CALL TO ORDER Mayor Gaylord called the meeting to order at 6:32 p.m. 2. ROLL CALL Present: Councilmembers Carlson, Caron, Miller, and Mayor Gaylord Absent: Councilmember Beattie Also Present: City Manager Luger, City Attorney Staunton, Consulting City Planner Richards, Public Works Superintendent Amundsen, Finance Officer Horn, City Planner Becker, and City Clerk Orlofsky 3. APPROVAL OF MINUTES (a) October 15, 2018 Work Session Minutes Carlson moved, Caron seconded, to approve the October 15, 2018 Work Session Minutes. Motion carried 3/0. (b) October 15, 2018 Regular City Council Minutes Carlson moved, Caron seconded, to remove the October 15, 2018 City Council minutes to be amended. Motion carried 4/0. 4. OPEN FORUM (a) None 5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS (a) 810 Excelsior Boulevard Staunton provided an update on the 810 Excelsior Boulevard property. 6. AGENDA APPROVAL (a) Meeting Agenda Carlson moved, Caron seconded, to add item 12(d) Pavement Management Plan to the Regular Agenda and to approve the November 5, 2018 Agenda as amended. Approve Verified Claims - Approve for Payment Manual Checks 084716 – 084754 Action – Approved for Payment Manual Checks 084716-084754. 2. September Financial Statement Action – Accepted for filing. 3. October Building Permit Report Action – Accepted for filing. 4. Second Reading of the Construction Management Ordinance Action- Approved the second reading and adopted ordinance No. 582, an Ordinance to amend Appendix E, Article 10, Section 10-6 as it relates to requirements for the Construction Management Ordinance provisions on escrow accounts, public notification, and construction signs. 5. 2019 North American Pond Hockey Tournament Action – Approved the Special Event Permit for the 2019 North American Pond Hockey Tournament the weekend of January 17 – 20, 2019 on Excelsior Bay. 6. Approve SABLID Assessment Roll Action – Accepted the St. Alban’s Bay Lake Improvement District (SABLID) 2019 budget and levy as presented and adopted Resolution 2018-43 – Resolution Levying the Assessment Roll for the St. Alban’s Bay Lake Improvement District. 7. Landmark Designation for 242 First Street Action – waived the first reading and scheduled a second reading for the November 19, 2018 meeting for Ord. No. 583 -An Ordinance Amending the City of Excelsior Heritage Preservation Design Manual by Adding 242 1st Street as a Landmark. 8. Heritage Preservation Committee Change of Start Time Action – Amended the bylaws. 9. 2019 Geotechnical/Environmental Professional Services Proposal Action – Authorized professional services proposal by WSB for Geotechnical Evaluation for the 2019 Street and Utility Improvement Project. Minutes City Council Meeting November 5, 2018 Page 3 (b) Consent Agenda - Continued 10. First Reading of the Oak Hill Cemetery Parking Ordinance Action – Waived the first reading of Ordinance No. 585 and schedule the second reading to the November 19, 2018 City Council meeting. 11. 2018 Sewer Lining Ad for Bids Action – Received plans and specifications and authorized advertisement for bids for the 2018 Sewer Lining Project 12. Waters Easement Agreement and Stormwater Maintenance Plan Action – Approved the Easement Agreement and Stormwater Maintenance Plan and the Easement and Encroachment Agreement. 7. PUBLIC HEARINGS (a) None 8. PETITIONS, REQUESTS and COMMUNICATIONS (a) Request for Additional On-Sale Liquor License Carlson moved, Caron seconded, to waive the first reading of Ordinance No. 586 – An Ordinance Amending Chapter 4, Article II, Division 2, Section 4-63, of the Excelsior City Code, as presented, and schedule a second reading for November 19, 2018. Motion carried 4/0. (b) Special Event Request for Ice Castle in The Commons The Council directed staff to work with the event organizers to create some terms and conditions for the event in The Commons this Winter and to bring it back to the City Council for approval at the Special City Council Meeting on Friday, November 9, 2018 at 10:00 am. Motion carried 4/0. 9. ORDINANCES and RESOLUTIONS (a) None 10. REPORTS of OFFICERS, BOARDS, and COMMITTEES (a) None 11. UNFINISHED BUSINESS (a) Conflict of Interest Council provided staff some direction on issue and asked that this be added to the City Council Bylaws. Staff will bring a revised version of the code to the Council for the first reading at a future meeting. Minutes City Council Meeting November 5, 2018 Page 4 12. NEW BUSINESS (a) Schedule a date for the Canvassing Board to Meet Carlson moved, Caron seconded, to schedule the Canvassing Board to Meet on Friday, November 9, 2018 in the Council Chambers at 10:00 a.m. Motion carried 4/0. (b) Christkindlsmarkt Miller moved, Caron seconded, to approve the reduced fee of $1000.00 for the Christkindlsmarkt Event for 2018. (c) Downtown Retailers Holidays in Excelsior Carlson moved, Caron seconded, to approve the special event permit for the Excelsior Retailer’s Holidays in Excelsior wagon rides on Saturday December 1st, 8th, 15th and 22nd at a reduced permit fee of $200.00 total. Motion carried 4/0. (d) Pavement Management Plan Council provided the City Council direction to move forward. 13.
