EXCELSIOR SPECIAL MEETING
October 25, 2018

1. CALL TO ORDER
Mayor Gaylord called the meeting to order at 6:30 p.m.
2. ROLL CALL
Present: Councilmembers Beattie, Carlson, Caron (arrived at 6:33 p.m.)
Miller, Mayor Gaylord
Absent: None
Also Present: City Manager Luger, City Engineer Dawley, Finance Officer Horn,
and City Clerk Orlofsky
3. APPROVAL OF AGENDA
(a) Meeting Agenda
Beattie moved, Carlson seconded, to approve the October 25, 2018 City
Council Agenda. Motion carried 4/0.
(b) Consent Agenda
Beattie moved, Carlson seconded, to approve the consent agenda. Motion
carried 4/0.

4. PUBLIC HEARING
(a) 2017 Street and Utility Improvement Project
Dawley presented the 2017 Utility Improvement Project area, costs, and the
proposed assessment roll.
Mayor Gaylord, opened the public hearing at 6:50 p.m.
Patrick Foss, 347 Second Street, stated he would like to dispute his
assessment because he feels the frontage computation was miscalculated for
his parcel. He asked how the City arrived at the square footage it has for
the proposed assessment.

Dawley explained that the calculation was taken from Hennepin County’s property
information and said that he would double check that their information is accurate.
Caron asked if the County Property Records are the only method used to measure the
square footage.
Dawley explained that it is the most common practice amongst cities in Hennepin
County.
Miller asked when the letter was sent out to residents and what information was
provided.
Orlofsky explained that letters were mailed no less than 10 days prior to the hearing,
and each letter identified the proposed assessment amount and map of the proposed
assessed area. Dawley added that staff follows the guidelines that are suggested by
the League of Minnesota Cities.
Caron asked if the City includes a copy of the assessment roll with the letter and
map. Orlofsky explained that staff did not include the entire roll for this mailing but
would certainly do that in the future.
Dawley said that he would verify Hennepin County’s records on the parcel at 347
Second Street and get back to the property owner with an answer.
Gaylord read letters from the following property owners:
Tim Brandow, 420 Second Street and 406 Second Street, sent an email to the City
Manager stating that he would like to dispute his assessment for two properties. His
letter explained that he had recently paid for a new sidewalk and trees with grates
along his entire street frontage because they were destroyed during the construction
phase of this project. He did not appreciate the poor workmanship by the construction
crews.
Seyed Mirsharif, 421 Third Street, sent an email stating that he would like to dispute
his assessment with the City. He was disappointed in the workmanship of the
construction crews during the improvement project and attached photos to his letter
for examples.
Beattie asked staff to verify the computation of the properties on all properties in
question. Dawley replied that he would do that.
Hearing no further comments from the public, Mayor Gaylord closed the public
hearing at 7:25 p.m.
Beattie moved, Carlson seconded, to accept the following letters of appeal for these
four properties: 347 Second Street, 406 Second Street and 420 Second Street, and
421 Third Street, properties that have submitted a letter of appeal this evening.
