CALL TO ORDER Acting Mayor Miller called the meeting to order at 6:32 p.m. 2. ROLL CALL Present: Councilmembers Beattie, Caron, Miller, Mayor Gaylord Absent: Mayor Gaylord Also Present: City Manager Luger, City Attorney Staunton, Consulting City Planner Richards, Public Works Superintendent Amundsen, and City Clerk Orlofsky 3. APPROVAL OF MINUTES (a) October 1, 2018 Work Session Minutes Beattie moved, Caron seconded, to approve the October 1, 2018 Work Session Minutes. Motion carried 4/0. (b) October 1, 2018 Regular City Council Minutes Beattie moved, Caron seconded, to approve the October 1, 2018 City Council Minutes as amended. Motion carried 4/0. 4. OPEN FORUM (a) Charlie Kanan, Rotary Member, addressed the City Council. (b) Kelly Morrison, Running for State Representative, addressed the City Council. 5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS (a) Update from Senator Osmek Senator Osmek provided an update on the Legislative Session. (b) 810 Excelsior Boulevard Staunton provided an update on the 810 Excelsior Boulevard property. AGENDA APPROVAL (a) Meeting Agenda Beattie moved, Carlson seconded, to approve the October 15, 2018 City Council Agenda. Motion carried 4/0. (b) Consent Agenda Beattie moved, Carlson seconded, to approve the October 15, 2018 Consent Agenda. Motion carried 4/0. 1. Approve Verified Claims - Approve for Payment Manual Checks 084651 – 084693 Action – Approved for Payment Manual Checks 084651 – 084693. 2. August Financial Report Action – Accepted reports for filing. 3. Authorize Interfund Transfers Resolution No. 2018-39 Action – Adopted Resolution 2018-39 – A Resolution Authorizing Interfund Transfers. 4. Adopt Resolution 2018-41 Amendments to the Fee Schedule Action- Adopted Resolution No. 2018-41 – A Resolution Setting License and Permit Fees and Utility Rates. 5. 2018 Hennepin County Hazard Mitigation Plan Action – Adopted Resolution 2018 – 40 – A Resolution Adopting the Hennepin County All-Hazard Mitigation Plan. 6. Construction Management Ordinance Action – Waived the first reading and scheduled the second reading for the November 5, 2018 City Council meeting of Ordinance No. 582 – An Ordinance to Amend Article 10, Section 10-6 of the Excelsior City Code of Ordinances Pertaining to Amending the Construction Management Ordinance Provisions on Escrow Accounts, Public Notification and Construction Signs. 7. Approve the Program Agreement for The Commons Concert Series Action – Approved the Program Agreement for The Commons Concert Series. Minutes City Council Meeting October 15, 2018 Page 3 7. PUBLIC HEARINGS (a) Assessment Hearing for Unpaid Utilities and Other Charges Councilmember Caron recused herself from this item. Acting Mayor Miller opened the public hearing at 6:53 p.m. Hearing no comments from the public, Acting Mayor Miller closed the public hearing at 6:54 p.m. Carlson moved, Beattie seconded, to adopt Resolution No. 2018-42 – A Resolution Levying Assessments for Costs Incurred by the City for Delinquent Utilities and other charges. Motion carried 3/0. 8. PETITIONS, REQUESTS and COMMUNICATIONS (a) Request for Additional On-Sale Wine License Beattie moved, Carlson seconded, to direct staff to draft an ordinance to bring back to the Council at the November 5, 2018 City Council Meeting. Motion carried 4/0. 9. ORDINANCES and RESOLUTIONS (a) Second Reading of PUD Ordinance and Garage Definitions Matthew Duffy, Attorney for Maynard’s, addressed the City Council. Julie Thunderberg, 834 Third Avenue, Apt 102, addressed the City Council. Beattie moved, Caron seconded, to amend Appendix E, Articles 2 and 65 of the Excelsior City Code regarding definitions for garages and to bring back the PUD Ordinance for review at the January 7, 2019 City Council Meeting. Motion carried 4/0. 10. REPORTS of OFFICERS, BOARDS, and COMMITTEES (a) Great River Greening Cooperative Agreement Carlson moved, Beattie seconded, to approve the Great River Greening Cooperative Agreement and authorize the City Manager to sign the agreement on behalf of the City of Excelsior. Motion carried 4/0. 11. UNFINISHED BUSINESS (a) Vacant Council Seat Appointment Process Beattie moved, Caron seconded, to leave the process for filling a Council vacancy as it is laid out in the Minnesota Statutes. NEW BUSINESS (a) Conflict of Interest Policy Caron moved, Carlson seconded, to direct staff to look at incorporating the code of conduct into the bylaws and to include a paragraph with language around a process around disclosures, and to require a new council member to attend the League of Minnesota Cities orientation for newly elected or appointed officials.
