trail to YMCA Pedestrian Improvements Project. AGREEMENT AMENDMENT — POST JOB OFFER PHYSICALS WITH VERA CLINIC To authorize the Mayor to sign Amendment No. 2 to the Vera Clinic Agreement to add post-job offer physicals as a clinic service. LETTER OF SUPPORT— EMERGENCY WITHDRAWL REQUESTS To authorize the Mayor to sign the letter directing MissionSquare ( formerly ICMA- RC) to process and administer emergency withdrawal requests on behalf of participants in the City of Everett' s 457( b) Deferred Compensation Plan. Roll was called with all council members voting yes. Motion carried. 3  May 4, 2022 ACTION ITEMS: AGREEMENT— DESIGN BUILD FOR THE WATER FILTER PLANT PHASE 2 To select IMCO General Construction as Design Builder, award and authorize the Mayor to sign the Design Build Contract for the Water Filter Plant Phase 2 Capital Upgrades Project to IMCO General Construction in the amount of$ 2, 723, 318. 68, in substantially the form provided. Roll was called with all council members voting yes. Motion carried. PROPOSED ACTION ITEMS COUNCIL BILL 2204- 14 FIRST READING AN ORDINANCE amending Ordinance No. 3136- 09 and reading Ordinance No. 2682- 03. EXECUTIVE SESSION The City Council recessed for an Executive Session at 6: 55 p. m., began the Executive Session at 6: 57 p. m. The Executive Session concluded at 7: 12 p. m. The City Council meeting reconvened at 7: 12 p. m. City Attorney David Hall provided an overview of a lawsuit settlement with Phoenix Law. SETTLEMENT— PHOENIX LAW 4  May 4, 2022 Moved by Council Member Tuohy, seconded by Council Member Vogeli, to authorize the Legal Department to tender the remainder of the SIR to Star Insurance for case settlement, and authorize the Mayor to execute any documents that are necessary for the settlement.
