City of Excelsior City Council Meeting MINUTES Monday, July 8, 2019 6:30 P.M. 1. CALL TO ORDER Acting Mayor Caron opened the meeting at 6:40 p.m. 2. ROLL CALL City Council: Councilmembers Dierking, Kurschner, Miller and Acting Mayor Caron Absent: Mayor Carlson Staff: City Manager Luger, City Attorney Staunton, Public Works Superintendent Amundsen, City Planner Becker, Finance Director Horn and City Clerk Peterson 3. APPROVAL OF MINUTES (a) June 17, 2019, Work Session Minutes Dierking moved, Miller seconded, to approve the June 17, 2019 Work Session Minutes. Motion carried 4/0. (b) June 17, 2019, City Council Minutes Dierking moved, Miller seconded, to approve the June 17, 2019 City Council Minutes. Motion carried 4/0. 4. RECOGNITION AND OPEN FORUM Karen Schott, 320 Oak Street, addressed the City Council. 5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS (a) Ice Castle Event Update Amundsen provided an update on the Ice Castle Event. (b) 2019 Street and Utility Improvements Project Update Amundsen provided an update on the 2019 Street and Utility Improvements Project. Minutes City Council July 8, 2019 Page 2 (c) City/Chamber Memorandum of Understanding Update Dierking provided an update on the City/Chamber Memorandum of Understanding. (d) July 22nd City Council Meeting in The Commons Acting Mayor Caron stated that the July 22 Work Session and Council Meeting will be held at The Commons and invited residents to an ice cream social with the Council and City Staff starting at 5:30 p.m. In case of rain, an announcement will be placed on the website and the event will be held in the Council Chambers. 6. MEET EXCELSIOR Mark Schnorr, South Lake Cycle, 344 Water Street, addressed the City Council. 7. AGENDA APPROVAL (a) Meeting Agenda Kurschner moved, Dierking seconded, to approve the July 8, 2019 Meeting Agenda. Motion carried 4/0. (b) Consent Agenda Dierking moved, Miller seconded, to approve the Consent Agenda for July 8, 2019. Kurschner requested additional information on the Mill Street Trail Open House. Motion carried 4/0. 1. Approve Verified Claims – Approve for Payment Manual Checks 085387 – 085458. Action - Approved for payment manual checks 085387 - 085458. 2. First Reading of Ord. No. 600 – Exempt 221 Academy Avenue from Snow Removal Action – Waived first reading of Ord. No. 600 – Exempting Sidewalk Snow Removal for 221 Academy Avenue and scheduled a second reading for July 22, 2019. 3. 10,000 Lakes Concours D’Elegance Temporary Liquor License Action – Approved temporary liquor license application for 10,000 Lakes Concours D’Elegance on July 28, 2019 in The Commons. Minutes City Council July 8, 2019 Page 3 4. 2020 Southwest Assessing Contract Action – Approved 2020 assessment contract with Rolf Erickson Enterprises, Inc. to provide assessment services with the City of Excelsior in the amount of $22,928 for the 2020 calendar year. 5. June Building Permit Report Action – Accepted the June Building Permit Report. 6. Park Zero-Turn Mower Purchase Action – Approved the purchase of the Toro 3000 Series Z Master with attachments from Minnesota Equipment Inc. for the cost of $13,536.54. 7. Amendment to Governmental Bonds Post-Issuance and Compliance Policy Action – Adopted the Amended City of Excelsior Government Bonds Post-Issuance and Compliance Policy. 8. Pay Voucher No. 1 – 2019 Street and Utility Improvement Project Action – Approved Construction Pay Voucher No. 1 for the 2019 Street and Utility Improvement Project and authorized payment in the amount of $20,731.37 to Northdale Construction Co., Inc. 9. Res. No. 2019-30 Accepting In-Kind Donations for the July 22, 2019 City Council Ice Cream Social Action – Adopted Resolution 2019-30 – A Resolution Accepting In- Kind Donations for the July 22, 2019 Ice Cream Social. 10. Acknowledge 10% Gambling Donations Action – Acknowledged charitable gambling donations. 8. PUBLIC HEARING (a) Public Hearing and Bond Resolutions – 2019 Street and Utility Improvement Project Acting Mayor Caron opened the Public Hearing at 7:14 p.m. The Public Hearing was closed at 7:15 p.m. Minutes City Council July 8, 2019 Page 4 Kurschner moved, Miller seconded, to adopt Resolution No. 2019-31 – Adopting a Street Reconstruction Plan and Approving the Issuance of General Obligation Street Reconstruction Bonds and Resolution No. 2019-32 – A Resolution Providing for the Competitive Negotiated Sale of $5,985,000 General Obligation Street Reconstruction Bonds, Series 2019A. Motion carried 4/0. 9. PETITIONS, REQUEST and COMMUNICATIONS (a) 2019 Crazy Days Kurschner moved, Dierking seconded, to approve the 4-day special rate of $500 for the 2019 Crazy Days event. Motion carried 4/0. 10. ORDINANCES AND RESOLUTIONS (a) None 11. REPORTS OF OFFICERS, BOARDS, and COMMITTEES (a) Park and Recreation Commission 1. Bruce Kelly’s Inflatable Dock Lift Request Miller moved, Kurschner seconded, to amend the Mooring Policy with the stipulations recommended by the Park and Recreation Commission to allow for the proposed installation of an air dock boat lift including Council stipulations that the dock needs to be either black or white in color, removed if the boat is out of the slip for an extended period of time and removed and cleaned at the end of every season. Motion carried 4/0. (b) Planning Commission 1. Appendix E Interim Policy Language Attorney Staunton reviewed the ordinance interpretation regarding Appendix E Interim Policy language. A discussion was held and Council Members Kurschner and Miller will meet with City staff and Attorney Staunton on Tuesday, July 9, to draft language to bring to the Planning Commission for review on July 15. If approved by the Planning Commission on July 15, the language will be brought to the City Council on July 22 as an emergency ordinance. Minutes City Council July 8, 2019 Page 5 2. First Reading of Ord. No. 601 – Shoreland Grading Dierking moved, Kurschner seconded to waive the first reading of Ord. No. 601, an ordinance amending Article 60 – Shoreland Management District of the Appendix E of the City Code and schedule the second reading for the July 22, 2019 City Council Meeting. Carried 4/0. 3. First Reading of Ord. No. 602 – Administrative Lot Combinations Kurschner moved, Dierking seconded, to waive the first reading of Ord. No. 602 (a), an ordinance amending Division 2 – Administrative Subdivisions of Chapter 30 – Subdivisions and schedule the second reading for the July 22, 2019 City Council Meeting. Motion carried 4/0. 4. First Reading of Ord. No. 603 – Variance Amendments Dierking moved, Kurschner seconded, to waive the first reading of Ord. No. 603, an ordinance amending the zoning ordinance to Amend Article 6 – Administration – Variances amending the language to include “Any change to a variance shall be reviewed by the Planning Commission and City Council” and schedule the second reading for the July 22, 2019 City Council Meeting.
