City of Excelsior Hennepin County, Minnesota MINUTES EXCELSIOR CITY COUNCIL MEETING October 1, 2018 Council Chambers 6:30 p.m. 1. CALL TO ORDER Mayor Gaylord called the meeting to order at 6:32 p.m. 2. ROLL CALL Present: Councilmembers Beattie, Caron, Miller, Mayor Gaylord Absent: Councilmember Carlson Also Present: City Manager Luger, City Attorney Staunton, Consulting City Planner Richards, Public Works Superintendent Amundsen, and City Clerk Orlofsky 3. APPROVAL OF MINUTES (a) September 17, 2018 Work Session Minutes Beattie moved, Caron seconded, to approve the September 17, 2018 Work Session Minutes. Motion carried 4/0. (b) September 17, 2018 City Council Minutes Beattie moved, Caron seconded, to approve the September 17, 2018 City Council Minutes as amended. Motion carried 4/0. 4. OPEN FORUM (a) None Bernard Hansen, 365 College Avenue, addressed the City Council. 5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS (a) Excelsior Fire District Board Meeting Miller provided the Excelsior Fire District Update. (b) 810 Excelsior Boulevard Staunton provided an update on the 810 Excelsior Boulevard property. (c) Mill Street Update Amundsen provided the Mill Street Update. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS – CONTINUED (c) Minnetonka Homecoming Parade Gaylord provided an update on the Minnetonka Homecoming Parade. 6. AGENDA APPROVAL (a) Meeting Agenda Beattie moved, Caron seconded, to add item 12(c) Request from Protect MN to the Regular Agenda and approve the September 4, 2018 City Council Agenda as amended. Motion carried 4/0. (b) Consent Agenda Beattie moved, Caron seconded, to continue Item 6(b)3 Continuation of Second Reading of PUD Ordinance until the October 15, 2018 City Council Meeting, and to approve the consent agenda as amended. Motion carried 4/0. 1. Approve Verified Claims - Approve for Payment Manual Checks 084622 – 084650 and E-Checks 1699-1715 Action – Approved for Payment Manual Checks 084622 – 084650 and E-Checks 1699-1715. 2. Public Works Mutual Aid Agreement Action – Approved the Resolution 2018-36 – A Resolution authorizing the Mayor and City Manager to enter into a Joint Power Mutual Aid Agreement for Public Works. 3. Continuation of Second Reading of PUD Ordinance Action – Removed from consent and continued the Second Reading of PUD Ordinance to the October 15, 2018 City Council Meeting. 4. Excelsior Elementary Halloween Parade 2018 Action- Approved the Special Event Permit for Excelsior Elementary Halloween Costume Parade. 5. Approve Resolution 2018-35 – A Resolution Calling for Public Hearing on Assessment for 2017 Street and Utility Improvements Action – Adopted Resolution No. 2018-35 – A Resolution Declaring Cost to be Assessed, Ordering Preparation of Proposed Assessment, and Calling for Public Hearing on Assessments for 2017 Street and Utility Improvement project. 6. Appointing Election Judges for 2018 General Election Action – Adopted Resolution 2018-37 – A Resolution Appointing Judges to Serve at the 2018 Primary and General Election. PETITIONS, REQUESTS and COMMUNICATIONS (a) Update from Hennepin County Sheriff Stanek Sheriff Stanek, Hennepin County Sheriff, addressed the City Council. (b) Tommy’s Tonka Trolley Partnership Dean and Becky Salita, new partners with Tommy’s Tonka Trolley, addressed the City Council. 9. ORDINANCES and RESOLUTIONS (a) Second Reading of Ordinance No. 581 – An Ordinance Regulating Tobacco Licensing Beth Kennedy, Family Physician, addressed the City Council. Ruth Tripp, Hennepin County Local Health, addressed the City Council. Beattie moved, Caron seconded, to waive the second reading of Ordinance No. 581, An Ordinance Regulating Tobacco Licensing, and directed staff to look at limiting the number of licenses within the City. Motion carried 4/0. 10. REPORTS of OFFICERS, BOARDS, and COMMITTEES (a) None 11. UNFINISHED BUSINESS (a) None 12. NEW BUSINESS (a) The Commons Concert Series Program Agreement with the Rotary Deb Rodgers, with Community for The Commons, addressed the City Council. Eric Snyder, with Community for The Commons, addressed the City Council. Beattie moved, Caron seconded, to approve the language as stated and to send to the Lake Minnetonka Excelsior Rotary Club Board. Motion carried 4/0. (b) Vacant Council Seat Appointment Process Beattie moved, Miller seconded, to continue this item to the October 15, 2018 City Council Meeting. Motion carried 4/0. NEW BUSINESS – CONTINUED (c) Request from Protect MN to extend their portable restroom pick up date Beattie moved, Caron seconded, to amend the event permit extending the portable restroom pickup date.
